Item 9AITEM 9A Approve a residential developer's agreement for Shady Oaks, Phases 2A and 2B, a 21 lot addition located on the west side of Shady Oaks between West Highland Street and Southlake Boulevard with Terra Shady Oaks, L.P. Project Location Shady Oaks Phases 2A and 2B Shady Oaks Phases 2A and 2B Phase 1 consisting of 36 residential lots completed in 2009 Interim Residential Developer Agreement signed by the City Manager on June 1, 2010 Allows for 2 lots to be released for building permits once fire protection is provided to the 2 lots Phases 2A and 2B consist of a total of 21 residential lots Critical Drainage Structure Fee - $5,387.30 Shady Oaks Phases 2A and 2B Park dedication requirement for this development is 0.525 acres based on one acre per 40 dwelling units or a fee payment of $63,000 based on 21 dwelling units at $3,000 each.  Park dedication credit balance of $749,700 dollars Developer will use $63,000 dollars in park credits Remaining park dedication credit is $686,700 dollars for future use Shady Oaks Phases 2A and 2B Sidewalks – will be constructed within common areas by the developer during the construction of these phases of the subdivision will be constructed at each individual private lot by the builder / home owner at the time the house is constructed The developer will construct an 8ft wide concrete pathway connecting North Peytonville Avenue to Shady Oaks with subsequent phases as they develop and right of way is dedicated RECOMMENDATION Approve a residential developer's agreement for Shady Oaks, Phases 2A and 2B, a 21 lot addition located on the west side of Shady Oaks between West Highland Street and Southlake Boulevard with Terra Shady Oaks, L.P.
