BACKGROUND INFORMATION
APPLICANT: Doug Vance, Rapid Refill Ink
OWNER: Park Place Shopping Center Ltd.
PROPERTY SITUATION: The property is located on the northwest corner of the intersection of
Business 114 and Park Blvd. in Grapevine Plaza. The address is 3300 S.H.
114, Suite 103.
REQUEST: The applicant is proposing an attached sign on the south side of the building
facing S.H. 114. The proposed sign will have a letter size greater than
permitted under Sign Ordinance No. 407 -B. Approval of a variance is
required in order to receive a building permit for this sign.
STAFF COMMENTS: The sign criteria, building elevations, site plan and applications are attached
to this report. The following variance to Sign Ordinance No. 704 -B is
requested:
• Ord. 704 -13, Section 16.A.2 MINIMUM/MAXIMUM LETTER/LOGO
HEIGHT The maximum permitted letter height is 12 inches for a sign
less than 100 feet from the right -of -way.
The store front is approximately 76 feet from the right -of -way. The
maximum letter size permitted is 12 inches. The applicant is requesting a
letter height of 15 inches.
The City Council may authorize variances in accordance with the following
provision of the Sign Ordinance No. 704 -13, Section 14, Variances:
The City Council may authorize variances to any restriction set forth in this
ordinance, including but not limited to the number, type, area, height, or
setback of signs, or any other aspect involved in the sign permitting process.
In granting any variance, the City Council shall determine that a literal
enforcement of the sign regulations will create an unnecessary hardship or a
practical difficulty on the applicant, that the situation causing the
unnecessary hardship or practical difficulty is unique to the affected property
and is not self - imposed, that the variance will not injure and will be wholly
compatible with the use and permitted development of adjacent properties,
and that the granting of the variance will be in harmony with the spirit and
purpose of this sign ordinance. A person may request a variance from the
Sign Ordinance by filing the request with the Building Official. Any request
for variance shall be accompanied by a completed application and a non-
refundable filing fee in the amount specified in the current fee schedule
adopted by City Council.
COUNCIL ACTION: Consider variance request.

Demonstration
Please demonstrate that the following conditions are agglicable to the requested sign
variance:
That a literal enforcement of the sign regulation will crate an unnecessary hardship or
practical difficulty on the applicant
Rapid Refill Ink's store location is adjacent to a Blockbuster Video store, which has a backlit 48 inch high blue
sign with 24 inch yellow letters. Restricting Rapid Refill Ink's sign to 12 inches to comply with the regulation will
cause Rapid Refill Ink's sign to be insufficiently visible to potential customers.
2. That the situation causing the unnecessary hardship or practical difficulty is unique to the
affected property and is not self imposed.
Suite 103 is one of two suites adjacent to Blockbuster Video. The tenant of the other suite, Texas Tan,
was allowed a variance, and a sign with 24 inch letters, due to their proximity to the large Blockbuster signage.
The difficulty was not self - imposed in that Rapid Refill Ink does not have control over the adjacent
company's sign.
3_ That the variance will not injure and will be wholly compatible with the use and permitted
development of adjacent properties
Adjacent properties will not be adversely affected by the variance. The sign will be 15 inches tall
and will not interfere with the visibility of adjacent properties and will not impede upon the development
of adjacent properties. The sign for the business on the east side of Rapid Refill Ink (i.e., Blockbuster Video)
is 48 inches high with 24 inch letters, and the sign on the business on the west side of Rapid Refill Ink
(i.e., Qualtrust Federal Credit Union) is 21 inches high with 15 inch letters.
4 That the variance will be in harmony with the spirit and purpose of the sign ordinance,
The sign ordinance permits 12 inch letters for signs less than 100 feet from the right of way and 18 inch
letters for signs 101 -150 feet from the right of way. The exact location of the right of way is difficult to
ascertain, but the proposed sign is 108 feet from the edge of the roadway in front of the suite (Northwest Highway).
The use of 15 inch letters would comply with the spirit of the criterion,
