II REQUEST: Variance to the Sign Ordinance No. 704 -B requirements for the duration of a banner sign for the Southlake Tavern to be located at 2700 E. Southlake Boulevard being the northeast corner of E. Southlake Boulevard and N. Nolen Drive. The specific variances requested are as follows: Sign Reg. Southlake Boulevard, being the northeast corner of E. Southlake Boulevard and N. Nolen Drive (former Big Bowl restaurant). STAFF COMMENTS: The sign criteria, building elevations, site plan and applications are attached to this report. The following variances to the Sign Ordinance No. 704 -B are requested: • Ord. 704 -13, Section 21.A.2.c DURATION Maximum fifteen (15) days, twice per calendar year with a sixty (60) day separation between permits. The applicant is requesting a banner sign for a duration of 60 days. City Council Action: The City Council may authorize variances in accordance with the following provision of the Sign Ordinance No. 704 -13, Section 14, Variances: The City Council may authorize variances to any restriction set forth in this ordinance, including but not limited to the number, type, area, height, or setback of signs, or any other aspect involved in the sign permitting process. In granting any variance, the City Council shall determine that a literal enforcement of the sign regulations will create an unnecessary hardship or a practical difficulty on the applicant, that the situation causing the unnecessary hardship or practical difficulty is unique to the affected property and is not self - imposed, that the variance will not injure and will be wholly compatible with the use and permitted development of adjacent properties, and that the granting of the variance will be in harmony with the spirit and purpose of this sign ordinance. A person may request a variance from the Sign Ordinance by filing the request with the Building Official. Any request for variance shall be accompanied by a completed application and a non- refundable filing fee in the amount specified in the current fee schedule adopted by City Council. The banner sign is allowed for a period of 15 days. The applicant request that the period be extended for a period of 60 days. The building is being greatly remodeled both inside as well as outside, and the amount of time required for this process is much greater that simple interior finish out construction. 2. That the situation causing the unnecessary hardship or practical difficulty is unique to the affected property and is not self imposed. The exterior of the building must be modified to accomplish the change in look away from the oriental exterior that Big Bowl utilized. That the variance will not injure and will be wholly compatible with the use and permitted development of adjacent properties. The requested bannersign is allowed underthe sign ordnance, and will only be placed in front the leased space, and will have no impact on the adjacent properties. 4. That the variance will be in harmony with the spirit and purpose of the sign ordinance. The temporary sign will be consistent with the allowed banner signs, and will be only during the re- construction of the building. Case No. SP 05 -139 Attachment E Page 1
