Item 4BCITY OF SOUTH LAKE MEMORANDUM January 26, 2010 To: Shana Yelverton, City Manager From: Sharen Jackson, Director of Finance Timothy Slifka, Purchasing Manager Subject: Authorize award of contract for City of Southlake wrecker services to Euless B&B Wrecker Service Action Requested: Authorization to award contract for citywide wrecker services to Euless B&B Wrecker Service. Background Information: In December 2009, Southlake released a Request for Proposal for citywide wrecker services. Our current wrecker services contract is scheduled to expire in March 2010. The City received three responses to our request for proposal. The responding vendors were ABC Wrecker Services, Edd's Towing and Euless B&B Wrecker Service. The submitted proposals were evaluated by a four person panel per the following guidelines: Overall long term cost to the City including all fees (15% weighting), Vendor references (20% weighting), Past relationship with City (15% weighting), Submittal of all requested documentation (20% weighting), Storage facility requirements (20% weighting), and Vendors equipment (10% weighting). The evaluators were Police Chief Robert Finn, Police Deputy Chief Russell Daniels, Police Lieutenant Mike Dunn, and Purchasing Manager Tim Slifka. All proposing vendors were given the opportunity to clarify their proposals prior to the evaluation process to ensure accurate information was obtained. All vendors responded with their clarifications and these responses were included during the evaluation process. Based on the panel evaluation scoring, Euless B&B Wrecker Service was chosen as "Best Value" vendor for award. This recommendation is based on the following reasons: ♦ Overall Vendor Cost of all items. Euless B&B Wrecker Service ranked in the middle for overall cost. This includes all costs not just City of Southlake costs. ♦ Vendor references. All vendors faired well in regards to their references but the overall response we received from vendor references was Euless B&B Wrecker Service was by far the best available. ♦ Vendor past relationship with the City of Southlake. Our past experience with Euless B&B Wrecker has been exceptional. Their response time has been outstanding. Response to accident scenes to remove vehicles and re -open roads has also been outstanding. Complaints have been kept to a minimum. They are very professional, well versed in all aspects of wrecker services and more than willing to go above and beyond normal wrecker services when requested. ♦ Submittal of all requested documentation. This portion included documentation of verifiable references, copies of applicable insurance coverage's, all required licenses and certificates and listing of vendor's equipment. All vendors submitted required documentation. ♦ Storage facility requirements. Euless B&B Wrecker Service has approximately 2000 available spaces for storage. They have a fully secured storage facility which met all the proposal requirements without modification. ♦ Vendor's equipment. Euless B&B Wrecker Service has the largest fleet of wrecker vehicles and can perform all aspects of wrecker services in-house and without outsourcing. The evaluation committee scoring reflected high marks for Euless B&B Wrecker Services equipment and overall condition of equipment. The committee took into account the vendors overall fleet size in regards to the other City or businesses they currently serve. This was done to evaluate the perceived response time for a City of Southlake wrecker service call. The evaluation committee felt given the overall size of Euless B&B Wrecker Service they would be able to provide wrecker service within our required response time at all times regardless of weather or other conditions or events. The evaluation committee scored Euless B&B Wrecker Service highest in this area. Financial Considerations: Towing service costs for non -City services are charged to individual vehicle owners. City of Southlake wrecker services are funded through budgeted department vehicle maintenance accounts. Based on City of Southlake FY 2008-2009 wrecker services activity the annual estimated Southlake cost under this new agreement would be less than $2,500 dollars for City of Southlake wrecker services. Miscellaneous A. Independent Contractor: Proposer agrees that Proposer and Proposer's employees and agents have no employer -employee relationship with City. Proposer agrees that if Proposer is selected and awarded a contract, City shall not be responsible for the Federal Insurance Contribution Act (FICA) payments, Federal or State unemployment taxes, income tax withholding, Workers Compensation Insurance payments, or any other insurance payments, nor will City furnish any medical or retirement benefits or any paid vacation or sick leave. B. Assignments: The rights and duties awarded the successful Proposer shall not be assigned to another without the written consent of the Purchasing Manager. Such consent shall not relieve the assigner of liability in