The property is located at 250 Players Circle. The applicant is proposing one attached sign on the north side of the building, which does not directly face a drive or street but will have visibility from Southlake Boulevard. REQUEST: The applicant is requesting one attached sign on the north side of the building, which is visible from F.M. 1709 but does not have frontage on F.M. 1709. The requested sign will have a letter /logo height and sign width greater than allowed under Sign Ordinance No. 704 -B. Approval of a variance is required in order to receive a building permit for this sign. STAFF COMMENTS: The sign criteria, site plan and application are attached to this report. The following variances are requested: • Ord. 704 -13, Section 16.A.2 MAXIMUM LETTER/LOGO HEIGHT The maximum permitted letter /logo height is 12 inches for signs less than 100 feet from the R.O.W. The northern elevation does not directly face a street or driveway. The proposed sign is approximately 26 feet from the northern property line. The maximum letter /logo size permitted is 12 inches. However, due to the height of the building, a sign on the northern elevation would have visibility from Southlake Boulevard. The proposed sign would be over 500 feet from Southlake Boulevard. The applicant is requesting a letter height of 24 inches and a logo height of 36 inches. • Ord. 704 -13, Section 16.A.5 SIGN WIDTH Attached signs are limited in width to 75% of the width of the single plane facade. The width of the single plane facdade is 42 feet 7 inches. The maximum permitted sign width is 31 feet 11 inches. The applicant is requesting a sign width of 32 feet 5 inches. • Ord. 704 -13, Section 16.A.4 NUMBER OF SIGNS Only one attached sign per lease space shall be allowed along each street frontage or vehicular driveway access. A secondary sign may be permitted at a public entrance, provided the entrance is on another side of the building. The applicant is proposing a sign on the northern elevation which does not have frontage on a street or vehicular driveway access. The northern elevation also does not have a public entrance. However, due to the height of the building, the sign would be visible from Southlake Boulevard. The City Council may authorize variances in accordance with the following provision of the Sign Ordinance No. 704 -13, Section 14, Variances: Case No. Attachment A SP 06 -031 Page 1 The City Council may authorize variances to any restriction set forth in this ordinance, including but not limited to the number, type, area, height, or setback of signs, or any other aspect involved in the sign permitting process. In granting any variance, the City Council shall determine that a literal enforcement of the sign regulations will create an unnecessary hardship or a practical difficulty on the applicant, that the situation causing the unnecessary hardship or practical difficulty is unique to the affected property and is not self - imposed, that the variance will not injure and will be wholly compatible with the use and permitted development of adjacent properties, and that the granting of the variance will be in harmony with the spirit and purpose of this sign ordinance. A person may request a variance from the Sign Ordinance by filing the request with the Building Official. Any request for variance shall be accompanied by a completed application and a non- refundable filing fee in the amount specified in the current fee schedule adopted by City Council.
