Item 4FCity of Southlake, Texas M E M O R A N D U M February 25, 2008 TO: Shana Yelverton, City Manager FROM: Greg Last, Director of Economic Development Consider an order setting a public hearing for April 15, 2008 to discuss and SUBJECT: review proposed updates to Land Use Assumptions, Capital Improvement Plans and Impact Fees for water, wastewater and roadway improvements. ______________________________________________________________________________ Action Requested: Set the date for a public hearing as described above. Background Information: The Local Government Code, Chapter 395, allows for cities to charge impact fees for water, wastewater, and roadway capital improvements. Southlake has charged water and wastewater impact fees since 1990 and roadway impact fees since 1996. One of the provisions of this chapter calls for periodic updates to the ordinances and related studies adopting the impact fees. City staff have been working with a variety of consultants over a year to prepare and update the required reports and capital improvement plans. A briefing on the status of these items will be presented during your work session on March 4, 2008. Another provision of this Chapter calls for City Council to set the date of the public hearing for the impact fee ordinance 31 days prior to the public hearing. Prior to taking this action, the Council needs to be provided the documents attached and referenced below (included in your packet): Financial Considerations: The Capital Improvements Advisory Committee approved a Status Report on August 24, 2007 which was provided to Council on September 12, 2007. Citizen Input/ Board Review: This process has been led by the Capital Improvements Advisory Committee (Planning and Zoning Commission) and they have been intimately involved in all aspects of the update. The documents attached herein will also be made available to the public after the notice referenced above appears in the paper. Legal Review: The City Attorney’s office (Wayne Olson) has been involved throughout this update process. Alternatives: 1. Establish the Public Hearing for April 15, 2008. 2. Establish the Public Hearing for a different date.