the event of default by the assignee. C. The 7-acre gated vehicle storage lot is lighted and video monitored by 18 video cameras. For additional protection of our customers, clients and staff all phone lines are recorded by our Dictaphone recording system. For over 40-years, the company was located at its original location, at 600 W. For over 40-years, the company was located at its original location, at 600 W. Euless Blvd. B & B has evolved into a 24-hour-a-day operation, and now comprises a fleet of 29 trucks, including one tons, super duties, flatbeds, medium duties, and heavy duty trucks, air bags, Landoll trailers, lowboy trailers, motorcycle trailers, service trucks, and other specialized equipment. Each of the trucks, have various capabilities, permitting towing and recovery under any and all conditions. There are currently 20 full-time drivers, who have been specifically trained to handle any requested service. The support staff includes 10 full-time dispatchers, 1 yard attendant and a full-time mechanic. In 1995, under the direction of the current owners, Andy Chesney & Debi Baker Chesney, construction began on the new B & B offices at 1201 W. Euless Boulevard. The office has a state of the art dispatch system and an 18 camera monitoring system of the office, shop and 7 acre storage lot. On Thursday, March 28, 1996, all operations were moved to the new location, and an exciting new chapter began in the history of B & B Wrecker Service. There is a great sense of pride and obligation that comes with owning and operating a business that has been in the family for so many years. That sense of pride extends to the employees of B & B as well. All B & B employees are welcomed and accepted into the business, just as though they are "a part of the family". This is indeed a unique organization to be associated with, in this day and time. And while success, and prosperity of B & B can be consistently measured by the repeat business from satisfied customers, exclusive contracts and renewals, and other referrals — the exceptional reputation of the company results from the honesty, and integrity, of the entire B & B family. Our reputation for excellent service can be proven by our track record with the city contracts that we currently hold. We have provided the towing and recovery services for the City of Euless since 1954 and the cities of Hurst and Bedford since 1990. We have worked on rotation in the City of Grapevine since 1988 and held the towing and recovery contract in the City of Southlake since 1988 as well. Company History The history of Euless/B&B Wrecker Service dates back to 1954 when Robert A. Baker opened with one truck and a garage at the corner of Ector and West Euless Blvd. in Euless. His son Bobby Baker joined him in 1958, the two of them worked together until Robert Baker's sudden death in 1975. Bobby continued running the wrecker service and the parts store, in which they had acquired, until 1982. Bobby bought out Robert's part of the parts store and Bernice Baker, Robert's wife, and her new husband took over the wrecker service. In 1983, Bernice sold the wrecker service to her daughter, Sandra Baker Hicks and her husband Ronnie Hicks, whom was the Assistant Fire Chief of Euless at the time. In 1984 Ronnie died of a heart attack at the age of 39 years old. Sandra tried to keep the business, however, it became very difficult and she decided to sell the company to her sister, Deborah Baker Chesney and her husband Andy Chesney in 1986. Andy and Debi started with the 5 trucks that the company had at the time and in the same location since 1954. In 1990 Andy and Debi bought a wrecker service in Southlake and expanded the business to cover the Grapevine- Southlake area in many capacities. In 1996, Andy and Debi bought 7 acres at 1201 W. Euless Blvd and built a 4,000 square foot office building and a 4,200 square foot shop with a wash bay. Andy and Debi now own 25 trucks which include not only 1 -ton tow trucks, but also several flat beds, medium duty, heavy duty and haul trucks. Everything needed for any kind of towing such as motorcycle trailer, air bags, trailers, etc. The office is equipped with the state of the art computer system as well as a security system for both office and storage lot. Statement of Change Any changes made to any personnel policy or practice will be provided to each employee, posted on the bulletin board or placed in a memo attached to the employee's paycheck. 