5B. Authorize the Ma or to execute an Interlocal Agreement between the Ci of Colleyyille and
the City of Southlake for water, refuse, and rec clables collection and billing of sanitya sewer
services on behalf of Colleyyille for the Timarron Village H, Phase 3. Subdivision. Allied
recently informed the City of Colleyville that they would no longer provide garbage service to
the portion of Timarron located within the city limits of Colleyville, Apparently, they were
unaware that this area was not in our city limits and have provided services to the homes as
they became occupied.
At a meeting with the City of Colleyville, IESI (Colleyville's provider), Allied and myself, we
discussed the possibility of amending our interlocal with Colleyville (for water) to provide for
garbage service through Allied, This would be the best approach to eliminate garbage trucks
rolling through that portion of Timarron four days a week (IESI collects on different days than
Allied). Also, the city would begin billing the residents for sewer service provided by
Colleyville and forward the funds to Colleyville. This approach cuts down on confusion and
ensures seamless service to those residents.
Allied and IESI are also working up a letter of agreement between the two companies so that
there are no issues between them when Allied serves IESI's territory.

7A, ZA05 -086. Site Plan for Lot 3, Pla ers Circle Addition located on the south side of West
Southlake Boulevard at the intersection of West Southlake Boulevard and Meadowlark Lane.
Current Zoning: C -3 General Commercial District. SPIN Neighborhood #16. PUBLIC
HEARING. Dr, J. Lee Pettigrew is requesting approval of a site plan for a 6,245 square foot
dental/medical office building on the proposed Lot 3, Players Circle Addition. The concept
plan establishing this pad site was approved April 19, 2005, There are no variances requested,
The Planning and Zoning Commission recommended approval (5 -0) subject to review.
The City Council had questions regarding the 8 -foot privacy wall located on the north side of
the building. The wall is dashed in on the building elevations and is shown in plan view on the
site plan. The wall is to be constructed of same masonry materials as the building. The
applicant indicated that the purpose of the wall is to provide a court yard and privacy screen for
the adjoining patient treatment rooms. The rooms are set up so that the patient is facing the
windows during treatment. It is also meant to help distinguish the employee entry and parking
area from the patient entry and parking area.

Pointe Phase 2 being Lots 4 and 5 Joel W. Chivers No. 350 Addition located at 2660
R.id ecrest Drive. Current Zoning AG Agnpultural District. Requested Zoning: SF -20A Sin le
Family Residential District. SPIN Neighborhood #3. PUBLIC HEARING. The plan
proposes the development of two residential lots on approximately 1.04 acres. This site
currently contains a non - conforming four -plex apartment unit. This property is designated for
"low density residential" development which limits residential development with a net density

not exceeding one dwelling unit per acre. The density of this proposal is 2.10 dwelling units
per acre and does not comply with the city's land use plan. Justification for deviation from the
land use plan should be included in any motion for approval.
The Planning and Zoning Commission recommended approval (5 -0) subject to review.
The City Council approved the first reading Sept. 20, (7 -0) subject to concept plan review
summary #3, dated Sept, 2, and subject to the fence line along the south property line being
wrought iron instead of wood and with the following considerations regarding compliance with
the land use plan.:
• this property can be considered part of the overall Oak Pointe project and as a result,
it equates to approximately one house per acre;
these two new lots abut the open area; and,
* it will eliminate an eyesore.

#3. This is the plat for the previous zoning item. Since this plat is only two lots and less than
10 acres, it was processed as a "Plat Showing" sometimes known as a "short form" plat. The
subdivision regulations require that these type plats be named under the original land grant
name and abstract number. Because this is to be developed as part of Oak Pointe, a variance to
allow naming it Oak Pointe Phase 2 is requested, Otherwise, there are no unresolved issues
with this plan

North Carroll Avenue and East Highland Street. Current Zoning: CS Community Service
District. Requested Zoning: S -P -1 Detailed Site Plan District with 0-1 Office District uses.
SPIN Neighborhood #5. PUBLIC HEARING. The plan proposes to change the zoning to
allow general office uses and day care use and allow future expansion of the former Carroll
I.S.D. administration building from 4,171 square -feet to approximately 5,196 square -feet on
approximately 0,88 acres.
The "S -P -1" zoning generally adheres to the "O -1" office district uses and regulations with the
following exceptions:
• the permitted uses shall include the "0-2" office district use of day care nurseries or
equivalent child care services; and
• the existing building shall be allowed to encroach into the required 30 -foot front
setback along East Highland Street.
The following variance is being requested:
• DrivewU Spacing — A minimum distance of 150 feet is required from an
intersection. The applicant is proposing ±100 foot spacing from the intersection

item. The Planning and Zoning Commission recommended approval (5 -0) subject to plat
review summary #2, dated Sept. 2; and subject to the provisions of the zoning change and site

