Southlake Boulevard. The property address is 2301 W. Southlake Boulevard, Suite 200. REQUEST: Crystal Clear Wireless, LLC is requesting a variance from the letter /logo height standards of Sign Ordinance No. 704 -B. STAFF COMMENTS: The sign criteria, building elevations, site plan and applications are attached to this report. The following variances to the Sign Ordinance No. 704 -B are requested: • Ord. 704 -13, Section 16.A.2 MAXIMUM LETTER /LOGO HEIGHT The maximum permitted letter height is 12 inches for a sign less than 100 feet from the right -of -way. The store front is approximately 80 feet from the street right -of -way. The maximum letter and logo size permitted is 12 inches. The applicant is requesting a letter height of approximately 16 inches. • Ord. 704 -13, Section 16.A.2 MINIMUM LETTER/L,OGO HEIGHT The minimum height allowed for letters or logos shall be six (6) inches. The applicant is requesting a minimum letter height of approximately S inches for the lettering in the attached sign. The City Council may authorize variances in accordance with the following provision of the Sign Ordinance No. 704 -13, Section 14, Variances: The City Council may authorize variances to any restriction set forth in this ordinance, including but not limited to the number, type, area, height, or setback of signs, or any other aspect involved in the sign permitting process. In granting any variance, the City Council shall determine that a literal enforcement of the sign regulations will create an unnecessary hardship or a practical difficulty on the applicant, that the situation causing the unnecessary hardship or practical difficulty is unique to the affected property and is not self - imposed, that the variance will not injure and will be wholly compatible with the use and permitted development of adjacent properties, and that the granting of the variance will be in harmony with the spirit and purpose of this sign ordinance. A person may request a variance from the Sign Ordinance by filing the request with the Building Official. Any request for variance shall be accompanied by a completed application and a non- Case No. SPO4 -252 Attachment A Page 1 refundable filing fee in the amount specified in the current fee schedule adopted by City Council. That a literal enforcement of the sign regulation will create an unnecessary hardship or practical difficulty on the applicant. - Without the variance permitted, we will have to have a new sign built, creating an undesired and unnecessary expense. - Without any sign, during the process of obtaining a new sign and permit, our sales are greatly affected as our products and services are not visible. -The signs of both of our neighboring businesses are larger than the standard 12" signsllettering measuring closer to 18" & 24 "; if required to comply with the standard 12" sign, our sign will appear even smaller between two much bigger signs. -The additional, smaller sign is vital to communicate our status as an Authorized Verizon Wireless Agent/ Retailer as this is our exclusive productlservice. 2. That the situation causing the unnecessary hardship or practical difficulty is unique to the affected property and is not self imposed. -The signs of both of our neighboring businesses are larger than the standard 12" signs/lettering measuring closer to 18" & 24"; if required to comply with the standard 12" sign, our sign will appear even smaller between two much bigger signs. 3. That the variance will not injure and will be wholly compatible with the use and permitted development of adjacent properties. -There is no apparent reason to believe injury will occur because of our requested variance. All items related to the request are wholly compatible with the use and development of adjacent properties. 4. That the variance will be in harmony with the spirit and purpose of the sign ordinance. Crystal Clear Wireless, LLC requests a sign variance at the location 2301 W Southlake Blvd. Ste. 200, Southlake, Tx 76092, to allow a sign with 16" vertical letters on a raceway & 12' horizontal. The store front is 37' across. The request is 4 additional inches in height.
