Approve a lease agreement extension for an additional sixty days for

Action Requested:
Council consideration regarding extension of the lease agreement
for property located at 315 and 379 Shady Oaks Lane with Mr. and
Mrs. Ralph Evans for a period of an additional sixty (60) days, to
expire on June 30, 2007.
Background
Information:
The City presently owns approximately 6.849 acres of park land
commonly described as 315 and 379 Shady Oaks Lane and leases
it to Ralph and Linda Evans (and daughter Lonna Rodgers) as part
of the original purchase agreement. The current lease expires on
January 31, 2007, but does allow per Section 3(e) for a ninety (90)
day extension per written request of the Tenant assuming they are
in the process of relocating. The Evans have requested this
extension per construction of their new home and intent to relocate
upon its completion. Given the proposed timeframe for
completion of their new residence the Evans are seeking an
additional sixty (60) days extension per the attached letter.
Following a review of proposed City development and use of the
property it is proposed that the lease extension be considered as no
conflicts for City use are evident and continued occupation of the
residence and 6.849 acre site provide caretaker benefits. The
Evans would continue to be responsible for mowing and
maintaining the premises in a good safe condition. No other
changes to the existing agreement are proposed.
Financial
Considerations:
There are no financial considerations as a part of the proposed
lease extension.
Financial Impact:
Reduction in maintenance costs estimated at approximately $375
for a period of sixty days.

Board Review:
Parks board reviewed and recommended (6-0) at their March 26,
2007 meeting.
Previous lease agreement approved by City Council at their
October 19, 2004 meeting. Commencement date of January 31,
2005.
Legal Review:
Other than the extension of sixty (60) days with a termination date
of June 30, 2007, there are no other changes from the previous
lease agreement.
Proposed addendum “A” has been reviewed by the city attorney.

ADDENDUM A
LEASE BETWEEN CITY OF SOUTHLAKE AND
W. RALPH EVANS, LINDA S. EVANS, AND LONNA RODGERS
Term:
(1) Addendum A to the lease agreement between the City of Southlake and W. Ralph
Evans, Linda Evans, and Lonna Rodgers for property located at 315 and 379 Shady Oaks Lane
shall extend the lease for a period of an additional sixty (60) days to expire on June 30, 2007.
Amendments.
(2) This Contract may not be amended or supplemented unless such
amendment or supplementation is approved in writing and signed by the City Manager or
designee.
IN WITNESS WHEREOF, the parties hereby have executed this Addendum in triplicate
originals to be effective on the Effective Date.
