Presentation of Tree City USA and Growth Award Southlake has again been named a Tree City USA. This is the eighth year Southlake has received this national recognition. A brief presentation will be made by The National Arbor Day Foundation. 3. Southlake Sidewalk Sale Staff will make a brief announcement to remind the audience about the June 18 citywide sidewalk sale. 4B. City Manager's Report No report is planned at this time. 4C. Resolution No. 05 -025, Appointment of the Mayor Pro Tem and the Deputy Mayor Pro Tem As stated in the Charter, Section 2.07 Mayor Pro Tem and Deputy Mayor Pro Tem: "At the first meeting after each general election or general election run -off, if any, or as soon thereafter as practicable, the Mayor shall, with the approval of the Council, appoint one of the Council members as Mayor Pro Tem and one as Deputy Mayor Pro Tem who shall hold their offices for one year. The Mayor Pro Tem shall perform the duties of Mayor in case of the absence or disability of the Honorable Mayor and Members of City Council Agenda Item Comments and Other Items of Interest City Council Meeting June 7, 2005 Page 2 of 37 Mayor. In case of absence or disability of both the Mayor and the Mayor Pro Tem, the Deputy Mayor Pro Tern shall perform the duties of Mayor." Authorize the City Manager to purchase 60 desktop personal computers and monitors and 12 printers from Dell Computer for $56,025.56 (State Bid). The long term plan for the city's IT operations includes a refresh/replacement schedule for all of the desktop computers, generally on a three to four year cycle based on the intensity of the usage. There are currently 55 Compaq Deskpro desktop computers that were purchased in late 2001. These pc's are currently experiencing a noticeable failure rate of the hard drives and power supplies as they are at the end of their lifespan. The cost to replace the hard drives, power supplies and to upgrade the memory exceeds the cost of a new personal computer. We are recommending the replacement of these computers with Dell computers. The pricing of $635.79 per machine is extremely competitive for a business class machine. Dell has additionally worked with technical services to provision these machines with all the City designated software at the factory. This relieves technical services of the necessity of further software installation once they arrive at the city. Under this scenario they can be deployed almost immediately upon arrival. These funds were budgeted in the FY 2004 -05 budget. The proposed pricing also includes flat panel monitors and 12 printers. Contact Gary Gregg with questions on this item. 5D. Authorize the Mayor to enter into a three year lease agreement between Applied Concepts, Inc. of Plano and the City of Southlake for 21 vehicle mounted radars for a total of $46,095. Southlake Police utilize radars in all patrol vehicles for speed enforcement within the City. The current Kustom radars are over 12 years old. Radar technology has advanced significantly during this period and now allows much better discrimination of speeding vehicles while the patrol vehicle is in motion. In order to maintain up -to -date technology, a rental agreement is Honorable Mayor and Members of City Council Agenda Item Comments and Other Items of Interest City Council Meeting June 7, 2005 Page 3 of 37 proposed to obtain 21 new Stalker dual antenna radars, which is currently the best technology available. The rental agreement allows the DPS to keep up with technological changes by changing out radar equipment every three years if needed. Authorize the Mayor to execute a commercial developer's agreement for Carroll Terrace located at the northwest corner of the intersection of North Carroll Avenue and Southcrest Court. The final plat for Carroll Terrace, which divides the property into five lots, was approved on November 16, 2004. The developer will construct 415 linear feet of public water lines and 420 linear feet of public sanitary sewer lines to serve these five lots. This developer's agreement covers the construction of the public infrastructure. The developer will pay a park fee of $1,200 per acre for 2.610 acres for a total of $3,132. Authorize the Mayor to execute a commercial developer's agreement for Players Circle Addition located on the south side of West Southlake Boulevard across from Meadowlark Lane. The final plat for Payers Circle Addition, which includes a cul -de -sac public street and nine commercial lots, was approved on May 19. The developer will construct 800 linear feet of public street, 890 linear feet of public water line and 1,045 linear feet of public sanitary sewer line. This developer's agreement covers the construction of these public improvements. The developer will pay a park fee of $1,200 per acre for 10.217 acres for a total of $ 12,260.40. Authorize the Mayor to execute a residential developer's agreement for Brentwood Addition located on the east side of North White Chapel Boulevard approximately 1,000 feet south of Dove Street. The final plat for Brentwood Addition which includes a cul -de -sac public street and nine residential lots was