THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF
SOUTHLAKE, TEXAS; GRANTING A ZONING CHANGE ON A
CERTAIN TRACT OR TRACTS OF LAND WITHIN THE CITY OF
SOUTHLAKE, TEXAS BEING LEGALLY DESCRIBED AS TRACTS
4C & 6A2 AND A PORTION OF TRACTS 4D & 6A, J.G. ALLEN
SURVEY, ABSTRACT NO. 18, BEING APPROXIMATELY 30.1
ACRES, AND MORE FULLY AND COMPLETELY DESCRIBED IN

MORALS AND GENERAL WELFARE DEMAND THE ZONING
CHANGES AND AMENDMENTS HEREIN MADE; PROVIDING
THAT THIS ORDINANCE SHALL BE CUMULATIVE OF ALL
ORDINANCES; PROVIDING A SEVERABILITY CLAUSE;
PROVIDING FOR A PENALTY FOR VIOLATIONS HEREOF;
PROVIDING A SAVINGS CLAUSE; PROVIDING FOR
PUBLICATION IN THE OFFICIAL NEWSPAPER; AND PROVIDING
AN EFFECTIVE DATE.
WHEREAS, the City of Southlake, Texas is a home rule City acting under its Charter
adopted by the electorate pursuant to Article XI, Section 5 of the Texas Constitution and Chapter
9 of the Texas Local Government Code; and,
WHEREAS, pursuant to Chapter 211 of the Local Government Code, the City has the
authority to adopt a comprehensive zoning ordinance and map regulating the location and use of
buildings, other structures and land for business, industrial, residential and other purposes, and to
amend said ordinance and map for the purpose of promoting the public health, safety, morals and
general welfare, all in accordance with a comprehensive plan; and

WHEREAS, the hereinafter described property is currently zoned as "AG" Agricultural
District and "S-P-2" Generalized Site Plan District under the City's Comprehensive Zoning
Ordinance; and
WHEREAS, a change in the zoning classification of said property was requested by a
person or corporation having a proprietary interest in said property; and
WHEREAS, the City Council of the City of Southlake, Texas, at a public hearing called
by the City Council did consider the following factors in making a determination as to whether
these changes should be granted or denied: safety of the motoring public and the pedestrians
using the facilities in the area immediately surrounding the sites; safety from fire hazards and
damages; noise producing elements and glare of the vehicular and stationary lights and effect of
such lights on established character of the neighborhood; location, lighting and types of signs
and relation of signs to traffic control and adjacent property; street size and adequacy of width
for traffic reasonably expected to be generated by the proposed use around the site and in the
immediate neighborhood; adequacy of parking as determined by requirements of this ordinance
for off-street parking facilities; location of ingress and egress points for parking and off-street
loading spaces, and protection of public health by surfacing on all parking areas to control dust;
effect on the promotion of health ad the general welfare; effect on light and air; effect on the
over-crowding of the land; effect on the concentration of population, and effect on
transportation, water, sewerage, schools, parks and other public facilities; and,
WHEREAS, the City Council of the City of Southlake, Texas, further considered among
other things the character of the districts and their peculiar suitability for particular uses and the
view to conserve the value of the buildings, and encourage the most appropriate use of the land
throughout this City; and,

WHEREAS, the City Council of the City of Southlake, Texas, does find that there is a
public necessity for the zoning changes, that the public demands them, that the public interest
clearly requires the amendments, and that the zoning changes do not unreasonably invade the
rights of those who bought or improved property with reference to the classification which
existed at the time their original investment was made; and,
WHEREAS, the City Council of the City of Southlake, Texas, does find that the changes
in zoning lessen the congestion in the streets, helps secure safety from fire, panic, and other
dangers, promotes the health and the general welfare, provides adequate light and air, prevents
the over-crowding of land, avoids undue concentration of population, and facilitates the adequate
provision of transportation, water, sewerage, schools, parks and other public requirements; and,
WHEREAS, the City Council of the City of Southlake, Texas, has determined that there
is a necessity and need for the changes in zoning and has also found and determined that there
has been a change in the conditions of the property surrounding and in close proximity to the
tract or tracts of land requested for a change since the tract or tracts of land were originally
classified and therefore feels that the respective changes in zoning classification for the tract or
tracts of land are needed, are called for, and are in the best interest of the public at large, the
citizens of the city of Southlake, Texas, and helps promote the general health, safety and welfare
of the community.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF SOUTHLAKE, TEXAS:
SECTION 1.
That Ordinance No. 480, the Comprehensive Zoning Ordinance of the City of Southlake,
Texas, passed on the 19th day of September, 1989, as originally adopted and amended, is hereby

