SUBJECT:Reject all bids for the Noble Oaks Pond Improvements project

Action Requested:
Recommendation to reject all bids received for the Noble Oaks Pond
Improvement project.
Background
Information:
As previously approved by City Council, and recommended by SPDC and
Parks Board, the proposed design for improvements to Noble Oaks pond
include a water well, pond excavation, spillway and storm drain improvements.
Also recommended as bid alternate items was the installation of a gazebo and
landscape improvements around the pond. The original cost estimates
provided by the project engineer for the base bid items totaled approximately
$100,000. The project was recently bid with two bids being received and
opened on December 19, 2006. Both bids ($251,000 and $271,858,
respectively) far exceeded the available funds for the project. A review of the
bid line items indicate the increase in cost is a result of the proposed well and
well pump which account for an average of 73% of each of the base bids. As a
matter of procedure staff is recommending that all bids for this project be
rejected.
Due to the high cost of installing a well staff is working with the engineer to
restructure the bid documents to separate the well from the pond
improvements, thus allowing these other improvements to move forward and
be accomplished within budget. Staff will also weigh the cost of a domestic
water feed to the pond as an alternative to utilizing well water. The timing for
drilling a water well is not favorable given the recent drought conditions and
tremendous gas exploration within the Barnett Shale.
Financial
Considerations:
Project funding in the amount of $100,000 is available in the fiscal year 2006-
07 SPDC operating budget.
Financial Impact:
Current bids exceed the availability of project funds.

Board Review:
Parks Board unanimously recommended rejection of all bids at their January 8,
2007 meeting (8-0).
Legal Review:
Legal opinion from City attorney advises rejection of bids due to the well and
pump pricing representing the majority of the project.