approved on May 5. The developer will construct 1,030 linear feet of public street, 780 linear feet of on -site public water line, 850 linear feet of off -site public water line, 970 linear feet of on -site public sanitary sewer line, 2,300 linear feet of off -site Honorable Mayor and Members of City Council Agenda Item Comments and Other Items of Interest City Council Meeting June 7, 2005 Page 4 of 37 public sanitary sewer line, 300 linear feet of storm sewer and an off -site detention pond. This item and the following two sign variances SP05 -127 and SP05- 112 are located in the Kimball Square commercial building (formerly the Gun Barrel retail strip center) at the northwest intersection of E. SH114 and Shady Lane. This and the following two agenda items are variances to allow larger letter height and sign area than permitted. Staff met with the three applicants to determine a letter size that worked for everyone. All applicants agreed to a letter size of 27 inches or less, with the area being determined by the letter height and copy length. For this request and the following two agenda items, the table shows the maximum permitted by the ordinance, original request and the amended request. Consider SP05 -131, Variance to Sign Ordinance No. 704 -B for Lot 2R1R, Cornerstone Business Park located at 405 South Nolen Drive. This property is south of East Southlake Boulevard behind Ultimate Electronics. This is a request to allow two monument signs on one lot and a reduction in sign setback. There are two buildings, one with full frontage on S. Nolen and the other with partial frontage which is completely consumed by a common driveway. The ordinance allows each building one sign per street frontage. The building with partial frontage is permitted one monument sign, but since it cannot be constructed in the driveway, the applicant is requesting that it be placed on the adjacent lot directly adjacent to its street frontage and common driveway. The plan proposes one sign at the north driveway and one at the south driveway 220 feet apart. The specific variances requested are as follows: Sign Reg. SPIN Neighborhood 48. PUBLIC HEARING. Dwight Bosworth is requesting approval of a zoning change and concept plan. The plan proposes the development of 19 residential lots and one common area lot on approximately 11.44 acres. Originally, the following variances were requested: • Private Street — Private streets are not permitted in new residential subdivisions. The applicant is requesting the proposed street be a private street. • Street Stub — Street stubs shall be provided into adjacent property at a minimum of 1,000 feet apart. The applicant is requesting a waiver from the street stub requirement. During the first reading of this ordinance, the applicant agreed to comply with the two requirements noted above. Neither a revised plan nor written documentation addressing the elimination of the two variances has been received. The City Council approved first reading (4 -0) subject to the recommendations of the Planning and Zoning Commission with the following amendments: • Accepting the applicant's commitment to provide a masonry fence along the south boundary line for the full length of the "I -1" zoned property; • Provide trees along the west boundary line; • Consider a curvilinear street design; • All increased run -off due to development must be contained; • Noting that the two west lots are to be buildable lots. The following variance is being requested: • Street Connection — Any proposed streets shall provide for appropriate continuation or completion of any existing streets (whether constructed or dedicated) which project to the limits of a proposed subdivision or are adjacent to the subdivision. The applicant is requesting a waiver from the street connection requirement connecting Enclave Court with existing street stub of Robin Lane. The plan proposes a 6,800 square foot religious facility on approximately 7 acres. The Planning and Zoning Commission recommended approval (6 -0) subject to revised site Plan review summary 43 dated May 19; and • requiring the applicant to tie into the sewer system; • accepting the applicant's willingness to work with the city to develop an alternative drainage plan that will allow the preservation of existing tree cover on the eastern border of the property; • and, accepting the applicant's willingness to install a four foot sidewalk along FM 1709 as recommended in the Southlake 2025 Plan, allowing deferment of the installation until the Phase II Site Plan has been approved. The applicant originally proposed to handle drainage by constructing an open drainage channel on the eastern portion of the site. The construction of the channel would have resulted in the loss of some trees. Since the P &Z meeting, the applicant has submitted a letter to the planning staff committing to eliminating the channel and designating the tree area on the east as a no disturbance area. The proposed changes to the general fund budget reflect an increase of $1,330,000 in revenues and $18,714 in personnel and $384,510 in capital request. Please refer to the memo from