BACKGROUND INFORMATION
APPLICANT: Terry Brockett, Starlight Sign
OWNER: Taco Bueno
PROPERTY SITUATION: The property is located on the south side of E. Southlake Blvd.,
approximately 150 feet from the intersection of E. Southlake Blvd. and
Kimball Ave. The address is 2305 E. Southlake Blvd.
REQUEST: The applicant is proposing a new monument sign to replace the existing
monument sign along E. Southlake Blvd. The proposed sign will have a base
size greater than permitted under Sign Ordinance No. 407 -B. Approval of a
variance is required in order to receive a building permit for this sign.
STAFF COMMENTS: The sign criteria, site plan and application are attached to this report. The
following variance to Sign Ordinance No. 704 -B is requested:
Ord. 704 -13, Section 16.13.3 MAXIMUM HEIGHT Four (4) feet, excluding
monument base and sign structure. The monument base may be an additional
eighteen (18) inches in height measured from ground level at the center of the
base to the top of the base. The sign structure shall not exceed five (5) feet.
The applicant is requesting a structure height of 10 feet 9 inches
Ord. 704 -B, Section 16.13.3 MAXIMUM HEIGHT One hundred (100)
square feet per sign with a maximum area per sign face of fifty (50) square
feet. The maximum area for the sign structure shall not exceed seventy (70)
square feet. The applicant is requesting a structure area of 150 square feet
per sign face.
The City Council may authorize variances in accordance with the following
provision of the Sign Ordinance No. 704 -B, Section 14, Variances:
The City Council may authorize variances to any restriction set forth in this
ordinance, including but not limited to the number, type, area, height, or
setback of signs, or any other aspect involved in the sign permitting process.
In granting any variance, the City Council shall determine that a literal
enforcement of the sign regulations will create an unnecessary hardship or a
practical difficulty on the applicant, that the situation causing the
unnecessary hardship or practical difficulty is unique to the affected property
and is not self - imposed, that the variance will not injure and will be wholly
compatible with the use and permitted development of adjacent properties,
and that the granting of the variance will be in harmony with the spirit and
purpose of this sign ordinance. A person may request a variance from the
Sign Ordinance by filing the request with the Building Official. Any request
for variance shall be accompanied by a completed application and a non-

refundable filing fee in the amount specified in the current fee schedule
adopted by City Council.

Sign Variance Application
Demonstration
Please demonstrate that the following conditions are applicable to the requested sign variance:
That a literal enforcement of the sign regulation will crate an unnecessary hardship or
practical difficulty on the applicant.
The slope of the ground make this sign impossible to see when driving East
bound. Our property is unique to this situation.
2. That the situation causing the unnecessary hardship or practical difficulty is unique to the
affected property and is not self imposed.
You can tell by driving FM 1709 that our sign is more difficult to see than other
signs at the same height.
3. That the variance will not injure and will be wholly compatible with the use and permitted
development of adjacent properties.
The increased height we are requesting is simply for view purposes and we plan to
comply with the masonry surround requirements.
4. That the variance will be in harmony with the spirit and purpose of the sign ordinance.
The whole purpose of a sign ordinance is to create uniform look and bring fairness
to competing business, not create a hardship on a particular business.
