BACKGROUND INFORMATION
APPLICANT: Eyeworks Group of Southlake
OWNER: Robert Chu
PROPERTY SITUATION: The property is located on the southeast corner of the intersection of East
Southlake Boulevard and Bank Street. The address is 3105 East Southlake
Boulevard.
REQUEST: The applicant is proposing a monument sign on the southeast corner of the
intersection of East Southlake Boulevard and Bank Street. The proposed
sign will lack the 6 inches of masonry surrounding the entire sign face as
required under Sign Ordinance No. 704 -B. The exposed portion of the sign
is proposed to be brushed aluminum /stainless steel. Approval of a variance is
required in order to receive a building permit for this sign.
STAFF COMMENTS: The sign criteria, building elevations, site plan and applications are attached
to this report. The following variance to Sign Ordinance No. 704 -B is
requested:
• Ord. 704 -B, Section 16.13.7 MATERIAL REQUIREMENTS The sign
structure must be constructed or covered with the same masonry material
as the principal building, or stone, or brick. All sign text and graphic
elements shall be limited to a minimum of six (6) inches from the outer
limits of the sign structure.
The applicant is proposing that the sign have masonry on two sides with
the remaining exposed sides being metal (brushed aluminum /stainless
steel).
The City Council may authorize variances in accordance with the following
provision of the Sign Ordinance No. 704 -B, Section 14, Variances:
The City Council may authorize variances to any restriction set forth in this
ordinance, including but not limited to the number, type, area, height, or
setback of signs, or any other aspect involved in the sign permitting process.
In granting any variance, the City Council shall determine that a literal
enforcement of the sign regulations will create an unnecessary hardship or a
practical difficulty on the applicant, that the situation causing the
unnecessary hardship or practical difficulty is unique to the affected property
and is not self- imposed, that the variance will not injure and will be wholly
compatible with the use and permitted development of adjacent properties,
and that the granting of the variance will be in harmony with the spirit and
purpose of this sign ordinance. A person may request a variance from the
Sign Ordinance by filing the request with the Building Official. Any request
for variance shall be accompanied by a completed application and a non-

refundable filing fee in the amount specified in the current fee schedule
adopted by City Council.

Sign Variance Application
DEMONSTRATION
RE: EYEWORKS PROJECT — MONUMENT SIGN —
CORNER OF SOUTHLAKE BOULEVARD AND BAND STREET
1.
We have gone to great length to come up with a "look" that we can consider unique to
our particular name. We are seeking a contemporary "Miami tropical look" - if there is
such a thing, with outside patio spaces, palm trees, permanent awnings etc. Having
invested so heavily in this look, not being allowed a monument sign that would be in
harmony would, in our opinion, constitute a hardship..
2.
If, by your definition, the architect's design is self-imposed, we may have a hard time
meeting this criteria. however, our request is based on our hoping to be allowed to keep
the monument sign in harmony with the unique design and "look" of our building.
3.
Our proposed monument sign is designed to be in harmony with our building. We firmly
believe that the design and high costs /quality of our new building is very much in
harmony with the sophisticated appearance of the entire retail corridor that's been created
in this area, including our immediate neighbors.

To the best of our knowledge all city monument requirements are being complied with
relative to height, overall dimensions and the spirit of your ordinances.
Please understand that we are not in any way asking for this variance for the purposes of
greater exposure than that to which we are entitled, nor are our motives related to costs
issues.