amended so that the permitted uses in the hereinafter described areas be altered, changed and
amended as shown and described below:
Being Tract 4C & 6A2 and a portion of Tracts 4D & 6A, J.G. Allen Survey,
Abstract No. 18, being approximately 30.1 acres, and more fully and completely
described in exhibit "A" from "AG" Agricultural District and "S-P-2"
Generalized Site Plan District to "R-PUD" Residential Planned Unit Development
District with amended "SF-20A" Single Family Residential District uses as
depicted on the approved Development Plan, including "R-PUD" development
standards, attached hereto and incorporated herein as Exhibit "B", and subject to
the following specific conditions:
1. Granting the requested variance to street frontage whereas all lots must front on a
public street. Noting that all residential lots will at least front on a common access
easement (private street) and private streets may be gated;
2. Subject to the applicant's proposed resident age restriction of fifty-five (55) years;
3. Subject to applicant's presentation, including but not limited to renderings of tennis
courts parking lot, open space along Union Church, and gates to be used.
4. Subject to four (4) trees per residential lot; and
5. Subject to Revised Development Plan Review Summary No. 1, dated August 17,
2007:
a. Provide a minimum 5 foot sidewalk along the north and west side of Private
Street C. In addition, the sidewalk on the east side of Private Street C is not
shown to connect to the S-P-2 portion of the development to the north.
Sidewalks (5' minimum) are required along both sides of all public and
private streets.
SECTION 2.
That the City Manager is hereby directed to correct the Official Zoning map of the City
of Southlake, Texas, to reflect the herein changes in zoning.
SECTION 3.
That in all other respects the use of the tract or tracts of land herein above described shall
be subject to all the applicable regulations contained in said Zoning Ordinance and all other
Ordinance No. 480-532 Page 4 of 27
applicable and pertinent ordinances for the City of Southlake, Texas. All existing sections,
subsections, paragraphs, sentences, words, phrases and definitions of said Zoning Ordinance are
not amended hereby, but remain intact and are hereby ratified, verified, and affirmed.
SECTION 4.
That the zoning regulations and districts as herein established have been made in
accordance with the comprehensive plan for the purpose of promoting the health, safety, morals
and the general welfare of the community. They have been designed, with respect to both
present conditions and the conditions reasonably anticipated to exist in the foreseeable future; to
lessen congestion in the streets; to provide adequate light and air; to prevent over-crowding of
land; to avoid undue concentration of population; and to facilitate the adequate provision of
transportation, water, sewerage, drainage and surface water, parks and other commercial needs
and development of the community. They have been made after a full and complete hearing
with reasonable consideration among other things of the character of the district and its peculiar
suitability for the particular uses and with a view of conserving the value of buildings and
encouraging the most appropriate use of land throughout the community.
SECTION 5.
That this ordinance shall be cumulative of all other ordinances of the City of Southlake,
Texas, affecting zoning and shall not repeal any of the provisions of said ordinances except in
those instances where provisions of those ordinances are in direct conflict with the provisions of
this ordinance.
SECTION 6.
That the terms and provisions of this ordinance shall be deemed to be severable and that
if the validity of the zoning affecting any portion of the tract or tracts of land described herein

