Item 7HCity of Southlake Department of Planning STAFF REPORT September 14, 2005 CASE NO SP 05 -210 P ROJECT: Conditional Sign Permit for Players Circle Addition REQUEST: Request for a Conditional Sign Permit for the Players Circle Addition development for monument signs to serve the overall site. The applicant is proposing to allow one (1) principal monument sign at the street intersection to serve the entire development. Additionally, the applicant is proposing that one standard monument sign be allowed on Lot 9 that will be shared with Lot 8. Last, the applicant is proposing minor monument signs for properties that have frontage along Players Circle. Under Sign Ordinance No. 704 -B, one monument sign is permitted per street frontage per site. If a site has two street frontages and proposes two signs, the signs must be a minimum of 500 feet apart. The principal monument sign is the only proposed sign that does not meet the development regulations for monument signs. The specific regulations of the principal monument sign requested are as follows: Sign Reg. PROPERTY SITUATION: The property is located on the south side of W. Southlake Blvd., at the intersection of FM 1709 and Meadowlark Lane. REQUEST: The applicant is proposing a principal monument sign to serve as the main sign for the Players Circle development. The proposed sign will be of a size and design greater than permitted under Sign Ordinance No. 704 -B. Additionally, the applicant is proposing a standard monument sign to be located on Lot 9 and shared with Lot 8 and is also proposing minor monument signs to be permitted for the lots fronting Players Circle. Approval of a Condition Sign Permit is required in order to receive a building permit for these signs. STAFF COMMENTS: The sign criteria, site plan and application are attached to this report. The following variances to Sign Ordinance No. 704 -B are requested for the proposed principal monument sign: Ord. 704 -13, Section 16.13.3 MAXIMUM HEIGHT Four (4) feet, excluding monument base and sign structure. The monument base maybe an additional eighteen (18) inches in height measured from ground level at the center of the base to the top of the base. The sign structure shall not exceed five (5) feet. The applicant is requesting a sign height of 9 feet and a structure height of approximately 22 feet. Ord. 704 -B, Section 16.13.3 MAXIMUM AREA One hundred (100) square feet per sign with a maximum area per sign face of fifty (50) square feet. The maximum area for the sign structure shall not exceed seventy (70) square feet. The applicant is requesting a sign area of 135 square feet with 45 square feet per sign face on 3 sign faces. The applicant is requesting a sign structure area of X223 square feetper sign face on 3 sign faces. The City Council may authorize a Conditional Sign Permit in accordance with the following provisions of the Sign Ordinance No. 704 -13, Section 6, Conditional Sign Permit: GENERAL: Notwithstanding anything in this ordinance to the contrary, the erection of a sign or signs may be approved pursuant to this section under a conditional sign permit approved by the City Council. The purpose of this section is to allow for a specialized review of signs which may not be appropriate generally without certain restrictions, but which, if controlled as to the number, size, height, color, location, lighting, or relation to adjacent properties, would promote the health, safety, and welfare of the community. Case No. SP 05 -210 Attachment A Page 1 Conditional permitting of signs shall not be based upon the content of the sign, but is intended to allow for the evaluation of the physical impact of the proposed sign on adjacent properties and to ensure adequate mitigation of potentially unfavorable factors, such as the number, size, height, color, location, lighting, and other potentially unfavorable impacts. N05 SCALE: 1/2" = 1' - 0" Sign Variance Application Demonstration Please demonstrate that the following conditions are applicable to the requested sign variance: That a literal enforcement of the sign regulation will crate an unnecessary hardship or practical difficulty on the applicant. There are 8 lots in "The Pavilion" and some Lots have no frontage or very limited visibility to Southlake Blvd. 2. That the situation causing the unnecessary hardship or practical difficulty is unique to the affected property and is not self imposed. The situation is unique because of the depth of the property and the need for knowing the location of the tracts. 3. That the variance will not injure and will be wholly compatible with the use and permitted development of adjacent properties. The Southlake Maket Place Shopping Center is west of the tract and has a sign with multiple names. 4. That the variance will be in harmony with the spirit and purpose of the sign ordinance.
