Item 10D MemoCity of Southlake, Texas MEMORANDUM March 1, 2005 To: Shana Yelverton, Acting City Manager From: Pedram Farahnak, P.E., Public Works Director Subject: Authorize the Mayor to Execute a Commercial Developer's Agreement for Southlake Town Square Phase IV, Grand Avenue District, a 41.35 Acre Tract Action Requested: Authorize the Mayor to execute a Commercial Developer's Agreement for Southlake Town Square Phase IV, Grand Avenue District, a 41.35 acre tract. Background Information: The Plat Revision for Southlake Town Square Phase IV was approved by Council on October 5, 2004. The development of this phase includes the construction of 6,322 LF of public streets, 7,360 LF of public storm sewer lines, 4,410 LF of public water lines and 6,840 LF of public sanitary sewer lines. The park dedication requirements applicable to Phase IV, Grand Avenue District are 0.6359 acres, based upon the development of 31.798 acres of additional land (district is 41.35 acres total, which includes 9.552 acres of existing development). The Developer of Town Square has a credit of 1.8466 acres from prior development. The developer agrees to apply 0.6359 acres of this credit to satisfy Developer's requirements for dedication for this Addition leaving a remaining credit balance of 1.2107 acres. Also, the Developer is planning to contribute a combined 3.543 acres of park land to the City in Phase IV, Grand Ave. District consisting of the 0.283 acre Plaza Park and the 3.26 acre West Park. On February 17, 2005, Park Board accepted the 3.543 acres of park land dedication. The Developer wishes to carry the remaining 1.2107 acres and the 3.543 acres of park development within Grand Avenue, for a total of 4.7537 acres, forward to future Town Square developments as a credit. The Developer may request that Council grant them credit towards the wastewater impact fee for monies the Developer spent on the installation of sanitary sewer steel casing across Hwy 114 east of Carroll Avenue. This casing serves the Developer's improved area only. Financial Considerations: Financial considerations on this phase were approved in the TIF Development Agreement and 380 Agreement approved by the City Council on November 16, 2004. Citizen Input/ Board Review: None Legal Review: This is the City's standard Commercial Developer's Agreement, originally drafted by the City Attorney. Alternatives: The Council may approve it, deny it or modify it.
