Plat Extension – Preliminary Plat for Mustang Business Park
PROJECT:
REQUEST: Wright Development Company is requesting approval of a variance to the Subdivision
Ordinance No. 483, Section 4.01(I) (Plat Expiration), as amended, extending the
validity of Case No. ZA 03-070, Preliminary Plat for Mustang Business Park.
A Preliminary Plat shall expire two years from the date of approval. Said expiration
date shall be extended one year from the latest date of filing a Final Plat on any
portion of said Preliminary Plat in the County Plat Records. The Preliminary Plat was
approved by City Council on November 4, 2003. A Final Plat has not been filed and
therefore the Preliminary Plat has expired.
A Final Plat was also approved and has since expired. The applicant is also separately
requesting to extend the validity of the Final Plat.

BACKGROUND INFORMATION
OWNER / APPLICANT: Joe L. Wright (Wright Development Company)
PURPOSE: Extend the validity of an expired Preliminary Plat so that the lots and
easements may be dedicated and filed in the County through a Final Plat.
PROPERTY SITUATION: The property is located on the north east corner of Brumlow Avenue and
State Hwy. 26.
LEGAL DESCRIPTION: Tract 1, Brumlow Industrial District, Phase 1 and Tracts 1B3, 1B3A, 1B1B,
1B1B1, & 4B1, out of the H. Decker Survey, Abstract No. 438
LAND USE CATEGORY: Industrial
CURRENT ZONING: “I-1” Light Industrial District and “I-2” Heavy Industrial District
HISTORY: -A final plat for Brumlow Industrial District, Phase 1 was approved by the
City on May 1, 1979.
-A change of zoning from ‘I-1’ to ‘I-2’ was approved for Tract 1, Brumlow
Industrial District, Phase 1 on December 5, 1989.
-A change of zoning from ‘AG’ to ‘I-1’ was approved for the proposed
Mustang Business Park on April 16, 2002.
-A preliminary plat was approved by City Council on November 4, 2003. The
validity of the preliminary plat has since expired.
STAFF COMMENTS: A final plat was not filed within two years of its approval date and has
expired. Because the plat has expired, a variance to the plat expiration is being
requested.
