Item 10ACity of Southlake, Texas MEMORANDUM November 27, 2006 TO: Shana Yelverton, City Manager FROM: Steve Polasek, Director of Community Services SUBJECT: Community Services Agreement with the Fort Worth Transportation Authority Action Requested: City Council discussion regarding Southlake Senior Advisory Commission recommendation to not renew an interlocal agreement with the Fort Worth Transportation Authority for participation in the Tarrant County Transportation Services (TCTS) program. Background Information: In January of 2004, the City entered into an agreement with the Fort Worth Transportation Authority to provide transportation services to senior citizens and disabled persons in Tarrant County. The program was intended to serve as a compliment to the existing transportation services provided by CARS as previously recommended in the Transportation Task Force Report. Named Tarrant County Transportations Services (TCTS), the service provides rides to individuals meeting the qualifications of the program at a cost of $2.50 each way for participating cities. This fee increases to $10.00 each way for residents in non - participating communities. Service is provided from 6:00 a.m. to 6:00 p.m. on weekdays and provides transportation to any destination within Tarrant County. One day a week is set aside for each participating city with Friday being assigned to Southlake. Service is also available on a first -come, first - served basis throughout the remainder of the week. While the program has been well utilized in other communities ridership within Southlake has been limited with an average of approximately one - hundred one -way trips annually ($19.16 per rider in 2006). In an effort to improve use of the program additional promotions were undertaken this year to include featured information in the Senior Scene, on the City's cable channel and web -site, and flyers. In general, feedback received from seniors who used the program indicate that the level of service was not adequate based on their given needs. Financial Considerations: The annual cost based on the estimated number of qualifying riders in Southlake is $1,686. Funding is available in the approved FY 2006 -07 Community Services division budget should Council wish to renew the agreement. The proposed funding request represents no change in cost from the previous year. Financial Impact: The financial impact to the City is the anticipated annual payment of $1,686 to the Fort Worth Transportation Authority. Shana Yelverton, City Manager November 27, 2006 Page 2 Citizen Input/ Board Review: The Senior Advisory Commission reviewed the proposed agreement at their November 14, 2006 meeting and voted unanimously (7 -0) to recommend to City Council not to renew the interlocal agreement for 2007 with Fort Worth Transportation Authority and cited low ridership as the primary reason for their recommendation. The Fort Worth Transportation Authority has reviewed the proposed agreement and no changes were recommended. Legal Review: The proposed interlocal agreement contains no substantive changes and has been reviewed by the City Attorney. Alternatives: Alternatives may include • Direction to not renew the proposed interlocal agreement. • Place on future agenda for consideration of approval of the proposed interlocal agreement. • Place on future agenda for consideration of approval of the proposed interlocal agreement with input as desired. They shall sometimes be referred to collectively as the "Parties." WHEREAS, the City of Southlake desires to provide door -to -door paratransit services for elderly and persons with disabilities within Tarrant County, but neither has a transportation service nor is a member of a transportation authority; and WHEREAS, the Fort Worth Transportation Authority is a federal grantee of the Federal Transit Administration, which provides funding to States under Section 5310 of Title 49 of the United States Code; and WHEREAS, the goal of the Section 5310 program is to provide transportation for elderly and disabled persons residing in cities that do not have public transportation available to them; and WHEREAS, the Texas Department of Transportation (TxDOT) asked the T to develop and implement a Section 5310 program for otherwise under served communities in Tarrant county; and WHEREAS, the T implemented such a program entitled Tarrant County Transportation Service (TCTS) which provides transportation for medical appointments, shopping, recreation, school or work to qualified individuals; and WHEREAS, the City of Southlake is contributing $1,686.00 towards the administrative costs of the Section 5310 service(TCTS); and WHEREAS, the monies will support a portion of administrative costs for the transportation services to qualified individuals during thel2 -month period, January 1, 2007 — December 31, 2007; The parties pursuant to City of Southlake action and Fort Worth Transportation Authority action agrees as follows: 1. The City of Southlake will be allocated one day, each week as their primary designated day for transportation and on that day all available vehicles will be provided for service to qualified Southlake residents. On the remaining days, rides are available subject to the priority requests from other cities on a first -come basis. 2. Each party represents to the other that the delegated costs of the project under the Agreement, as well as any payments made by it pursuant to this Agreement, will be made from current revenues and /or specified grant funds. Further, each Party warrants and represents to the other party that each Shana Yelverton, City Manager November 27, 2006 Page 5 Party has been authorized by it respective governing body to do so. Each party further represents and warrants to the other Party that any renewal of, deletion, or change to this Agreement will be in writing and authorized by its respective governing body. 3. The Fort Worth Transportation Authority will administer transportation services to the citizens of the City of Southlake under the program known as Tarrant County Transportation Services from January 1, 2007 through December 31, 2007. 4. The Fort Worth Transportation Authority will administer demand responsive transportation services for the seniors and persons with disabilities of Southlake according to the federal requirements of the Section 5310 grant and according to the relevant State of Texas statutes. 5. The City of Southlake will pay the authorized amount to the Fort Worth Transportation Authority within 30 days of receipt of invoice. 6. Fort Worth Transportation Authority will provide access upon request to the Section 5310 records to the City of Southlake. 7. Parties will comply with all applicable State of Texas and federal statutes and regulations as required by their status as a federal grantee and transit authority of the State of Texas, and federal grantee and municipality of the State of Texas, respectively. 8. The term of this agreement will begin January 1, 2007 and end December 31, 2007. This agreement may be renewed for up to three successive one -year periods beginning on January 1 and ending on December 31 of each year upon written agreement by both parties. 9. The City of Southlake will be considered a participating community and the qualifying residents of Southlake will be entitled to ride TCTS for a one way trip fare of $2.50. 10. In performing the services hereunder, Fort Worth Transportation Authority is acting as an independent contractor, and shall not be deemed an employee, agent or partner of the City. Neither party shall have the authority to make binding representations or agreements on behalf of the other. 11. Notwithstanding any provision of this Agreement to the contrary, nothing contained in this agreement shall be construed to limit or waive any governmental or sovereign immunity of the City, or any immunity applicable to its officers, agents, servants or employees.