Sharen Elam included in your packet for detailed explanations of all changes. Attachment A of the ordinance illustrates how the amendments fit within the budget. Innovative Developers, Inc. is requesting approval of a zoning change from AG agricultural district to 0-1 office district and an associated concept plan. The plan proposes the development of a medical office building of approximately 4,500 square feet on 0.809 acres. Duration 15 days 60 days Contact Ken Baker or Dennis Killough with questions on this item. 11A. Proposal and release of the Request for Proposal (RFP) for the Southlake Wireless Networking concept. Several months ago you were briefed on current issues regarding wireless networking concepts for the community and on pending legislation in the State of Texas. The Texas Legislature has met and failed to make any substantial changes in the abilities of cities to offer wireless networking, thus preserving the status quo for now. Staff has been reviewing all the available technologies and has formulated a pilot plan for the city. The planned wireless networking RFP addresses City Council initiatives, public safety needs, parks, and public works requirements into a pilot project. The concept of the initial project is Honorable Mayor and Members of City Council Agenda Item Comments and Other Items of Interest City Council Meeting June 7, 2005 Page 13 of 37 to provide wireless coverage at five initial locations within the City. Town Square will have outdoor coverage in parks and open areas for public use. The library will benefit from this proposal as library patrons will be able to obtain a wireless internet connection from within the library. Access points will also be located at the public works operations center, DPS east facility, Bicentennial Park and Bob Jones Park. The DPS east and public works operations center locations will allow for public safety vehicles to upload digital video from a proposed in- car video system to a centrally located server as well as the potential to provide internet access to citizens in parks in the immediate area. The Bicentennial Park location will provide for a wireless camera that will potentially provide views of the park as well as the Bicentennial Park water tower. Additionally it is anticipated that the parks maintenance facility will be able to use this service and the city will be able to discontinue a DSL circuit there at a savings of about $1,400 a year. Parks also needs connectivity at Bob Jones Park for a camera and other future applications. The public will be able to obtain internet access at both parks. Staff will be prepared to present this item if you wish. Contact Gary Gregg with questions on this item. 1113. Proposed Rural Conservation Land Use designation. During the development of the Southlake 2025 Plan, the Planning and Zoning Commission developed the Rural Conservation Subdivision category. The conventional approach to residential development in the rural portion of Southlake typically results in the entire parcel being covered with house -lots and subdivision streets. This type of residential development ultimately results into a network of subdivisions with little or no open space or environmental resource protection. The basic principle of this land use category is to allow the cluster development of homes onto a portion of the development parcel, so that the remainder can be preserved perpetually as open space. While the current zoning ordinance provides detailed standards for lot area, setbacks, density and floor area, the ordinance does not set any noteworthy standards for quality and configuration of the open space to be preserved. The new land use category will establish a framework for the development of a new zoning ordinance category that will ensure that quality open space is preserved. The Planning and Zoning Commission has been developing the Rural Conservation Subdivision ordinance during the past month. OTHER ITEMS OF INTEREST • On Mondav niuht_ Mav 29. 2005_ aolice were called to the 2800 block of Tvler Street in Kirkwood Hollow on a loud music disturbance There was a major party in progress at a residence in Kirkwood Hollow. Residents also complained about parking and other violations. The initial responding officer had been briefed earlier regarding a mass gathering notice which had been properly submitted by the homeowner and mistakenly believed it to be a noise exemption permit. Later in the evening, the on duty Police Supervisor responded to an additional noise complaint and gave the homeowner the choice of turning off the music or being issued a citation. The homeowner chose the citation and a citation was issued for violation of the noise ordinance. Officers are limited in authority in dealing with class C misdemeanors and have difficulty in forcibly stopping noise disturbances on private property without clear legal guidelines being provided. DPS Administration is not satisfied with the response to the complaints and we are working to develop improved response plans to incidents of this nature. Both City Attorney and Council input will be solicited in this process.
