REQUEST: Variance to the Sign Ordinance No. 704 -B requirements for number of monument
signs and minimum setback. The site is located at 405 -415 South Nolen Drive. The

BACKGROUND INFORMATION
APPLICANT: Identity Management
OWNER: S -SI Southlake Two, LP
PROPERTY SITUATION: The property is located on the northeast side of South Nolen Drive, between
the intersections of Crooked Lane and South Nolen Drive and Silicon Street
and South Nolen Drive. The address is 405 and 415 South Nolen Drive.
REQUEST: The applicant is requesting a second monument sign approximately 220 feet
from the existing permitted monument sign. The applicant is also requesting
to place the sign approximately 12.5 feet from the property line. Approval of
a variance is required in order to receive a building permit for this sign.
STAFF COMMENTS: The sign criteria, building elevations, site plan and applications are attached
to this report. The following variances to the Sign Ordinance No. 704 -B are
requested:
• Ord. 704 -13, Section 16.13.5 NUMBER OF SIGNS Only one monument
sign is permitted along each street frontage on any site. Monument signs
may be no closer than five hundred feet on any one site.
The applicant is requesting to place a second monument sign along South
Nolen Drive to provide sign exposure for 415 South Nolen Drive, which
does not have frontage on Nolen Drive. The existing permitted sign
provides exposure for 405 South Nolen Drive and is located on the
southern corner of the site, near Silicon Drive. The proposed sign will be
located on the northwestern corner of the site, near Crooked Lane. The
second sign will be approximately 220 feet from the existing sign.
• Ord. 704 -13, Section 16.13.6 MINIMUM SETBACK Monument signs
must be fifteen feet from any property line.
The applicant is requesting to place the second sign approximately 12.5
feet from the property line along South Nolen Drive to minimize the
impact of the concrete footing on the root systems of 3 existing trees.
The City Council may authorize variances in accordance with the following
provision of the Sign Ordinance No. 704 -13, Section 14, Variances:
The City Council may authorize variances to any restriction set forth in this
ordinance, including but not limited to the number, type, area, height, or
setback of signs, or any other aspect involved in the sign permitting process.
In granting any variance, the City Council shall determine that a literal
enforcement of the sign regulations will create an unnecessary hardship or a

practical difficulty on the applicant, that the situation causing the
unnecessary hardship or practical difficulty is unique to the affected property
and is not self - imposed, that the variance will not injure and will be wholly
compatible with the use and permitted development of adjacent properties,
and that the granting of the variance will be in harmony with the spirit and
purpose of this sign ordinance. A person may request a variance from the
Sign Ordinance by filing the request with the Building Official. Any request
for variance shall be accompanied by a completed application and a non-
refundable filing fee in the amount specified in the current fee schedule
adopted by City Council.

The Fire Marshall has &taped a preferences for vlsible (sign) presence for Lot
3R (415 S. Nolen) in order to facilitate rapid location of this building and
minimize rie5portse time to this location, as t'hls bluilding will be effectively
scretpled from view from S. Nolen Drive by the building On 11 2RIR,
In order to minimize the impact of the 2"" sign, we have changed the signs
plan from double -sided to single -sided (ore still have a total of 2 sides of
risible signs space, now shared between 2 signs located at either end of the
tracts width; this will optimize being able to locate are address quickly and
easily in proximity to both access driveways, And will minimize improper
slowing of traffic in the vicinity and inappropriate diversiorp of driver;
attention.
We have also angled the Signs t-D approximately 45 degrees from
perpendii ialar, wh will i nc reaSe aesthetics, decrease i mpact of Sign
positioning, and further facilitate address- locating from the thoroughfare.
Pprmitting construction of this 2 sign at this time will enable ors to construct
this sign ovt of lot/color-consistent building materials (masonry) to provide
desirable aesthetics coincidental with the facing elevation~ of the building
being built on Lot 2RiR=
W e are also attempting to minimize the impact of the concrete footing for the
Nortl`'_ rnoFt sign (Signs A) on the root systems of 3 significant specimen
trees which we are attempting to preserve at the front of the property;
placement of the sign in conformance with the 15' property line set -back
requirement will cause this sig to be located within 3" of an existing 20" Ca

tree. We wound like to center the slgn at the midpoint between these trees,
which would cause the sign feting to be 9' from the base of the trees on
either side on the sign.
2, That the $ituation causing the unnecessary hardship or practical
difficulty is unique to the affected property and is riot self imposed.
The manner in which these lots have been platted creates the unique
requirement for 2 signs to he located on a singie tract.
The existing (natural) location of 3 significant trees at the property front
creates the unique situation for which efforts to preserve these tree are
deli red .
3. That the ,variance will not injure and will be wholly compatible with
the use and permitted development of adjacent properties.
The placement of these signs and the manner in which they are constructed
will optimize aesthetics for the neighboring tracts and will optimize -and
facilitate orderly local traffic movements.
4. That the variance will be in harmony with the spirit and purpose of
the slgn ordinance.
All other aspects of the sign ordinance will be complied with acid this variance
whll achieve the desired effect of maximizing aesthetics while at the same
time provIdIng the optimal solution to providing sign exposure for the
