ATTACHMENTS: (A) Background Information (B) Vicinity Map (C) Site Exhibit (D) Sign Detail (E) Sign Variance Application STAFF CONTACT: Dennis Killough (481 -2073) Ken Baker (481 -2036) Case No. SP 05 -225 BACKGROUND INFORMATION OWNER/APPLICANT: 24 Hour Fitness PROPERTY SITUATION: On the south side of East Southlake Boulevard, east of the intersection of East Southlake Boulevard and Kimball Avenue. The address is 2315 East Southlake Boulevard, Suite 110. REQUEST: The applicant is proposing to display temporary "H- stake" ground signs, which are not a permitted sign type under Sign Ordinance No. 704 -B. STAFF COMMENTS: The sign criteria, building elevations, site plan and applications are attached to this report. The following variances to the Sign Ordinance No. 704 -B are requested: • Ord. 704 -13, Section 17.A. PROHIBITED SIGNS: Any sign which is not specifically permitted in the ordinance is prohibited. The applicant is proposing to display two temporary "H -stake " ground signs for approximately 45 days from mid - September to mid - October to advertise their presale site. The applicant will remove the signs at dusk every night. This type of temporary ground sign is not specifically permitted in the ordinance. • Ord. 704 -13, Section 16.C.3 GROUND SIGN MAXIMUM HEIGHT: The maximum height for ground signs is three (3') feet. The applicant is proposing to display ground signs that are 3 feet 10 inches in total height. The City Council may authorize variances in accordance with the following provision of the Sign Ordinance No. 704 -13, Section 14, Variances: The City Council may authorize variances to any restriction set forth in this ordinance, including but not limited to the number, type, area, height, or setback of signs, or any other aspect involved in the sign permitting process. In granting any variance, the City Council shall determine that a literal enforcement of the sign regulations will create an unnecessary hardship or a practical difficulty on the applicant, that the situation causing the unnecessary hardship or practical difficulty is unique to the affected property and is not self - imposed, that the variance will not injure and will be wholly compatible with the use and permitted development of adjacent properties, and that the granting of the variance will be in harmony with the spirit and purpose of this sign ordinance. A person may request a variance from the Sign Ordinance by filing the request with the Building Official. Any request for variance shall be accompanied by a completed application and a non- Case No. Attachment A SP05 -225 Page 1 refundable filing fee in the amount specified in the current fee schedule adopted by City Council. Due to the location of the presale there is low visibility from the street due to a grass embankment, trees and low shrubs. Without the ability to draw attention from the street we have very limited walk in traffic or even neighborhood awareness that the pre -sale site is there. Due to restrictions we are not allowed to place H -stake or A- Frames out on the embankment to help draw people in to sign up. 2. Case No. SP 05 -225 When 24 hour Fitness originally signed the lease for this retail site we were in the winter months and the obstruction of trees and low shrubbery could not be anticipated due to the spring and summer growths. Because of this, and as the photos demonstrate below, there is decreased visibility from the street turning into the parking lot heading West (photo 1) �vel looking out our signage on the kiosk. We request the below opportunities to advertise and draw attention to our pre -sale and permanent site for the following months. • Pre -Sale Location o (2) H- Stakes/ Real Estate Signs • Placed outside every morning and retrieved at dusk same day. • Duration from September 6 through October 15 • Location on grassy area in front of presale to draw attention to sign up location • Verbiage: 24HF branding, Now Enrolling with phone number. • Exhibit #3 Permanent Location o (1) Banner — 50 sq foot banner on build location with Sneak Peek Party details. • Request extension on the allowed time to 30 days. Banner will go up one month prior to the event • Estimated date up September 15 • Estimated down date November 17 • Location on the front fagade of the building. • Verbiage: 24HF branding, Now Open with party details • Exhibit #1 (4) Wind sails — to be located at permanent site. • Estimated date up October 15 • Estimated date down December 15t • Located in grassy area in front of club, evenly spaced along the frontage. • Verbiage: 24HF branding, Now Enrolling with phone number. • Exhibit #2 4. Each request is a temporary but viable solution to the immediate problem of lack of visibility and awareness to the new pre -sale site as well as placing extra emphasis on the permanent location during Sneak Peek and Grand Opening months in hopes of getting this club back on track compared to the goals laid out to our financial board. As stated above, certain signage will be up for a period of time while other signage will be removed every evening and replaced the next business day to keep in order to compliment Southlake City planning enforcement.
