The applicant is also requesting to display three of the banners over public streets and one banner on the pavilion in Rustin Park. The proposed display dates are March 10 through April 10, 2006. The Southlake Town Square development is located at the northeast corner of N. Carroll Avenue and E. Southlake Boulevard (EM. 1709). The specific variances requested are as follows: Sign Reg. Carroll Avenue and E. Southlake Boulevard (F.M. 1709). REQUEST: The applicant is proposing to display banners of approximately 72 square feet in various locations of Southlake Town Square for a period of 31 days. Two banners will be displayed over Main Street and one will be displayed over Grand Avenue. The proposed banners exceed the maximum area and duration for banner signs permitted by Sign Ordinance No. 704 -B. In addition, the sign ordinance only allows signs to be displayed over public right -of -way with the City's permission. Variance approval is required to receive building permits for these signs. A fourth banner is shown on the exhibits and will be displayed on the pavilion in Rustin Park. This banner will require approval from the Community Services Department as they regulate all signage in the park. STAFF COMMENTS: The sign criteria, site plan and application are attached to this report. The following variances are requested: • Ord. 704 -13, Section 21.A.2.a. MAXIMUM AREA The maximum permitted area for a banner is 0.5 square feet for every one foot of width of building or lease space not to exceed fifty (50) square feet. The applicant is requesting a maximum sign area of approximately 72 square feet for each banner. • Ord. 704 -13, Section 21.A.2.c. DURATION Banners are permitted to be displayed for a maximum of 15 days, twice per calendar year with a sixty (60) day separation between permits. The applicant is requesting to display the banners for 32 days, from March 10 to April 10. • Ord. 704 -B. Section 17.H. SIGNS PROJECTING ON /OVER PUBLIC PROPERTY OR PUBLIC RIGHT -OF -WAY It shall be prohibited to erect or display any type of sign on or over public right -of -way or other public property, unless the same be erected by the City, County, State or other authorized governmental agency, or with the permission of the City, for public purposes. The applicant is requesting to display three banners over public streets: two over Main Street and one over Grand Avenue. (The banners will have grommets and will be attached to brackets that are built into the buildings.) A fourth sign will be displayed on the pavilion atRustin Park. Case No. Attachment A SP 06 -055 Page 2 This banner will require approval from the Community Services Department as they regulate all signage in the park. The City Council may authorize variances in accordance with the following provision of the Sign Ordinance No. 704 -13, Section 14, Variances: The City Council may authorize variances to any restriction set forth in this ordinance, including but not limited to the number, type, area, height, or setback of signs, or any other aspect involved in the sign permitting process. In granting any variance, the City Council shall determine that a literal enforcement of the sign regulations will create an unnecessary hardship or a practical difficulty on the applicant, that the situation causing the unnecessary hardship or practical difficulty is unique to the affected property and is not self - imposed, that the variance will not injure and will be wholly compatible with the use and permitted development of adjacent properties, and that the granting of the variance will be in harmony with the spirit and purpose of this sign ordinance. A person may request a variance from the Sign Ordinance by filing the request with the Building Official. Any request for variance shall be accompanied by a completed application and a non- refundable filing fee in the amount specified in the current fee schedule adopted by City Council. Artwork will also reflect the quality expected by the community- Case No. SP 06-055 Attachment E Page 1 Dennis, As to the sign applications, I am requesting the following: Billboard: The approval currently in place for the signage at the intersection of Carroll and 1709 expires March 31, 2006. The applicant requests permission to extend the term for 1 year as well as permission to change the sign face several times throughout the year to accommodate different projects over the next 12 months (Grand Avenue Grand Opening, Phases II and III of the Brownstones, Harkins movie theater and Hilton Hotel). The first change is attached and will be changed March 10 , 2006. All sign changes will remain consistent with previous versions. Banners: The applicant requests permission to hang four banners beginning March 10, 2006 — April 10, 2006 for the purpose of creating an awareness of the grand opening event for Grand Avenue. Other information you requested: • Banners will have grommets and be attached to the brackets that are built in to the buildings. • Billboard signage going up in March 2006 is planned to be a plastic wrap material, designed to be a smooth fit to the form of the sign.
