The development is located on the northeast corner of the intersection of Carroll Avenue and E. Southlake Boulevard. The existing Variance to the Sign Ordinance No. 704 -B requirements for sign height and area of a development sign is expired and the applicant is requesting to replace the sign with a new development sign of similar height and size. The proposed development sign is to be a single -sided sign with a sign face of approximately 152 square feet. The proposed development sign will have a total height of 167.5 inches, or just less than 14 feet. Development signs are allowed for a period of one (1) year or upon issuance of a certificate of occupancy for commercial developments. The specific variances requested are as follows: Sign Reg. Max. Page 1 BACKGROUND INFORMATION OWNER/APPLICANT: Cooper & Stebbins PROPERTY SITUATION: Southlake Town Square is located on the northeast corner of the intersection of Carroll Avenue and E. Southlake Boulevard. The property is approximately 130 acres and has frontage on E. Southlake Boulevard, N. Carroll Avenue, and the east -bound frontage road of State Highway 114. REQUEST: Cooper & Stebbins is requesting a variance from the sign height and area standards for temporary development signs of Sign Ordinance No. 704 -B. STAFF COMMENTS: The sign details, site plan, and applications are attached to this report. The following variances to the Sign Ordinance No. 704 -B are requested: • Ord. 704 -13, Section 21.D.2(a) MAXIMUM HEIGHT Five (5) feet above grade. The applicant is requesting a total sign height of 13 feet and 11.5 inches (total of 167.5 inches). • Ord. 704 -B, Section 21.D.2(b) MAXIMUM AREA Sixty -four (64) square feet with a maximum of thirty-two (32) square feet per sign face. The applicant is requesting a total sign area of approximately 152 square feet (10' -1 1 '2 "x 15'- 1 V2'). The City Council may authorize variances in accordance with the following provision of the Sign Ordinance No. 704 -B, Section 14, Variances: The City Council may authorize variances to any restriction set forth in this ordinance, including but not limited to the number, type, area, height, or setback of signs, or any other aspect involved in the sign permitting process. In granting any variance, the City Council shall determine that a literal enforcement of the sign regulations will create an unnecessary hardship or a practical difficulty on the applicant, that the situation causing the unnecessary hardship or practical difficulty is unique to the affected property and is not self - imposed, that the variance will not injure and will be wholly compatible with the use and permitted development of adjacent properties, and that the granting of the variance will be in harmony with the spirit and purpose of this sign ordinance. A person may request a variance from the Sign Ordinance by filing the request with the Building Official. Any request for variance shall be accompanied by a completed application and a non- refundable filing fee in the amount specified in the current fee schedule adopted by City Council. Southlake Town Square is a mixed -use downtown that covers a broad area. Informational signage is important to keep the community aware of the continuing expansion. That the situation causing the unnecessary hardship or practical difficulty is unique to the affected property and is not self imposed. Southlake Town Square is a planned 130 acre mixed -use central business district. Informational signage is important in telling our community about the expansion of Town Square. That the variance will not injure and will be wholly compatible with the use and permitted development of adjacent properties. The signage proposed is consistent with informational signage that is found in the Southlake area and is a revised design of what is already in place. It will be informing the community of coming expansion to the Town Square. That the variance will be in harmony with the spirit and purpose of the sign ordinance.
