inch water line adjacent to proposed FM 1938.
Background
Information:
FM 1938 is a joint project with the Cities of Southlake and Keller,
the Town of Westlake, Tarrant County, the Texas Department of
Transportation (TxDOT), and the Regional Transportation Council
(NCTCOG – RTC). On August 23, 2007, the Texas Department of
Transportation executed Minute Order #111060 designating FM
1938 onto the state highway system from the intersection of
Southlake Blvd (FM 1709) to the intersection of State Highway 114.
This action allows available State and Federal funds to be used for
construction of the roadway.
The Cities of Southlake and Keller, the Town of Westlake, and
Tarrant County agreed to provide design engineering services and
right of way to TxDOT for the project. On March 5, 2002, the City
of Southlake entered into an Interlocal Agreement with Tarrant
County, the City of Keller, and the Town of Westlake for the joint
acquisition of right-of-way necessary to make the roadway
improvements to FM 1938 from FM 1709 to State Highway 114.
Tarrant County agreed to fund the cost of the right of way and
provide the acquisition services necessary to obtain the right-of-
way.
In addition to acquiring the roadway right of way for the project,
Tarrant County also agreed to acquire additional right-of-way
adjacent to FM 1938 through Southlake for Segment B of the 30-
inch TW King Water Transmission Line Project to be built adjacent
to the FM 1938 project right-of-way. This additional right-of-way is
being fully funded by the City of Southlake. The 30-inch TW King
Water Transmission Line Project will be constructed to connect to
the west to the Ft. Worth Caylor Pump Station via an existing
shared 42 inch water transmission line through the City of Keller to
the intersection of Pearson Lane and Florence Road and to the
east to Southlake’s T. W. King Pump Station No. 2. Segment B is
adjacent to FM 1938 within the City of Southlake. This water line
connection is vital to meeting the City of Southlake’s projected
water demands by 2012.
Resolution 08-063 will ratify the seven right-of-way purchases
made to date and authorize the City staff to review, approve, and
execute negotiated values to purchase the remaining seven right-
of-way parcels necessary for constructing the 30-inch T. W. King
water transmission line adjacent to the FM 1938 Project. The
adoption of this resolution is one additional step to streamline the
property acquisition phase of this project.

Acquisition of the additional right-of-way is funded in the annual
Capital Improvement Program.

RESOLUTION NO. 08-063
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS,
RATIFYING ANY RIGHT-OF-WAY PURCHASES MADE TO DATE FOR THE FM 1938
PROJECT AND AUTHORIZING STAFF TO TAKE ALL APPROPRIATE ACTIONS TO
ACQUIRE REMAINING RIGHT-OF-WAY NECESSARY FOR THE ACCOMPANYING
IMPROVEMENTS INCLUDING A 30 INCH WATERLINE AND SIDEWALK.
WHEREAS,
on March 5, 2002, the City of Southlake entered into an Interlocal Agreement
with Tarrant County, the City of Keller, and the City of Westlake for the joint acquisition of right-
of-way necessary to make certain improvements to FM 1938 from FM 1709 to State Highway 114;
and,
WHEREAS,
on August 23, 2007, the Texas Department of Transportation executed Minute
Order #111060 designating FM 1938 onto the state highway system from the intersection of FM
1709 to the intersection of State Highway 114; and,
WHEREAS,
on October 21, 2008, the City Council of the City of Southlake passed
Resolution No. 08-058 emphasizing the importance of the FM 1938 Project to the improvement of
transportation mobility in this area and the entire DFW area; and,
WHEREAS,
Segment B of the 30 inch TW King Water Transmission Line Project is to be
built adjacent to the FM 1938 Project right-of-way; and,
WHEREAS,
the construction of the 30 inch TW King Water Transmission Line Project
(which will connect to the West to the Ft. Worth Caylor Pump Station via an existing shared 42 inch
water transmission line in the City of Keller, and to the East to the T. W. King Pump Station No. 2
in the City of Southlake) is vital to meeting the City of Southlake’s projected water demands by
2012; and,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
SOUTHLAKE:
SECTION 1: That the City Council ratifies all right-of-way purchases made to date for the
purposes of constructing a 30 inch TW King water transmission line and 8 foot sidewalk adjacent to
the FM 1938 Project.
SECTION 2: That City of Southlake staff is authorized to review, approve, and execute
negotiated values to purchase the remaining right-of-way necessary for constructing a 30 inch TW
King water transmission line and 8 foot sidewalk adjacent to the FM 1938 Project.
