REQUEST: Bosworth Farms II, L.P. is requesting approval of a plat revision proposing to
subdivide one (1) existing lot of approximately 1.556 acres into a total of four
(4) lots. A variance to street the frontage requirement is requested allowing
Lots 2R -2 and 2R3 to front on a common access easement and driveway
meeting the City's construction standards for a street.

Honorable Mayor and Council Members:
We have submitted a plat revision request for Brewer Industrial Addition, We are requesting one
(1) variance related to this plat revision:
1. Based on the lot configuration and the request to develop four (4) individual lots with
building to be purchased separately, two (2) of the lots do not have frontage on a dedicated
righf -of -way. In order to develop the four (4) separate lots, we are requesting that Lots 2R2 and
2R3 be allowed to be platted without direct connection to a dedicated right- of -way. Both lots
will have access to a dedicated right -of -way through platted mutual access easements
We believe that the request is an improvement to the development that is beneficial to the City
as well as the future building owners.. We appreciate your consideration of each of these
requests.. If you have any additional questions or comments, we will be available at the City
Council meeting to discuss them.

CITY STAFF HAS REVIEWED THE ABOVE REFERENCED PROJECT RECEIVED BY THE CITY ON 03/31/08 AND WE
OFFER THE FOLLOWING STIPULATIONS. THESE STIPULATIONS ARE HEREBY MADE CONDITIONS OF PLAT

Provide adequate easements as needed for the distribution of franchise and public utilities to each lot
and for compliance with approved construction plans. Easements have been added for the water line
through the middle of the lots. A 15' utility easement was added along the east for sewer and
franchise utilities. A 15' utility easement exists along the frontage.
2. Lots 2R2 and 2R3 do not front on a street and are proposed to be on a private common access
easement. A variance request letter was submitted with justifications to propose the lots as
drawn. If the variance is approved, change "mutual access easement" to "common access,
drainage, and utility easement ", provide a reciprocal parking and access agreement which
addresses construction and maintenance of common access easement driveways and fire lanes,
cross access, joint use of parking and parking spaces to be shared between the lots within the
subdivision. Additionally, the drive must be constructed to structural street standards and drainage
structures, utilities and easements be provided to the lots. Prior to filing a plat, a copy of the county
filed agreement must be received by the City. The applicant may also wish to consider
including provisions for landscaping, common areas, trash enclosure use and maintenance.
The applicant will provide a draft copy of the agreement for review by the City Attorney
before the plat revision goes to the Planning and Zoning Commission.
Abandonment of the 15' SS easement is subject to Public Works and City Council approval. An
easement detail exhibit has been provided on the plat for the 15' Sanitary Sewer easement.
4. Correct the square footage in the fourth call of the property description from 97,782 to 67,782.

The following should be informational comments only
* We recommend that the plat revision not be moved forward until the site plan and zoning are ready for
this property.
* We recommend contacting the SPIN Representative for this district to receive their opinion on whether

* It appears this property lies within the 65 'LDN D/FW Regional Airport Overlay Zone, requiring
construction standards in compliance with the Airport Compatible Land Use Zoning Ordinance No.
479. Additionally, the Avigation Easement and Release shown in Appendix 3 of the Subdivision
Ordinance No. 483 should be executed on subsequent Plats to be filed in the County Plat Records.
* A "Certificate of Taxes Paid" indicating that there are no delinquent taxes owed on the subject property
from each taxing authority must be provided to the City prior to filing this plat in the County records. A
copy of this information may be obtained from the Tarrant county Tax Assessor /Collector's Office
located at 100 E. Weatherford St. in Ft. Worth (across from the old red courthouse). There is a service
charge of $10 per account for this certificate. For more information contact the Assessor /Collector's

* We recommend this plat not be filed until the construction plans have been substantially approved.
* Please submit a revised blueline "check print" prior to submitting blackline mylars with original
signatures.
* Original signatures and seals will be required three blackline mylars prior to filing the plat. Also
required are two sets of owner's dedications and notaries (8.5" x 11" or 14" paper) with original
signatures and seals on each. Mylars will not be accepted if any erasures or original ink, other than
signatures or seals, appear on the plat.
* A Developers Agreement is required prior to construction of any public infrastructure. The Developer's
Agreement for this addition should consider streets, drainage, park dedication requirements and fees,
off -site sewer extensions, off -site drainage and utility easements and impact fees.
* The Development Review Committee (DRC) has determined this pre - submittal is sufficient for formal
submittal to the Planning and Zoning Commission for the May 8, meeting. The applicant should be
aware that a formal submittal for the next scheduled Planning and Zoning Commission meeting must
be received at the City by 5:00 p. m. on 04121108. A total of 27 revised copies of each plan
folded to 6" X 9" and a single 11" X 17" reduction of each plan must be submitted. If not received
before the deadline, the item will be moved to a later P &Z agenda. If any significant changes, other
than those noted above are made to the submittal, the plat could be held up.
