ATTACHMENTS: (A) (B) (C) (D) (E) (F) Background Information Vicinity Map Site Plan Sign Detail Previous Sign Sign Variance Application STAFF CONTACT: Dennis Killough (748 -8072) Ken Baker (748 -8067) Case No. SP 05 -384 BACKGROUND INFORMATION OWNER/APPLICANT: Ad Art Inc. on behalf of Shoe Pavilion PROPERTY SITUATION: The property is located at 2727 East Southlake Boulevard in Cornerstone Plaza. This is the former location of Ultimate Electronics. REQUEST: The applicant is proposing an attached sign facing East Southlake Boulevard that will have a letter height larger than permitted by Sign Ordinance No. 704 -B. Approval of a variance is required to receive a building permit for this sign. STAFF COMMENTS: The sign criteria, site plan and application are attached to this report. The following variances are requested: • Ord. 704 -B, Section 16.A.2 MAXIMUM LETTER/LOGO HEIGHT The maximum permitted letter /logo height is 24 inches for signs between 151 and 200 feet from the R.O.W. The proposed sign is approximately 185 feet from the street right -of -way. The maximum letter /logo size permitted is 24 inches. The applicant is requesting a maximum letter height of 63 inches for the `h' in the word `shoe'. The remaining letters are a maximum 42 inches in height. The City Council may authorize variances in accordance with the following provision of the Sign Ordinance No. 704 -B, Section 14, Variances: The City Council may authorize variances to any restriction set forth in this ordinance, including but not limited to the number, type, area, height, or setback of signs, or any other aspect involved in the sign permitting process. In granting any variance, the City Council shall determine that a literal enforcement of the sign regulations will create an unnecessary hardship or a practical difficulty on the applicant, that the situation causing the unnecessary hardship or practical difficulty is unique to the affected property and is not self - imposed, that the variance will not injure and will be wholly compatible with the use and permitted development of adjacent properties, and that the granting of the variance will be in harmony with the spirit and purpose of this sign ordinance. A person may request a variance from the Sign Ordinance by filing the request with the Building Official. Any request for variance shall be accompanied by a completed application and a non- refundable filing fee in the amount specified in the current fee schedule adopted by City Council.
