The applicant is requesting variances for three signs to be located in the Aventerra development. The specific variances requested are as follows: Sian Reg. Dove Street and 100 East S.H. 114, located at the northeast corner of S.H. 114 and N. White Chapel Blvd. REQUEST: Two new development signs are proposed at the property located at 500 West S.H. 114. A third new development sign is proposed at the property located at 100 East S.H. 114. The applicant is requesting a variance to the requirements for sign height and area for the three temporary real estate signs. The proposed signs are approximately 17 feet tall and 140 square feet in area. The applicant is also requesting to allow a total of two signs at 500 West S.H. 114 and a total of two signs at 100 East S.H. 114. Note: There are two existing real estate signs on the Aventerra property located at the northeast corner of S.H. 114 and N. White Chapel Blvd. One sign falls within the sign regulations for real estate signs and is located at 100 East S.H. 114. The other sign, located at 250 East S.H. 114, exceeds the area and height requirements and was granted a variance on December 16, 2001. The sign was allowed a total height of 17 feet and an area of 192 square feet. The actual sign is 16 feet tall and has a sign face area of 132 square feet. STAFF COMMENTS: The sign criteria, site plan and application are attached to this report. The following variances are requested: • Ord. 704 -13, Section 22.C.2.b. MAXIMUM HEIGHT The maximum permitted height is five (5) feet for ground signs. The applicant is requesting a maximum height of 16.25 feet (195 inches). • Ord. 704 -13, Section 22.C.2.c. MAXIMUM AREA The maximum permitted area is sixty -four (64) square feet with a maximum of thirty- two (32) square feet per sign face. The applicant is requesting one -sided signs with a maximum area of 143 square feet per sign face. The signs are 10.2 feet tall by 14 feet wide. • Ord. 704-B, Section 22.C.2.d. MAXIMUM NUMBER OF SIGNS Only 1 real estate sign is allowed per site. The applicant is requesting two real estate signs at 500 West S.H. 114. There was previously an over -sized sign at this site that was approved by City Council on December 16, 2001. This sign has been removed. Case No. Attachment A SP 05 -329 Page 2 The applicant is requesting one additional real estate sign at 100 East S.H. 114. The existing sign at this site is within the height and area regulations for real estate signs. The City Council may authorize variances in accordance with the following provision of the Sign Ordinance No. 704 -13, Section 14, Variances: The City Council may authorize variances to any restriction set forth in this ordinance, including but not limited to the number, type, area, height, or setback of signs, or any other aspect involved in the sign permitting process. In granting any variance, the City Council shall determine that a literal enforcement of the sign regulations will create an unnecessary hardship or a practical difficulty on the applicant, that the situation causing the unnecessary hardship or practical difficulty is unique to the affected property and is not self - imposed, that the variance will not injure and will be wholly compatible with the use and permitted development of adjacent properties, and that the granting of the variance will be in harmony with the spirit and purpose of this sign ordinance. A person may request a variance from the Sign Ordinance by filing the request with the Building Official. Any request for variance shall be accompanied by a completed application and a non- refundable filing fee in the amount specified in the current fee schedule adopted by City Council. Case No. SP 05 -329 Attachment E Page 1 Cartwright Signs, Ltd. 1/31/06 Re: REQUEST FOR VARIANCE For: Aventerra Signage for Newland Communities Dear Council Members, Please accept this letter as request for variance on three (3) signs in the City of Southlake, in the community known as Aventerra. Newland Communities currently has three (3) signs in this community that were manufactured for Aventerra by our company. We would like to ask you to please review the following attachments and consider allowing these signs to remain as is. The attachment should provide sufficient information on the style of signs, as well as layout and placement within the community. We would also like to note that Newland Communities has two (2) existing signs that were not manufactured by Cartwright Signs. A city employee, Mr. Dennis Killough, advised our office to also note these signs for your reference. I will note the location of these particular signs on the following maps as "existing ". The three (3) new signs that we are requesting variance for will be noted on the maps as "new ". Your time and consideration in reviewing our variance proposal is greatly appreciated. As we feel it is critical to the development of this property, it is our desire to keep all five (5) of the signs noted on the attached map as is. Please do not hesitate to contact me if you have any questions regarding our request, or the information attached. Our original letter dated 11/28/05 and map submitted at that same time showed a total of 3 old signs, and 3 new signs. We have revised this letter due to a change in the total quantity of signs. There are now only two (2) old signs, and three (3) new signs. Please note that the sign shown on our original submitted map located on Parcel 104 a, The Grove at Aventerra (Off Hwy 114 & Dove Rd) has since been removed from the property.
