REQUEST: H.E.B. Central Market is requesting approval of a specific use permit for the sale of
alcoholic beverages at their new store located at 1425 E. Southlake Boulevard.
According to the applicant, this business has a 20 year lease at this location.

LEGAL DESCRIPTION: Future Lot 3, Block 1, The Shops at Southlake Addition
LAND USE CATEGORY: Town Center
CURRENT ZONING: "S -P -2" Generalized Site Plan District
HISTORY: -A rezoning and concept plan for "S -P -2" zoning was approved in May of
1996.
-A revised concept plan was proposed in 1999 and deemed to be inconsistent
with the "S -P -2" zoning by the Southlake Zoning Board of Adjustments.
-City Council approved a change of zoning and concept plan to "S -P -2"
Generalized Site Plan District on May 17, 2005.
-A preliminary plat was also approved by City Council on May 17, 2005.
-A revised site plan was approved by City Council on October 4, 2005.
P &Z ACTION: June 8, 2006; Approved (5 -0) subject to the terms of the lease.
STAFF COMMENTS: Due to the limited scope of this request and that no changes are proposed to the
approved site plan, no plan review summary is provided. A site plan exhibit
showing the specific location of this request is included as Attachment `C' of
this report.

RESOLUTION NO. 06 -035
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SOUTHLAKE, TEXAS, GRANTING A SPECIFIC USE PERMIT FOR
THE SALE OF ALCOHOLIC BEVERAGES ON PROPERTY WITHIN
THE CITY OF SOUTHLAKE, TEXAS, LOCATED AT 1425 E.
SOUTHLAKE BOULEVARD, BEING LEGALLY DESCRIBED AS A
PORTION OF TRACT 7A, SITUATED IN THE J. FREEMAN SURVEY,
ABSTRACT NO. 529, MORE FULLY AND COMPLETELY
DESCRIBED IN EXHIBIT "A ", AND AS DEPICTED ON THE
APPROVED SITE PLAN ATTACHED HERETO AND
INCORPORATED HEREIN AS EXHIBIT `B" AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, a Specific Use Permit for the sale of alcoholic beverages has been requested by a person
or corporation having a proprietary interest in the property zoned as "S -P -2" Generalized Site Plan District;
and,
WHEREAS, in accordance with the requirements of Sections 45.1 (1) and 45.6 of the City's
Comprehensive Zoning Ordinance, the Planning and Zoning Commission and the City Council have given the
requisite notices by publication and otherwise, and have afforded the persons interested and situated in the
affected area and in the vicinity thereof, and,
WHEREAS, the City Council does hereby find and determine that the granting of such Specific Use
Permit is in the best interest of the public health, safety, morals and general welfare of the City.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SOUTHLAKE, TEXAS:
SECTION 1.
A Specific Use Permit is hereby granted for the sale of alcoholic beverages on the property located at
1425 E. Southlake Boulevard, being legally described as a portion of Tract 7A, situated in the J. Freeman
Survey, Abstract No. 529, more fully and completely described in Exhibit "A ", and as depicted on the
approved site plan attached hereto and incorporated herein as Exhibit `B" and providing an effective date,

subject to the provisions contained in the comprehensive zoning ordinance and the restrictions set forth herein.
The following specific requirements and special conditions, if any, shall be applicable to the granting of this
Specific Use Permit:
1.
SECTION 2.
This resolution shall become effective on the date of approval by the City Council.
