Item 9BCity of Southlake Department of Planning STAFF REPORT November 1, 2006 CASE NO: SP 06 -463 P ROJECT: Sign Variance for Dr. Hebert Office Building REQUEST: This is a variance request from the Sign Ordinance No. 704 -B requirements for maximum letter /logo height and sign placement for attached signs. The subject property is located at 170 Players Circle in the Players Circle Addition. The applicant is proposing two attached signs for Southlake Chiropractic that will exceed the 12 inch maximum letter /logo height allowed under the ordinance. The sign on the west elevation will have 12 inch letters and a 34 inch logo and the sign on the north elevation will have 18 inch letters. In addition, the proposed sign on the north elevation (facing Southlake Boulevard) is not allowed because it will be on another tenant's lease space. Therefore, the applicant is proposing to allow two tenant's signs on the north elevation: one for Southlake Chiropractic and one for a future tenant. Further, the sign on the north elevation will be 21 feet in length, which exceeds the maximum sign width of 18.75 feet for this facade. The two proposed signs for Southlake Chiropractic will be similar to the Clearview Eyecare and Laser Center sign on S.H. 114, which is shown in Attachment E. Approval of a variance is needed to receive a sign permit for the proposed signs. The building is located in the Players Circle Addition development. STAFF COMMENTS: The sign criteria, site plan and application are attached to this report. The following variances are requested: • Ord. 704 -13, Section 16.A.2 MAXIMUM LETTER/LOGO HEIGHT The maximum permitted letter /logo height is 12 inches for attached signs located less than 100 feet from the right of way or driveway access. The applicant is permitted a maximum letter height of 12 inches on the north and west elevations. The applicant is requesting a maximum letter height of 18 inches on the north elevation facing Southlake Boulevard and a maximum logo height of 34 inches on the west elevation facing the internal driveway. • Ord. 704 -13, Section 16.A.5 SIGN WIDTH Attached signs are limited in width to the middle 75% of the width of the lease space or the single plane facade. The single plane fa(ade on the north elevation is 25 feet wide, which limits the sign width to 18.75 feet. The applicant is requesting a sign width of 21 feet on the north elevation. The sign ordinance allows for attached signage for each lease space, but only where the lease space fronts an access drive. The internal layout configuration of the lease spaces offers no fronting of Southlake Blvd. This prevents the owner and the tenant the opportunity to adequately advertise and identify their place of business. The results are economic hardship for myself and limited appeal to my Potential tenant. Limited exposure to traffic on Southlake Blvd. 2. That the situation causing the unnecessary hardship or practical difficulty is unique to the affected property and is not self imposed. The shape of the Lot dictated the shape of the building. The building had to position facing west because of the addition of the retail space to the west, the developer wanted our buildings facing each other. That the variance will not injure and will be wholly compatible with the use and permitted development of adjacent properties. Granting this variance for the conditional sign permit will have no adverse effect on adjacent properties. And it decreases the risk of an accident if the driver on Southlake Blvd were to glance up to find us. 4 That the variance will be in harmony with the spirit and purpose of the sign ordinance. The sign will comply with existing sign ordinance, and meet development requirements as well with regard to style, size, and illumination. All signs will be exclusive of the owner of the building, and the potential tenant holding a Certificate of Occupancy and conducting bonafide business operations within the building.
