Item 4F13 S0UTHLA1<,.,E CITY OF Department of Planning Development Services STAFF REPORT June 30, 2010 CASE NO: SV10 -011 PROJECT: Sign Variance for Carillon Office Development Temporary Sign REQUEST: Hines Southlake Land, L.P. is requesting a variance to the Sign Ordinance No. 704 -D requirements for sign height and sign area for a temporary land sign. Specifically, the applicant is requesting an extension on the approval of the existing temporary sign for Carillon Office Development, located at the 200 block of East S.H. 114 on the north side of the highway. The sign was approved by City Council on July 15, 2008 for a period of two years. The applicant is requesting a two year extension on the approval. PROPERTY SITUATION: The property is located on the north side of East S. H. 114, at the 200 block of East S. H. 114. HISTORY: July 15, 2008 City Council approved this temporary sign for a period of 2 years (SP08 -144). STAFF COMMENTS: The sign criteria, site plan and application are attached to this report. Case No. Attachment D SV10 -011 Page 1 Sign Variance Application Please demonstrate that the following conditions are applicable to the requested sign variance: That a literal enforcement of the sign regulation will create an unnecessary hardship or practicai difficulty on the applicant. It is our opinion that due to the distance from the highway, the speed of the traffic on Hwy 114, and the topography of the land that a sign of the dimensions allowed by the ordinance (48SF) would be ineffective. 2. That the situation causing the unnecessary hardship or practical difficulty is unique to the affected property and is not self imposed. On another property where the sign could be placed closer to the street, and where existing topography is not an issue, the existing ordinance is not prohibitive. However, because of the unique qualities of the Carillon property, the ordinance is prohibitive for an effective sign. That the variance will not injure and will be wholly compatible with the use and permitted development of adjacent properties. The height, size, and placement of the sign will not adversely affect adjacent properties. Adjacent properties will likely benefit from the permitted development. 4. That the variance will be in harmony with the spirit and purpose of the sign ordinance. The sign will be conservative in nature (see exhibit), and it is in harmony with the spirit and purpose of the sign ordinance which is to make potential customers aware of a business opportunity which will benefit the community as a whole.
