Authorize an amended contract with RPGA Design Group, Inc. for the design of
SUBJECT:
the new DPS Headquarters in the amount of $1,765,000.

Action Requested:
Obtain Council approval for an amended architectural contract for the DPS
Central Facility.
Background
Information:
The Crime Control and Prevention District Board approved an architectural
contract with RPGA Design Group earlier this year for the design and
construction of a DPS Central Facility. Since that initial approval of the
contract, the scope of the project has changed, necessitating a contract
amendment. The original estimated construction cost was $12 million for the
project and the architectural fees were 8% of the estimated construction costs.
When the original architectural contract was signed, the building project was
defined as being approximately 50,000 sq.ft. in size. Once the design process
began, it was determined that an architectural presence was desired on both
corners of the building site. This required that the building be expanded both
horizontally and vertically to accomplish this architectural presence. The
sloping site and the length of the building added to complexity of the project
and additional components further added to the complexity of the project. The
original program did not include a jail facility since it was anticipated that we
would design the facility so that the jail facility could be added to the building
at a later date. However, due to the building site, the jail facility was added
into the first level of the building, thus adding to the complexity of the building
design and operational functionality. The use of a parking structure instead of
a parking lot due to the cost of land also added to the complexity of the project.
At the end of the preliminary design, the building was approximately 87,000
square feet.
Due to the project growing in size and scope, the architectural contract is being
amended to reflect an estimated construction cost of $23.5 million. The
amended contract defines the architectural fees as 8% for the original $12
million in construction and fees of 7% for the additional $11.5 million in
estimated construction costs. The original architectural contractual fees totaled
$960,000 and the amended contract adds another $805,000 for a total of
$1,765,000.

Considerations:
The funding for this contract can be provided from the Crime Control &
Prevention District tax revenue.

Board Review:
The current facility scope and size has been presented at a city-wide SPIN
meeting.
The Crime Control and Prevention District Board has reviewed and approved
the contract amendment.
Legal Review:
The City Attorney has reviewed and approved the attached amended contract.
Alternatives:
Alternatives that exist are;
(1)Deny these amendments and reduce the scope of the project, or
(2)Modify and re-negotiate the recommended amendments.
