No. ZA09-001, Lot 8, A. H. Chivers No. 299 Addition
REQUEST:
Onsom LLC is requesting variances to Subdivision Ordinance No. 483, as amended, to
extend the validity of Case ZA09-001, Plat Showing for Lot 8, A. H. Chivers No. 299
Addition. The plat was approved administratively on February 4, 2009. The plat has
not been filed in the County Plat Records and expired on February 4, 2010. The
applicant is requesting the validity of this plat be extended until February 8, 2011.
The property is located at 650 East S.H. 114 and the current zoning is “S-P-1” Detailed
Site Plan District.
VARIANCES
REQUESTED:
The following variances are requested to Subdivision Ordinance No. 483:
Plat Expiration:
1. Section 4.01(I)(2) stipulates that a plat showing which has not
been recorded in the County Plat records within one year of the date of approval
shall expire. The applicant is requesting an extension on the plat until February
8, 2011.
Plat Extension:
2. Section 4.01(I)(3) states that an approved plat’s expiration date
may be extended upon written petition for extension prior to the expiration date of
the plat. The applicant filed the petition prior to the expiration of the plat
however; the earliest available Council date for consideration is past the
expiration date.
ACTION NEEDED: Consider approval of plat extension
