REQUEST: On behalf of Eliot House (Drews) Partners I, L.P., Pogue Engineering is requesting
approval of a plat revision. The purpose of the plat is to dedicate the right -of -way for
Zena Rucker Road and to revise the lot existing lot lines between Lots 2R and 3R,
Block 60, Timarron Addition Phase 5.

PROPERTY SITUATION: The property is located on the southeast corner of E. Southlake Blvd. and
Byron Nelson Pkwy., at 611 -641 E. Southlake Blvd. and 409 Byron Nelson
Pkwy.
LEGAL DESCRIPTION: Lots 2R & 3R, Block 60, Timarron Addition, Phase 5
LAND USE CATEGORY: Retail Commercial
CURRENT ZONING: "R -PUD" Residential Planned Unit Development District
HISTORY: -City Council approved a change of zoning to "R -PUD" with associated
concept plan for Timarron Addition, Phase 5 on May 21, 1996.
-A development plan and preliminary plat were approved for Timarron
Addition, Phase 5 on May 7, 1996.
-A revised preliminary plat for Lots 2, 3, & 4, Block 60, Timarron Addition,
was approved by City Council on November 5, 1996.
-A final plat was approved by P &Z on November 7, 1996.
-City Council approved a plat revision on March 3, 1998.
-A revised development plan was approved by City Council on January 4,
2005.
PATHWAYS MASTER
PLAN: The Southlake Pathways Master Plan recommends a natural multi -use trail
along the creek that will connect E. Southlake Boulevard with S. Carroll
Avenue. With construction of Zena Rucker Road, the applicant is proposing
an 8 -foot multi -use trail along the south side of Zena Rucker Road that will tie
into the existing trail system along the east side of Byron Nelson Parkway
before it turns south along the east property line of the proposed Lot 4. This
proposed alignment has been approved by the City's Senior Parks Planner.
P &Z ACTION: July 7, 2005; Approved to Table (5 -0) until July 21, 2005.

* We find the applicant has met all the requirements of our previous reviews. This plat is apparently
ready to file in the County Plat Records.
INFORMATIONAL COMMENTS
* We recommend this plat not be filed until the construction plans have been substantially approved.
This will ensure adequate easements and finish floor elevations.
* A reciprocal shared parking and access agreement must be provided to the City prior to issuance of a
building permit for any building.
* A Developers Agreement is required prior to construction of any public infrastructure. The
Developer's Agreement for this addition should consider streets, drainage, park dedication
requirements and fees, off -site sewer extensions, off -site drainage and utility easements and impact
fees.
* A "Certificate of Taxes Paid" indicating that there are no delinquent taxes owed on the subject
property from each taxing authority must be provided to the City prior to filing this plat in the County
records. A copy of this information may be obtained from the Tarrant county Tax
Assessor /Collector's Office located at 100 E. Weatherford St. in Ft. Worth (across from the old red
courthouse). There is a service charge of $10 per account for this certificate. For more information
contact the Assessor /Collector's office at (817) 884 -1103.
* Original signatures and seals will be required three blackline mylars prior to filing the plat. Also
required are two sets of owner's dedications and notaries (8.5" x 11" or 14" paper) with original
signatures and seals on each. Mylars will not be accepted if any erasures or original ink, other than
signatures or seals, appear on the plat.
