Plat Extension for Johnson Place Estates
PROJECT:
REQUEST: Jones & Boyd, Inc. is requesting approval of a variance to the Subdivision Ordinance
No. 483, Section 4.01(I) (Plat Expiration), as amended, and is requesting that the
validity of Case No. ZA 06-121, Final Plat for Johnson Place Estates, be extended for
an additional one year from the date of the City Council’s action on this item.
Section 4.01(I) states that a Final Plat which has not been recorded in the County Plat
Records within one year of the date of approval shall expire. The Final Plat was
approved by the Planning & Zoning Commission on September 7, 2006. Final plats for
subdivisions requiring the installation of streets and utilities are typically not recorded
until these improvements have been installed and are ready to be accepted by the City.
This insures that street right-of-ways and easements are correctly shown based on as-
built conditions and also insures that all the new lots of record are properly served by
streets and utilities. The final plat for this development has not been recorded due to
construction delays and will not be ready to file prior to the expiration.

BACKGROUND INFORMATION
OWNER: MDC-Johnson Place Estates, LTD
APPLICANT: Jones & Boyd, Inc.
PROPERTY SITUATION: The property is located on the west side of the 400 block of Randol Mill
Avenue and the north side of the 2400 block of Johnson Road.
LEGAL DESCRIPTION: Tracts 6B, 6D, 8, 8A, and 8A2B, J.J. Freshour Survey, Abstract No. 521; and,
Lot 1, Block 1, Johnson Place Addition
LAND USE CATEGORY: Low Density Residential
CURRENT ZONING: “R-PUD” Residential Planned Unit Development District
HISTORY: - A preliminary plat was approved by City Council for the Father Joe Addition
on August 6, 1991.
-A final plat was approved by City Council for Lot 1 of Father Joe Addition on
August 6, 1991 as well.
-City Council approved a final plat for Lots 2 & 3, Father Joe Addition on
October 1, 1991.
-A change of zoning from “CS” to “SF-1A” was approved by City Council on
Lot 1, Father Joe Addition on January 6, 2004.
-A plat revision was approved by City Council on December 16, 2003 for the
Johnson Place Addition.
-City Council approved a change of zoning to “R-PUD” and a development
plan for Johnson Place Estates on May 2, 2006.
-A preliminary Plat was approved by City Council on August 1, 2006.
DRAINAGE ANALYSIS: The Johnson Place development drains in 4 directions. The eastern portion of
the site drains to two (2) proposed detention ponds – one at the northeast
corner of the site adjacent to Randol Mill Avenue, and one at the southeast
corner of the development along Randol Mill Avenue. The outfall of the two
ponds will be along the roadway of Randol Mill Avenue. The western portion
of the site drains also drains to three (3) proposed detention ponds – one at the
southwest corner of the site near the park which will outfall directly into the
creek, and one on either side of the entrance to the subdivision along Johnson
Road, both of which will outfall to the existing culverts at Johnson Road.
STAFF COMMENTS: A final plat will not be filed within one year of its approval date and will expire.
Because the plat will expire, a variance to the plat expiration is being
requested.
