Chivers Survey, Abstract No. 299 EXECUTIVE SUMMARY: Toll Brothers Inc. is requesting approval of two (2) plat extensions extending the validity of Case No. ZA08-033, a Final Plat and Case No. ZA08-014, a Preliminary Plat both for Tracts 1, 1C, and 1C1, A.H. Chivers Survey, Abstract No. 299. The property addresses are 2210 N. Carroll Avenue and 1107 & 1155 E. Dove Road. REQUEST DETAILS: A Final Plat was approved on May 8, 2008 by Planning & Zoning Commission and a Preliminary Plat was approved on May 6, 2008 by City Council for Tracts 1, 1C, and 1C1, A.H. Chivers Survey, Abstract No. 299. One extension was approved until May 8, ZA08-033 2010 for the Final Plat () until May 8, 2010. The approved Plats are for the development of 12 residential lots and 2 open space lots on 9.14 acres located at the southwest corner of E. Dove Street and N. Carroll Avenue. Variances The applicant is requesting a variance to Section 4.01(I)3 of the Subdivision Ordinance No. 483, as amended to extend the validity of the plats after they have already expired thth on May 6 and 8, 2010 respectively. The applicant is A Final Plat shall expire one (1) year from the date of approval. requesting to extend the validity of the Final Plat until May 8, 2011. The applicant A Preliminary Platshall expire two (2) years from the date of approval. is requesting to extend the validity of the Preliminary Plat until May 6, 2011. APPLICANT: Toll Brothers Inc. PROPERTY SITUATION: 1107 & 1155 E Dove St. and 2210 N Carroll Ave. LEGAL DESCRIPTION: Tracts 1, 1C, & 1C1, A.H. Chivers Survey, Abstract No. 299 LAND USE CATEGORY: Medium Density Residential and Low Density Residential CURRENT ZONING: “R-PUD” Residential Planned Unit Development Zoning District HISTORY: - The building at the corner of Dove and Carroll (previously a day-care) was built in 1967 (Source: TAD) with Light Commercial zoning approved March 16, 1971 (ZA71-001) and later “C-2” zoning with adoption or the current Zoning Ordinance No. 480 and Map on September 19, 1989. The building was removed with the construction of this development. - The residence at 1107 E Dove Rd was built in 1984 (Source: TAD and removed with the construction of this development. - A Zoning Change & Development Plan was approved by City Council on Planning Case ZA07-063 November 20, 2007 under which established Winfield Estates. - A Preliminary Plat was approved on May 6, 2008 by City Council under Planning Case ZA08-014 . - A Final Plat (ZA08-033) for Winfield Estates was approved by the Planning & Zoning Commission (5-0) on May 8, 2008 and an extension was approved until May 8, 2010. An additional extension has been requested. STAFF COMMENTS: Subdivision Ordinance No. 483, Section 4.01(I) Expiration of Plats: Preliminary Plat: A Preliminary Plat shall expire two (2) years from the date of approval. Said expiration date shall be extended one (1) year from the latest date of filing a Final Plat on a portion of said Preliminary Plat in the County Plat Records. Final Plat, Plat Revision, Amended Plat or a Plat Showing which has not been recorded in the County Plat Records within one year of the date of approval shall expire. Extensions: The City Council may extend the expiration date of an approved plat upon written petition for such extension by the owner prior to the expiration of the plat but not to exceed one (1) year.
