Item 7A MemoCity of Southlake, Texas MEMORANDUM February 23, 2005 TO: Shana Yelverton, Acting City Manager FROM: Rick Black, Director of Public Safety (Ext. 242 1) SUBJECT: Ordinance No. 778 -A, 2nd Reading, An amendment to Noise Ordinance No. 778, modifying the definition of daytime and nighttime hours. Action Requested: City Council approval of amendments as recommended by staff and Councilmember Terrell. Background Information: Councilmember Terrell began discussion with staff in August of 2004 about enforcement concerns of noise ordinance (778). Meetings held at the DPS East Facility included Director Black and members of Building Services. Current definitions of the noise ordinance allow various interpretations of daylight hours and dark hours. The amendment removes the words daylight and dark from section five (5) and seven (7) of the definition section of the ordinance. The deletion of daylight and dark hours provides an exact period to enforce when violations are considered. Legal Review: None Alternatives: The Council may approve the request, deny the request, or approve it subject to conditions.
