SUBJECT: Authorize the purchase of Longhorn and Calf Statues from Cowpainters,
LLC
Action Requested: City Council authorization of the purchase of Longhorn and Calf statues
from Cowpainters, LLC.
Background
Information: Under certain circumstances a single bidder is identified as producing a
product or providing a service that is unique to them alone (ie. sole
source). The Texas Local Government Code Section 252.022 allows for
the purchase of items that are only available from a single source (Pg 10,
City of Southlake Purchasing Policy). In researching the sculpture art
work for the Southlake Stampede program Chair Mary Georgia and the
Committee (including staff) reviewed an abundance of information in
their process to select Cowpainters, LLC as the statue vendor for the
Southlake Stampede.
Various vendors were initially identified by interviewing other similar
public art project managers and searching the web. Project managers
recommended Cowpainters, LLC or Fiberstock. Criteria used to select a
vendor included most importantly whether the vendor can produce the
artwork for the longhorn image desired. Other criteria included can the
vendor meet the project timeline, price per Longhorn and Calf, as well
as consideration of recommendations from other similar public art
project managers about the performance of the vendors. All project
managers interviewed gave Cowpainters the highest rating for
responsiveness and quality. As such, Cowpainters, LLC was identified
as the only vendor capable of producing the quality and quantity of
longhorn and calf statues required for this public art project, in a safe,
timely and professional manner.
As you recall, since the target minimum has been obtained the
longhorns pay for themselves via the sponsorship fees. The order for
the first fourteen (14) sponsored longhorns, totaling $23,835, has been
processed, and production is underway. Additional sponsorship
commitments are forthcoming and the second order will need to be
placed towards the end of July or in early August. As a result, City
Council authorization is required to purchase any additional longhorns
and calves from Cowpainters, LLC as the total purchase will exceed
$25,000. If the project reaches its maximum sponsorship level, with all
50 Longhorns and all 50 Calves sponsored, the approximate total
expenditure with Cowpainters, LLC would be $129,365 (Purchase
$114,365 + Shipping $15,000).
Financial
Considerations: To date, over $50,000 in sponsorship monies have been received.

Impact: No financial impact to the City as project costs offset by sponsorship
funding.