Southlake Boulevard and North. Carroll Avenue. Current Zonin S -P -2 General Site Plan
District. SPIN Neighborhood #8. PUBLIC HEARING. The plan proposes approximately
170,000 square feet of retail and restaurant development. The following variances are
requested:
• screening wall along boundary in excess of 8 feet in height;
• screening wall utilizing materials other than those of the front building fagade;
• exemption of 8 -foot tall masonry trash enclosure in lieu of other screening methods
on the trash receptacles located in the rear of the property;
• textured paint on tilt wall (stucco appearance) in excess of 80% on certain rear
building facades; and
• lighting variance to allow metal halide type lights instead of high pressure sodium
or a light providing similar lighting effect.
The Planning and Zoning Commission recommended approval on Sept. 22, (5 -0) as presented,
subject to site plan review summary #3, dated Sept. 16, granting the requested variances for:
• screening wall along boundary in excess of 8 -feet in height;

• screening wall utilizing materials other than those of the front building facade;

• lighting variance to allow metal halide type lights instead of high pressure sodium

Also, accepting the applicant's willingness to meet with the neighbors to further discuss the
proposed wall and noise issues and to provide an encroachment easement along the southern
boundary to address residential fence connections to the masonry wall proposed along the
southern boundary line.

7G. Variance to the Noise Ordinance No. 778 as it pertains to certain commercial o erations of the
p roposed retail center known as the Sho s at Southlake located at the southeast corner of East
Southlake Boulevard and South Carroll Avenue. Shops at Southlake may require a variance
from the above noise regulations of the City Code. At present, a 14 -foot wall is proposed along
a portion of the southern property line to buffer the adjoining residences from noise nuisances
expected to be generated by the proposed adjacent commercial operations. This wall would
meet the city's standards of limiting noise at the residential properties to under 55 decibels.
However, due to the scale and aesthetic concerns of a 14 -foot wall, City Council and adjoining
property owners may opt for a lower wall, In that case, a variance to the noise standards will
be needed for the development, and you will take no action on this item.
The staff report for this item includes a noise comparison table and the acoustical engineering
analysis and report for the Shops of Southlake and Central Market.

7H. Consider SP05 -258. Conditional Si Permit for the Sha s of Southlake located at the
southeast corner of East Southlake Boulevard and South Carroll Avenue. This proposal
addresses the major entry features, monument signs, attached signs and window signage The
major points are as follows:
• three major entry features, 30 -feet tall - two on Southlake Boulevard and one on
Carroll Avenue;
• two monument structures one foot taller than permitted by the sign ordinance - one
on Southlake Boulevard and one on Carroll Avenue;
• criteria for attached signs based on tenant size and distance from the street,
including specific signage for Central Market;
criteria for window signs and rear entry signs;
• criteria for banner signage on light fixtures within the development;
• sign color and letter construction.

7I. Ordinance No. 891. 2 °d Reading. officially changing the street name of "Chap el Downs Drive
West" located west of North White Cha el Boulevard to "West Chapel Downs Drive" and
officially char in the street name of "Cha el Downs Drive" located east of North White
Chapel Boulevard to "East Cha el Downs Drive." PUBLIC HEARING. The Chapel Downs
subdivision is located on the east side of White Chapel Boulevard and is directly across from
the Oak Hill subdivision. The major east -west roadway through the subdivision was named
"Chapel Downs Drive." The Oak Hill subdivision is located on the west side of White Chapel
Boulevard, just south of Carroll High School (9 & 10 grades). The major east -west road
through this subdivision was also named "Chapel Downs Drive"
During the mid 1990's, it appears that the name of road for that portion of the Chapel Downs
Drive located west of White Chapel Blvd. was changed to "Chapel Downs Drive West."
However, the portion of the roadway east of White Chapel Blvd. remained "Chapel Downs
Drive."

During this same time, street signs were erected along White Chapel Blvd, designating the
roads as "W. Chapel Downs Drive" and "E. Chapel Downs Drive" respectively. These street
signs do not match the official street names. The inconsistent naming of the streets has
possibly lead to at least one resident located in the Oak Hill subdivision having mail and other
packages incorrectly delivered to a home in the Chapel Downs subdivision with the same
numerical address.
In order to eliminate any future confusion and with the extension of Chapel Downs Dr. West
into the proposed Sandlin Manor subdivision, staff is recommending that the official street
names be changed to East Chapel Downs Drive and West Chapel Downs Drive and that street
signs be installed that accurately reflect the official name of the streets.