shall be declared to be invalid, the same shall not affect the validity of the zoning of the balance
of said tract or tracts of land described herein.
SECTION 7.
Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to
comply with or who resists the enforcement of any of the provisions of this ordinance shall be
fined not more than Two Thousand Dollars ($2,000.00) for each offense. Each day that a
violation is permitted to exist shall constitute a separate offense.
SECTION 8.
All rights and remedies of the City of Southlake are expressly saved as to any and all
violations of the provisions of Ordinance No. 480, as amended, or any other ordinances affecting
zoning which have accrued at the time of the effective date of this ordinance; and, as to such
accrued violations and all pending litigation, both civil and criminal, whether pending in court or
not, under such ordinances, same shall not be affected by this ordinance but may be prosecuted
until final disposition by the courts.
SECTION 9.
The City Secretary of the City of Southlake is hereby directed to publish the proposed
ordinance or its caption and penalty together with a notice setting out the time and place for a
public hearing thereon at least fifteen (15) days before the second reading of this ordinance, and
if this ordinance provides for the imposition of any penalty, fine or forfeiture for any violation of
any of its provisions, then the City Secretary shall additionally publish this ordinance in the
official City newspaper one time within ten (10) days after passage of this ordinance, as required
by Section 3.13 of the Charter of the City of Southlake.

SECTION 10.
This ordinance shall be in full force and effect from and after its passage and publication
as required by law, and it is so ordained.

Developer's Narrative Letter
South Village at Watermere
R-PUD Development Regulations
August 6, 2007
This proposal is being made by Keller Watermere, LP and Southlake Watermark, LP, to
rezone the property from "AG" Agriculture and "S-P-2" Generalized Site Plan District to
a "R-PUD" Residential Planned Unit Development Zoning and will be known as the
South Village at Watermere. This 30.10-acre rezoning is part of the Watermere at
Southlake development. All residents of the South Village at Watermere will have access
to the clubhouse, open spaces, swimming pools, walkways, and other amenities of the
Watermere at Southlake development.
This presentation to the City of Southlake will document and provide information on:
1. Existing site conditions and adjacent property uses and zoning;
2. Description of the proposed development concept;
3. Description of the development improvements including paving, storm drainage,
water and sanitary sewer facilities.
Project Location
The South Village at Watermere is located on the north side of Union Church Road and
east of Pearson Lane. The western property line abuts the Chesapeake Place subdivision
which is zoned "R-PUD." The southern property line is the northern right-of-way line for
Union Church Road. Hidden Lakes, a 1,000-acre residential development in the City of
Keller, is located on the south side of Union Church. The northwest property line abuts
undeveloped property and the east property line abuts a tract of land this is currently
being used as a nursery. The north and northeast property lines abut Watermere at
Southlake that is currently under development.
Ownership
The property is currently owned by Keller Watermere, LP, and Southlake Watermark
Holdings, LP.
Proposed Zoning and Land Use
The proposed zoning of the South Village at Watermere is "R-PUD" Residential Planned
Unit Development Zoning District according to Section 30 of the City of Southlake's
Comprehensive Zoning Ordinance.. A separate submittal to change the Future Land Use
Map designation from Public/Semi-Public to Medium Density Residential and a revision
to the SP-2 zoning district for the original Watermere at Southlake is being made
concurrently with this submittal.

Purpose and Intent of Proposed District
It is a goal that the proposed neighborhood be well integrated into the surrounding areas
by extending thoroughfares and pedestrian paths throughout the site. The 30.10-acre site
will be developed as single-family detached housing for seniors with large areas of open
space for recreational purposes. The recreational facilities within the R PUD zoning
change will include two tennis courts, a swimming pool area with pavilions, gazebos,
walking trails, a three-acre pond with fountains and a fishing pier.
Development Concept
The South Village at Watermere will continue the quality development of Watermere at
Southlake and add to the already diverse and vibrant area. All residents of the South
Village at Watermere will have access to the clubhouse and other amenities within the
Watermere at Southlake development. The South Village at Watermere will provide
reciprocal access to the residents of Watermere at Southlake. All housing will be deed
restricted to residents ages 55 and older-to maintain the atmosphere of the Watermere
development..
Watermere Drive divides the property and will have open space on both sides of the
street. The open space on the east side of Watermere Drive will contain the 3-acre pond
with fountains and a fishing pier. Other amenities within this open space include a
swimming pool with pavilions, tennis courts, gazebos and walking trail adjacent to the
pond. The open space on the west side of Watermere Drive will feature walking trails,
gazebo and large amounts of green space, All proposed open areas will be landscaped
and irrigated..
Development Standards
The following Development standards shall apply to the proposed R PUD district:
1. Street Design Standards
a. Street Right-of-way
i. Private Residential Street - 50' utility, drainage, common &
emergency access easement, 27' B-B pavement
ii. Watermere Drive - 60' Right-of-way, 37' B-B pavement
b. On-street Parking
i. Parallel parking spaces shall be allowed within the 50' utility,
drainage, common & emergency access easement for the quad-
plex buildings located in the adjacent SP-2 zoning district.
c, No Alleys
d, Pavement Surfaces
i. All streets and sidewalks shall be constructed with reinforced
concrete.
ii. All crosswalks and the entry shall have stamped and stained
pavement.

