Item 4D AudioThis request was made by the future owner of Lot 13 and the basis for the request is outlined in an email provided by the applicant. 1 On September 19, 2006, City Council approved the Stratfort Gardens concept plan and zoning change to allow a 14 lot residential subdivision. The subdivision is located south of W. Southlake Boulevard and west of White Chapel Boulevard between the Stratfort Parc subdivision and the Lake Crest subdivision. The boundary of the subdivision is indicated by the purple line on the map. The future owner of lot 13, which is highlighted in yellow has requested the construction of sidewalk planned on her lot be deferred until such time as the Lafeverre property to the south is developed and a connection to the south can be made. The basis for the request to defer the sidewalk is a safety concern and outlined in an e-mail provided by future owner of Lot 13 to the city staff and has been provided in your staff report. The purpose of the sidewalk on lot 13 (which is indicated by a green dashed line) is to provide a connection from the Stratford Gardens residential and commercial sidewalk system shown by the red line to a future sidewalk system on the Lafeveree and Malik properties (indicated by the light blue) which will provide a connection back to White Chapel Blvd to the east and an existing sidewalk system in the Timberlakes open space area to the west. 2 The approved plan indicates that a 5’ internal project trail or sidewalk as shown in red connecting the northern portion of the property to the southern portion of the property of the west side of . 3 This slide shows the approved final plat. Lot 13 is indicated in yellow. The green line indicates the pedestrian system once the subdivision is built out. The red line indicates the CAE on lot 13 where the sidewalk stub to the Lafavere property will built. The CAE was moved to the west with the approval of the plat to provide more direct access to the creek and natural to the west. The applicant is requesting that the construction of that portion of the sidewalk system shown in red be deffered until the Lafevere property is developed.. 4 On this slide Stratford Gardens in outlined by a red line. The Master pathway plan indicates that it is the city’s intent to provide connectivity from FM 1709 trail (through the office/commercial portion of Stratfort Gardens to the north and to White Chapel Boulevard (through the Lafeverre’s property once developed to the east) and an existing sidewalk in the Timberlake subdivision (through the Lafeverre’s & Malik’s properties to the west) 5 This is a photograph looking north of the back portion or western portion of Lot 13. A new home is currently being constructed on the lot. The sidewalk connecting Strafford gardens to the Lafavre property will be located approximately where the new sod has been laid. The building is planning to construct a fence on top of the retaining approximate location of the sidewalk behind the house is where the sod is located. A fence will eventually be constructed on top of the retaining wall shownthat have up to that trend, and 6 7 This is a photo showing where the sidewalk will connect to the Lafavre property to the south. 8 9 On December 7, 2008, Ms. Carey O’Conner, the future owner of the 325 Edinburgh Court, contacted the city via e-mail and formally requested deferral of the construction of the sidewalk until such time as the property to the south was developed. Ms. O’Conner’s e-mail stated based the request on potential safety concerns (See attachment D). On December 8, 2008, the city responded to Ms. O’Conner and indicated that the city staff could not approve deferral of the sidewalk construction administratively since it was a condition of the zoning approval and concept plan and that deferral of the sidewalk construction must be approved by City Council. As such, this item has been placed on the agenda. If City Council approves the request, it is staff’s recommendation that the following be completed to a final certificate of occupancy be issued on the home: 1) Preparation of an agreement that indicates that the sidewalk at 325 Edinburgh (Lot 13, Block 1) Court will be constructed at such time as the property to the south is developed (530 South White Chapel Boulevard) and a sidewalk connection is available. This agreement will be a covenant running with the land, and be binding on any future owners of Lot 13, Block 1. Accordingly, the City will file the Agreement in the deed records of Tarrant County, Texas. 2) Escrow amount paid in full. A draft agreement is attached (See Attachment E). 10 11
