PROJECT: Specific Use Permit to allow a tent sale at 325 Commerce Street
REQUEST: On behalf of Ram Interest, L.P., International Development Corp. is requesting
approval of a specific use permit to allow a tent for the purpose of promoting retail
sales. The applicant is requesting a tent for their semi - annual 3 -day tent sale. The
tent is proposed to be approximately 4,000 square feet and is to be set up on Monday,
April 25 in order to begin loading products and setting up for the event. The sale
will begin at 8:00 a.m. on Thursday morning, April 28, and last through 5:00 p.m. on
Saturday, April 30. The remaining merchandise after the sale will be emptied from
the tent Saturday evening and the tent will be taken down on Monday, May 2. The
hours of operation for the three days of the sale will be from 8:00 a.m. to 5:00 p.m.
each day. The tent is proposed to be located in the front truck loading area and will
not reduce the number of parking spaces on site or the effectiveness of landscaped
areas within the site. A tent permit application is required to be filled out and
approved by the Building Services Department showing that the tent will meet
current building and fire codes.
Duration of tent: April 25 through May 2

Hours of Operation: 8:00 a.m. to 5:00 p.m. Th/Fr /Sat

Comprehensive Zoning Ordinance No. 480 on September 19, 1989.
P &Z ACTION: March 17, 2005; Approved (6 -0) as presented, signage as shown, permit to be
issued by the Building Services Department.
STAFF COMMENTS: Due to the limited scope of this request, no new review letter was generated.
The applicant is requesting to have a tent for the purpose of promoting retail
sales for the period of April 25 through May 2. The actual sale will be for
three days from April 28 through April 30. A narrative with photos of the
event and a site exhibit showing the location of the tent has been provided as
Attachment "C ".

International Development Corporation (IDC) is a twelve (12) years old, Texas
Corporation located in Southlake, Texas. As a Westinghouse Licensee of Solar Lighting
Products, Low Voltage Products and Bird Feeders, we provide our customers a wide
variety of lighting products (including solar and low voltage), gardening tools, yard art,
patio furnishings, fire pits, home decor and much more.
Our customers include Costco Wholesale, Sam's Wholesale, Wal -Mart, K -Mart,
Menard's, Shopko, Home Shopping network, Shop at Home, GrandinRoad and
Frontgate Catalogs. Our products are well known and reliable and we are considered
by Home Improvement Executive Magazine, to be the top ranked manufacturer for
innovative design.
Over the past several years, IDC has become a fixture in the City of Southlake, by
hosting a semi- annual tent sale lasting three (3) days in the Spring and three (3) days
in the Fall. The products from prior seasons or discontinued packaging are sold to the
public at or below cost. This is the only time we offer our products to the public and
our mailing list totals over 1700 residents of Tarrant County and the surrounding areas.
Our tent sale has been improved over the years to incorporate the image that
Southlake wishes to project. The tent sale is well run, clearly defined and uniquely
organized to the City of Southlake's Specific Use Permit regulations, including:
Staff to cover traffic problems (if needed)
f A fixed time period for the sale (3 days only, Thurs/Fr/Sat, 8 -5)
Appropriate Signage and Lighting
Ample Parking with Signage
Sanitary Facilities
f Law Enforcement/Security for evening hours (not open to public)

IDC provides more signage outside of the tent to direct traffic to our overflow parking lot (corporate
IDC would like to set the tent up on April 11, 2085 to begin Loading product. We will have
security during the evening hours and the tent is completely secured during those hours. The
tent sale would open at 8;00 AM on Thursday morning following a full page advertisement on
the Ft. Worth Star Telegram on Wednesday. A full page ad will break in the Grapevine Sun on
Thursday followed by another full page advertisement in the Ft. Worth Star Telegram on
Friday. Other advertising avenues will be researched and there may be additional ads based
on quotes provided (nearer the intended date) by local publications.
IDC provides carts that are clearly marked for our customer's use as well as purchase to car
service (someone to take the packages purchased to the customer's vehicle). Loading of
large, bulky or heavy items are coordinated at our warehouse side entrance. Customers are
encouraged to ask questions and IDC provides five to seven customer service attendants
stationed throughout the tent at all open times.
Our tent is maintained is an orderly and clean fashion with extra signage pointing out
entrances, exits, hours of operation, no smoking, payment terms and occupancy information
(l=ire Marshall). The tent is closed at 5:00 PM on Saturday (after the sale) and all items are
removed from the tent placed in our warehouse by 7:08 PM that evening. The tent will
remain up over the weekend but will be completely empty. On Monday, April 18, 2005, the
tent company will come pick the tent up and there will be no sign that there was a tent sale

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SOUTHLAKE, TEXAS, GRANTING A SPECIFIC USE PERMIT FOR A
TENT FOR THE PURPOSE OF PROMOTING RETAIL SALES ON
PROPERTY WITHIN THE CITY OF SOUTHLAKE, TEXAS,
LOCATED AT 325 COMMERCE STREET, BEING LEGALLY
DESCRIBED AS LOT 3, BLOCK A, COMMERCE BUSINESS PARK,
MORE FULLY AND COMPLETELY DESCRIBED IN EXHIBIT "A ",
AND AS DEPICTED ON THE APPROVED CONCEPT PLAN
ATTACHED HERETO AND INCORPORATED HEREIN AS EXHIBIT
"B" AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, a Specific Use Permit for a tent for the purpose of promoting retail sales has been
requested by a person or corporation having a proprietary interest in the property zoned as "I -l" Light
Industrial District; and,
WHEREAS, in accordance with the requirements of Section 45.1 (42) of the City's Comprehensive
Zoning Ordinance, the Planning and Zoning Commission and the City Council have given the requisite
notices by publication and otherwise, and have afforded the persons interested and situated in the affected
area and in the vicinity thereof, and,
WHEREAS, the City Council does hereby find and determine that the granting of such Specific Use
Permit is in the best interest of the public health, safety, morals and general welfare of the City.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SOUTHLAKE, TEXAS:
SECTION 1.
A Specific Use Permit is hereby granted for a tent for the purpose of promoting retail sales on the
property located at 325 Commerce Street, being legally described as Lot 3, Block A, Commerce Business
Park, an addition to the City of Southlake, Tarrant County, Texas, according to the plat recorded in Volume
388-214, Page 60, Plat Records, Tarrant County, Texas, more fully and completely described in Exhibit "A ",

and as depicted on the approved Concept Plan attached hereto and incorporated herein as Exhibit `B" and
providing an effective date, subject to the provisions contained in the comprehensive zoning ordinance and