IOA. ZA05 -074 Preliminga Plat for The Reserve at Southlake being a pproximately 30 acres is
located on the west side of Sunshine Lane. gpproximatelv 2269 feet north of East Highland
Street. Current Zoning: SF -1A Single Family Residential District. SPIN Neighborhood #5.
Huitt - Zollars is requesting approval of a preliminary plat proposing 24- residential lots of one
acre or more on approximately 30 acres. Staff recommends a street stub into the south
boundary. The applicant is requesting that the street stub not be required. The property owner
to the south has requested that the street stub be provided in a manner that would allow for
future development of the western portion of his property. A response letter from the owner is
included in the staff report.
The Planning and Zoning Commission recommended approval (5 -0) subject to plat review
summary #3, dated Sept, 2, granting the variance for elimination of the street stub;
recommending the study of the HEC -1 and HEC-2 assumptions by a third party prior to
council; and, recognizing the applicant's willingness to deed restrict the fencing around the
entire perimeter and on the west side along the 100 year flood plain to five -foot wrought iron.

Cheatham and Associates is currently reviewing the HEC-1 and HEC -2 assumptions to insure
reliability of the conclusions of the drainage study. Staff will provide this information prior to

10B. Consider SP05 -223. Variance to Sign Ordinance No. 704 -B for Clearview E ecare and Laser
Center, located at 2100 East S.H. 114. This property is located on the westbound frontage road
of State Highway 114 at the northeast corner of Briarwood Drive. The proposed sign
placement is at 99 feet from the right- of-way which permits a maximum of 12 -inch letters.
This distance is one foot short of allowing up to 18 -inch letters, The variance request is as

13. Some of the events include the trucWtrailer competition, zero turn mower obstacle course,
irrigation assembly, backhoe operation, plant identification, and playground inspection.

3. Texas APA Awards Luncheon. As you know, the Texas American Planning Association has
chosen the City of Southlake's 2025 Consolidated Land Use Plan and Mobility and Master
Thoroughfare Plan as the recipient of the Chapter's 2005 Comprehensive Planning Award. The
Chapter will present the award at a brief ceremony during a luncheon on Friday, Oct. 7. If you
would like to attend the luncheon, please contact Ken Baker so that reservations can be made.
4. Oktoberfest The City of Southlake, the Southlake Chamber of Commerce and Southlake

6. Cijy wide sidewalk construction. In an effort to avoid confusion and keep Southlake residents
informed about future location of sidewalks, staff recommends the following steps prior to
commencement of construction work:
• all property owners that have frontage or side yards abutting the right of way where
a sidewalk is to be constructed will be informed in writing;

METROPORT MEALS ON WHEELS
etroport Meals On Wheels, Inc. is a nonprofit organization which organ -
°HHFF� izes volunteers to deliver hot lunches to homes of individuals who are
elderly, frail, chronically ill or in need of special help. Although most pro-
gram participants receive meals on an on -going basis, MMOW helps
during periods when someone needs temporary or short -term assistance.
MMOW also provides help for active seniors by creating and managing senior center commu-
nity luncheons and activity programs and promoting already established senior centers.
We are currently in need of volunteers to assist with Tuesday luncheons at the Senior Center

Starting August 15
residents of Southlake can
register online for
recreational activities.
Internet registration is
expected to improve
customer service by
providing twenty -four hour a
day, seven day a week
access for program
registration. RecNet is the
network of recreational
services that provides this
online service and can be
accessed through any
internet- connected
computer. Visit the City's
recreation web site

access on -line registration.
Summer athletic programs
continue to grow. This year,
the track program had 115
participants; one- hundred-
seventy people participated
in the swim program;
summer basketball had 300
players and 34 teams; and
volleyball had 200 players
and 18 teams.
Non - athletic programs and
special events also continue
to be very popular as
residents take part in
such activities as the Stars
and Stripes celebration,
Masterworks Music Series,
Camp Mania, Teen Camp,
and BooBoo's Buddies
Annual Pet Celebration.

Rodeo. This year's rodeo is
scheduled for October 6 th at
Walker's Creek Park in
North Richland Hills
beginning at 8:00 a.m.

maintenance employees.

Harvest Fest

Come join us as we celebrate the fall season at the annual Harvest
Fest and Carnival. Entertainment will include a magic show,
Halloween show, and costume parade. There will be numerous
activities for children such as bounce houses, carnival games, face
painting, balloon art, and pumpkin decorating. The Bob Jones
Nature Center is sponsoring the "Wings of the Night" hike where
participants can get an up close look at real bats. Food, drinks,
and other goodies will also be available.
