City of Southlake Department of Planning STAFF REPORT February 23, 2005 CASE NO: SP 05 -017 PROJECT: Sign Variance for Hibernia Bank REQUEST: The bank is located at the northwest corner of the intersection of N. Carroll Avenue and E. Southlake Boulevard. A variance to the Sign Ordinance No. 704 -B regarding the minimum distance between monument signs on a single site is being requested. The Sign Ordinance allows one monument sign along each street frontage per site. Where a single site may be permitted more than one monument sign, the signs must be a minimum of 500 feet apart. Carroll Avenue and E. Southlake Boulevard. The property address is 1110 E. Southlake Boulevard. REQUEST: Hibernia Bank is requesting avariance from the standards of Sign Ordinance No. 704 -B for distance between monument signs. STAFF COMMENTS: The sign criteria, building elevations, site plan and applications are attached to this report. The following variances to the Sign Ordinance No. 704 -B are requested: • Ord. 704 -13, Section 16.13.5 NUMBER OF SIGNS Only one monument sign, excluding menuboard signs, shall be allowed along each street frontage on any site, unless otherwise specifically provided in this ordinance. Monument signs may be no closer than five hundred (500) feet on any one site. The applicant is proposing 2 monument signs with a distance of 340 feet between signs. The City Council may authorize variances in accordance with the following provision of the Sign Ordinance No. 704 -13, Section 14, Variances: The City Council may authorize variances to any restriction set forth in this ordinance, including but not limited to the number, type, area, height, or setback of signs, or any other aspect involved in the sign permitting process. In granting any variance, the City Council shall determine that a literal enforcement of the sign regulations will create an unnecessary hardship or a practical difficulty on the applicant, that the situation causing the unnecessary hardship or practical difficulty is unique to the affected property and is not self - imposed, that the variance will not injure and will be wholly compatible with the use and permitted development of adjacent properties, and that the granting of the variance will be in harmony with the spirit and purpose of this sign ordinance. A person may request a variance from the Sign Ordinance by filing the request with the Building Official. Any request for variance shall be accompanied by a completed application and a non- refundable filing fee in the amount specified in the current fee schedule adopted by City Council. There are two street frontages to this property. It would be most desireable to have a monument sign near both of these entrances. Although there is in excess of 500 feet of street frontage on this property, we are unable to achieve 500 feet of sign seperation if measured in a straight line. The literal enforcement of the sign regulaton would prohibit two signs even though they would be located at the two extreme (diagonal) corners of the property. 2. That the situation causing the unnecessary hardshlp or practical dt4ftculty Is unique to the affected propriety and is not self imposed. The intersection of.Southlake Blvd. And Carroll is dramatically lower than the actual property corner. The slope of the property dictated this situation. There are large electrical transformer boxes at the bottorn of the slope. It will also be very difficult to place a sign on this slope. 3. That the variance will not Injure and will be wholly compatible with the use and permitted development of adjacent properties. This variance it glrnnted should very computable with the surrounding properties. The signz will be tastefully done, following the guidelines set forth by the City of Southlake with the exception of seperation. 4 That the werlance will be in harmony with the spirit and purpose of the sign ordinance. We believe this approach will good for all and well within the spirit of the City of Sout€alakes sign ordinance. We are eliminating patentiat clutter at the corner of Southlake Blvd. and Carrell and moving the stf;na to where they will be most useful. Case No. SP 05 -017 Attachment E Page 1
