PROJECT: Sign Variance for Albertson's
REQUEST: Variance to the Sign Ordinance No. 704 -B requirements for number of signs and
letter /logo height. The tenant is located in the Southlake Marketplace shopping
center at the southeast corner of the intersection of Davis Boulevard and W.
Southlake Boulevard. This is a variance for the number of signs and the letter height
of attached signs. The specific variances requested are as follows:

BACKGROUND INFORMATION
OWNER: Albertson's
APPLICANT: Willow Creek Signs, Inc.
PROPERTY SITUATION: Albertson's is located in the Southlake Marketplace shopping center at the
southeast corner of the intersection of Davis Boulevard and W. Southlake
Boulevard. The property address is 2201 W. Southlake Boulevard.
REQUEST: Albertson's is requesting a variance from the number of signs to allow
signage for a tenant with a store front facing the interior of the store only and
letter /logo height standards of Sign Ordinance No. 704 -B.
STAFF COMMENTS: The sign criteria, building elevations, site plan and applications are attached
to this report. The following variances to the Sign Ordinance No. 704 -B are
requested:
• Ord. 704 -13, Section 16.A.4 NUMBER OF SIGNS Only one attached
sign per lease space shall be allowed along each street frontage on any
site, unless otherwise specifically provided in this ordinance.
The applicant is requesting a sign be allowed on the store front
identifying a tenant with a store front facing the interior of the store only.
• Ord. 704 -13, Section 16.A.2 MINIMUM LETTER/L.OGO HEIGHT The
minimum height allowed for letters or logos shall be six (6) inches.
The applicant is requesting a minimum letter height of approximately S 1 /z
inches for the lettering in the second attached sign.
The City Council may authorize variances in accordance with the following
provision of the Sign Ordinance No. 704 -13, Section 14, Variances:
The City Council may authorize variances to any restriction set forth in this
ordinance, including but not limited to the number, type, area, height, or
setback of signs, or any other aspect involved in the sign permitting process.
In granting any variance, the City Council shall determine that a literal
enforcement of the sign regulations will create an unnecessary hardship or a
practical difficulty on the applicant, that the situation causing the
unnecessary hardship or practical difficulty is unique to the affected property
and is not self - imposed, that the variance will not injure and will be wholly
compatible with the use and permitted development of adjacent properties,
and that the granting of the variance will be in harmony with the spirit and
purpose of this sign ordinance. A person may request a variance from the
Sign Ordinance by filing the request with the Building Official. Any request

for variance shall be accompanied by a completed application and a non-
refundable filing fee in the amount specified in the current fee schedule
adopted by City Council.

Demonstration
Please demonstrate that the following conditions are applicable to the requested sign variance:
1. That a literal enforcement of the sign regulation will crate an unnecessary
hardship or practical difficulty can the applicant

on the Sav -On pharmacy if it is unable to identity itself to the public_ The "Sav -4n
Pharmacy" logo is a reglstered,trademark and cannoI be changed,
2. That the situation causing the unnecessary hardship or practical difficulty is
unique to the affected property and is not self imposod. ..
The situation is unique to the property in that the Sav -On pharmacy is located
inside of the Albertson's grocery stare and should have the right to identify and
promote its business to the general public.
3, That the variance will not injure acid will be wholly compatible with the use and
permitted development of adjacent properties_
The sign variance requested is compatible with the use and. permitted development
of all adjacent properties, This sign variance requested is.only to insure that the
"Sav -an Pharmacy" located Within the Alt rtson's grocery stare has the ability to
identify itself to the public and make aware that it is in business.
4 • That the variance will be in hammy with the spirit and purpose of the sign
ordinance..
This sign variance is in harmony with the spirit and purpose of the sign vrdinanace in
that the ordinance was not written to create undue hardships on its business community
but rather to keep a structured and uniformed system for promoting each business
entity to the public. All businesses must have the right to promote their identity to the
general public. This sign variance allows "5av -On Pharmacy" its right to promote its
name and identity.
