Price, P.E., Director of Public Works Subject: Ordinance No. 974, 2nd Reading, Adopt an ordinance to dedicate a 24' public access easement for public use on city - owned property on Lot 3R6, Block 1, Miron Addition (Miron Water Tower site) Action Requested: Ordinance No. 974, 2 nd Reading, Adopt an ordinance to dedicate a 24' public access easement for public use on city -owned property on Lot 3R6, Block 1, Miron Addition (Miron Water Tower site). Background Information: A 24 foot wide, 7,129.55 square foot Permanent Access Easement across city -owned property on Lot 3R6, Block 1, Miron Addition (Miron Water Tower site) was previously dedicated to Southlake 1709 Joint Venture, Martin Schilling, Trustee, in October, 2006 to benefit Lot 4R, Block 1, Miron Addition. Southlake 1709 Joint Venture is selling Lot 4R, Block 1, Miron Addition to another party and has requested an amendment to the easement to include their heirs, successor, and assigns to allow a transfer of the easement rights. Since the original dedication, the use of this easement has expanded to benefit other properties in the area. City staff feels the public would be better served if the easement was rededicated to the public rather than just to Lot 4R, Block 1, Miron Addition. The proposed Ordinance 974 will dedicate the access easement to the public for public use and will supersede the previous dedication. Financial Considerations: There are no costs to the City other than the normal filing fees to record the easement documents. Strategic Link: The proposed easement dedication links to the city's strategy map relative to focus area of Mobility, Infrastructure, and Performance Management and Service Delivery. The specific corporate objectives that are met by this right of way dedication are to provide travel convenience within the City and region, to invest to provide and maintain high quality public assets and to provide high quality customer service. Citizen Input/ Board Review: None. Legal Review: The ordinance has been reviewed by the City Attorney's office. Alternatives: The City Council may approve or deny the ordinance. ' IIQJaeO ORDINANCE NO. 974 AN ORDINANCE DEDICATING A 24' PUBLIC ACCESS EASEMENT FOR PUBLIC USE FROM CITY OWNED PROPERTY AT THE MIRON WATER TOWER SITE DESCRIBED AS LOT 3R6, BLOCK1, MIRON ADDITION IN THE CITY OF SOUTHLAKE, TARRANT COUNTY, TEXAS; DECLARING THAT SUCH EASEMENT IS NECESSARY FOR USE BY THE PUBLIC; AUTHORIZING THE MAYOR TO EXECUTE THE EASEMENT DEDICATION DOCUMENTS; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City of Southlake, Texas is a home rule city acting under its charter adopted by the electorate pursuant to Article XI, Section 5 of the Texas Constitution and Chapter 9 of the Local Government Code; and WHEREAS, the City Council of the City of Southlake has determined that the development of the Miron Addition demonstrates a need for a public access easement for public use from City owned property described as Lot 3R6, Block1, Miron Addition; and WHEREAS, the public access easement for public use will be provided to the benefit of the public and dedicated to the public; and WHEREAS, the City Council of the City of Southlake has determined that there is a public need for public access easement for public use from City owned property described as Lot 3R6, Block1, Miron Addition; and NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: SECTION 1 The City of Southlake grants a public access easement for public use to the City of Southlake, Tarrant County, Texas, more specifically shown in Exhibit "A" attached hereto and incorporated herein for all purposes and the easement is dedicated to the public in perpetuity. SECTION 2 The Mayor of the City of Southlake, Texas is hereby authorized and empowered to execute the aforementioned public access easement for public use Dedication. SECTION 3 A copy of the public access easement for public use Dedication shall be presented for filing with the County Clerk of Tarrant County, Texas by the office of the City Secretary. SECTION 4 It is hereby declared to be the intention of the city council that the phrases, clauses, sentences, paragraphs and sections of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council, without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section.
