Action Requested: City Council consider Resolution No. 07 -015, authorizing a one -time payment of accrued sick leave to 911 Dispatch employees transferred to the City of Keller as of April 1, 2007. Background Information: The City of Southlake has entered into an agreement with the city of Keller to provide regional dispatch services to citizens of Southlake and Keller. The regional dispatch center will be operated by Keller and therefore, all Southlake 911 Dispatch operators will transfer employment to Keller as of April 1, 2007. Following a series of meetings between Southlake and Keller staff, including a representative committee of affected employees, Keller has provided an employment package of benefits to the affected Southlake employees. As part of the benefits offered to transferring Southlake employees, each will receive an immediate 40 hours of sick leave balance, and then accrue sick leave at 8 hours per month thereafter. Some Southlake employees have substantial sick leave balances that ordinarily would be forfeited upon separation from employment. Under current Southlake Personnel Policies and Procedures, Chapter b `Benefits," Section 3 "Sick Leave" employees are not eligible for payment of accrued sick leave at time of separation unless the employee: 1. (a) retires from City employment under the City sponsored program and is immediately eligible to receive retirement payments; and (b) has at least ten (10) years of continuous employment with the City of Southlake; or 2. separates from employment for any reason except for involuntary termination, with twenty (20) or more years of continuous full -time service. Any payment of accrued sick leave is limited to four hundred (400) hours. Since the affected 911 Dispatch employees are being separated for business reasons, equivalent to a Reduction in Force (RIF), some hardship may be experienced by employees who will no longer have a substantial sick leave balance in the event of a significant illness or injury, or maternity leave. NOTE: One employee affected will transfer employment two (2) months short of the 20 -year continuous service requirement. This employee's situation has been discussed with City Council before and it was indicated that this Shana Yelverton, City Manager March 13, 2007 Page 2 employee would be paid for accrued sick leave as if she were separating with 20 years service. The additional cost to include the other 911 Dispatch employees is approximately $1,250. This resolution, if approved, will apply to all 911 Dispatch employees being transferred to city of Keller employment. Financial Considerations: The proposed resolution would provide for a payment of accrued sick leave balances on March 30, 2007, less 40 hours (equivalent to the balance credited by Keller) and not to exceed four hundred (400) hours. Estimated cost would be approximately $10,250 based on current sick leave balances. This includes the 400 hour sick leave payment to the one employee with 19.8 years of service previously discussed with City Council. Citizen Input/ Board Review: N /A. Texas RESOLUTION NO. 07-015 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS, AUTHORIZING A ONE -TIME PAYMENT OF ACCRUED SICK LEAVE TO 911 DISPATCH EMPLOYEES TRANSFERRED TO THE CITY OF KELLER AS OF APRIL 1, 2007. WHEREAS, the City of Southlake (the "City ") has entered into an agreement with the city of Keller to provide regional dispatch services to citizens of Southlake and Keller resulting in all Southlake 911 Dispatch operators being transferred to city of Keller employment effective April 1, 2007; and WHEREAS, current City Personnel Policies and Procedures Chapter 6 `Benefits," Section 3 "Sick Leave," provides only for payment of accrued sick leave, up to 400 hours maximum, in the event (a) an employee retires from the City with ten (10) years of service, OR (b) the employee separates employment with twenty (20) or more years continuous service; and WHEREAS, the separation of employment with the City of Southlake is the result of a business related decision equivalent to a Reduction in Force (RIF); NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, THAT: Section 1 : The City authorizes a one -time payment of accrued sick leave to 911 Dispatch employees being transferred to city of Keller employment on April 1, 2007, subject to the following criteria: (a) Payment will be made for Sick Leave hours accrued as of March 30, 2007, less 40 hours (equivalent to the number of hours provided to each Southlake employee upon hire by Keller on Aril 1, 2007); and (b) Payment for accrued sick leave will not exceed four hundred (400) hours. Section 2 . The City Manager is authorized to reimburse the following employees for their accrued sick leave balances as described above. Such compensation will be paid from the City's General Fund balance with issuance of final paycheck.
