Price, P.E., Director of Public Works Subject: Approve Change Order No. 4 for the Neighborhood Improvement Project of Heatherwood Estates, Royal Oaks Addition, and Twin Creeks Addition for additional sanitary sewer improvements with North Texas Contracting, Inc. in the amount of $778,949.00 Action Requested: Approve Change Order No. 4 for the Neighborhood Improvement Project of Heatherwood Estates, Royal Oaks Addition, and Twin Creeks Addition for additional sanitary sewer improvements with North Texas Contracting, Inc. in the amount of $778,949.00 Background Information: The Capital Improvements Program (CIP) includes funds for the construction of sewer and paving improvements for several neighborhoods within the City. Cheatham and Associates completed the final design and prepared contract documents in October of 2009. The City Council awarded the project on November 3, 2009 to North Texas Contracting, Inc. Approximately 9,800 linear feet of 8" and 10" sewer line will be constructed within the Heatherwood, Royal Oaks, and Twin Creeks neighborhoods as well as along East Dove Road between Lonesome Dove Road and Kimball Avenue. Once completed, the sewer line will serve approximately 70 residential and commercial properties. Also included in the project is the reconstruction of the streets within these neighborhoods and East Dove Road between Lonesome Dove and Kimball Avenue. To comply with the City's master water plan, a 12" water line will also be constructed along East Dove Road from Lonesome Dove and Kimball Avenue to replace the existing substandard 8" water line. The construction along Primrose Lane included the construction of a sewer line, replacing the existing water line, minor drainage improvements, and widening and reconstruction of the road. Sewer was also installed along Pearson Lane from Johnson Road to Gray Lane. The City Manager approved Change Order No. 1 in the amount of $6,740.00 on January 14, 2010. This change order consisted of the relocation of a 12-inch water line along Carroll at Primrose due to conflicts with the storm sewer. On February 22, 2010, the City Manager approved Change Order No. 2 in the amount of $18,641.00. This work included the relocation of a 12-inch water line on Pearson partially located under pavement that was in conflict with the proposed location of the sewer line. Change Order No. 3 in the amount of $12,630.00 was approved on April 6, 2010 by the City Manager. The work consisted of approximately 285 linear feet of 4 inch under drain to be installed along the south edge of Primrose Lane to relieve the area of excess ground water for the purpose of stabilizing the road for paving activites. The current change order in the amount of $778,949.00 consists of several revisions to the design of the sanitary sewer within the Heatherwood Estates, Royal Oaks Addition, and Twin Creeks Addition neighborhoods as well as portions of the sewer along East Dove Road. Currently, the proposed location of the sewer line along these streets is approximately 5 feet back of curb on the west side of each street. Although the sewer will still be directionally bored, there is significant potential for sags or "bellies" to be created during installation of the sewer line. The City requires the contractor to repair the "bellies" before the line is accepted. These are well established neighborhoods with many large trees located on each lot. In addition, several of these properties have retaining walls and heavily landscaped areas located in the proposed alignment of the sewer line. Should a "belly" exist and require repair, the disruption to the residents' property can be minimized by placing the sewer line under the pavement. Moving the proposed sewer into the roadway where possible will minimize the impact to the property should a "belly" occur and require repair. The change order also reroutes the sewer line in Dove Road from Creekside Lane to connect to the sewer in Royal Oaks. This will partially relieve the load on the lift station previously proposed on Creekside and provide sewer service to the Dove Road locations in a shorter time frame. City Staff is currently evaluating the feasibility of relocating the lift station to Torian Lane. This change order also includes work associated with relocating approximately 700 linear feet of 12 inch water line from the north right-of-way into the west bound lane of East Dove Road due to a conflict with a 4-inch steel gas line. Waiting for Atmos Energy to relocate this 4-inch steel gas line would prove very lengthy and potentially extremely costly for the city. A significant portion of the cost of this change order is related to the requirement for placing Cement Treated Stabilization (CTS) over underground utility lines when open cutting existing pavement to ensure a stabilized base material for the flexible pavement surface. Although the sewer line is to be directionally bored, the contractor has significant risk of open cutting the pavement to make repairs of the sag locations. In addition, approximately 2,000 square yards of sod were needed to establish permanent erosion control along Primrose Lane to be in compliance with the City's erosion control ordinance. Financial Considerations: On November 3, 2009, the City Council approved a bid amount of $3,748,737.54. The previously approved change orders increased the total contract amount to $3,786,748.54. Staff recommends that City Council approve Change Order No. 4 in the amount of $778,949.00 resulting in a total project cost of $4,565,697.54. Staff recommends funding Change Order No. 4 from the unencumbered funds in the following existing CIP accounts budgeted for this project: 503699-598804-S0009 $ 250,000 502699-598804-U0025 $ 686,000 209499-598804-R0038 $ 178, 000 Total Available Budget $ 1,114,000 Strategic Link: The construction of the water, sewer, and paving improvements links to the city's strategy map relative to the focus areas of Infrastructure and Performance Management and Service Delivery.