2. Streetscape Standards
a. Sidewalks
i. Residential - 5' sidewalk.
ii, Watermere Drive -Meandering 5' sidewalk on west side, 8'
sidewalk on east side.
iii. Union Church Road - 6' sidewalk
b. Street Trees
i. Will be placed at irregular intervals along the residential street
frontages.
3. Open Space
a. Open space to consist of green space with walkways.
b.. The open space shall be fully landscaped and irrigated.
c. Maintenance shall be provided by the Homeowners Association that has
required membership of all residents. The Homeowners Association shall
have fine and lien rights as permitted by law to enforce compliance with
the rules and regulations of the association.
4. Block and Lot Standards
a. Minimum Lot area- 9,800 square feet
b. Minimum. Lot Width- 70 feet at building line
c. Minimum Lot Depth- 130 feet
d. Maximum Lot Coverage - 60%
5. Building Standards
a. Maximum Building Height- 35' or 2.5 stories

Variances
We are requesting the following variances with this zoning application:
1. Private Streets. The streets labeled as "Private Street A" and "Private Street C:"
are to be private gated streets. Watermere Drive will be a public street.
2. Street Width. The private streets will be permitted to be 27' feet from back of
curb to back of curb.
Homeowners Association
The South Village at Watermere will be part of the Homeowners Association that has
been established for the Watermere at Southlake development. The Association will be
responsible for maintaining all open spaces, amenities, private streets and fencing
throughout the development.
Open Space Management Plan
All open spaces within the "R-PUD" zoning district and the private streets, shall be
owned and maintained by the Watermere at Southlake Homeowners Association. The

Association shall have mandatory membership for all the homeowners in the
neighborhood. Dues shall be assessed and collected so that the property under the control
of the Association can be maintained in a high quality condition. The deed restrictions
and collection of dues shall be enforceable through lien rights and assessment of fines
and penalties as allowed by law.
Engineering Analysis
Roadways
The South Village at Watermere is bounded by Union Church Road to the south where
ingress and egress will be provided for a south entrance. Watermere Drive, a public
street, will be extended from the north through the subject property and connect to Union
Church Road. This connection will provide north/south ingress and egress from Union
Church Road to Southlake Boulevard. The individual lots will be served by private streets
that are gated.
A traffic impact analysis has been completed for this project. This report shows that
there will be minimum impact to Union Church Road.
Drainage
The South Village at Watermere is located in the Big Bear Creek Watershed and
generally drains from the north to the south. The three-acre pond will act as a detention
system for the stone drainage before the storm water is discharged across Union Church
Road. The detention system has been designed so that downstream properties will not be
adversely affected by the development of the South Village at Watermere. Detailed
drainage studies will be provided to the city with the submission of the construction
plans.
Water Distribution and Sewage Collection System
With this development, a new 12" waterline will be constructed along the frontage of
Union Church Road and connect to the existing 12" waterline in front of the Chesapeake
Place neighborhood.. A 8" waterline will be extended along the Watennere Drive with 8"
waterlines extending into the private streets. The development will be served by the
existing sanitary sewer line that runs through the eastern portion of the property. Detailed
construction plans for the utilities will be submitted to the city for review at the
appropriate time.
Summary
The South Village at Watermere is designed to be an extension of the Watennere at
Southlake development and to transition from Watermere at Southlake development to
the existing single-family developments. The South Village at Watermere will be a
positive addition to this part of Southlake and to the neighbors in Keller.