4 General Policies & Procedures Anti -Harassment Policy and Complaint Procedure In providing a productive work environment, Euless/B&B Wrecker Service believes that its employees should enjoy a workplace free from all forms of harassment. It is the policy of Euless/B&B Wrecker Service to provide a work environment free from harassment. Prohibition Against Harassment Euless/B&B Wrecker Service will not tolerate harassment against any of its employees, whether based on sex, race, color, religion, national origin, age, or physical or mental disability. This prohibition covers harassment by anyone in the workplace — supervisors, co-workers, and non -employees. Anyone who violates this anti -harassment policy is subject to discipline up to and including termination for the first offense. Sexual Harassment Is Strictly Prohibited. Euless/B&B Wrecker Service strictly prohibits all forms of sexual harassment against any of its employees, male or female. Sexual harassment consists of any unwelcome behavior of sexual nature, which creates a hostile work environment. Sexual harassment also occurs when submission to sexual advances is a condition of a job benefit. Those forms of harassment may include, but are not limited to the following: • Epithets, slurs, negative stereotyping, derogatory remarks, or jokes that relate to race, color, religion, national origin, age, or disability • Physical threatening, intimidating, or hostile acts that relate to race, color, religion, national origin, age, or disability • Written or graphic material that denigrates or shows hostility or aversion toward an individual or group because of race, color, religion, national origin, age, or disability and that is displayed or circulated in the workplace Complaint Process Complaint: Any employee who believes that he or she has suffered sexual harassment or any other form of harassment should report the incident to Euless/B&B Wrecker Service as soon as possible so that prompt action may be taken. Euless/B&B Wrecker Service encourages victims of harassment to come forward. Further, any employee who is aware of any incident of harassment should report it as soon as possible. This complaint procedure is designed to allow an employee options as to whom he or she reports an incident of harassment. Complaints or incidents of harassment should be reported to any one of the following individuals with whom the reporting employee is most comfortable: • Office Manager (Human Resources Representative) • Dispatch Supervisor • Driver Supervisor • Andy or Debi Chesney Confidentiality: EulessB&B Wrecker Service will protect the confidentiality of harassment allegations to the extent possible. Euless/B&B Wrecker Service cannot guarantee complete confidentiality, since it cannot conduct an effective investigation without revealing certain information to the alleged harasser and potential witnesses. Investigative _Process Euless/B&B Wrecker Service has set up a mechanism for a prompt, thorough, and impartial investigation into harassment complaints. If a fact-finding investigation is necessary, it will be launched immediately and discreetly. The amount of time required to complete the investigation would depend on the particular circumstances. Euless/B&B Wrecker Service may undertake immediate corrective measures before completing the investigation to ensure that further harassment does not occur. Typically, the investigator will interview the complainant, the alleged harasser, and the third parties who may have 0 relevant information. Any interviews will be conducted privately, and as indicated previously, Euless/B&B Wrecker Service will take every reasonable precaution to maintain the confidentiality of those interviews. Once all of the evidence is in, Euless/B&B Wrecker Service will make a determination. Euless/B&B Wrecker Service will inform the parties of the determination. Immediate and A ro riate Corrective Action Euless/B&B Wrecker Service will undertake immediate and appropriate corrective action whenever it determines that harassment has occurred in violation of this policy. Any employee found to have violated this policy might be disciplined up to and including termination for the first offense. Euless/B&B Wrecker Service will design its corrective action to stop the harassment, correct its effects on the victim, and ensure that the harassment does not recur. Strict Prohibition Against All Forms Of Retaliation Euless/B&B Wrecker Service strictly prohibits all forms of retaliation against any employee who reports harassment or provides information related to a complaint of harassment. Euless/B&B Wrecker Service will undertake whatever measures are necessary to ensure that retaliation does not occur. Any employee, who believes that he or she has been the victim of retaliation as a result of having complained about harassment, or having participated in an investigation, should immediately bring the matter to the attention of Euless/B&B wrecker Service through the complaint process described above. Violation of this prohibition against retaliation is punishable by discipline up to and including termination for the first offense. Conflict of Interest An employee of Euless/B&B Wrecker Service is expected to perform their assigned responsibilities and to conduct personal activities in such a matter that they do not conflict with the best interests of the company. Any employee wishing to pursue outside employment must notify his/her supervisor of his/her intention to do so. We want each employee to understand that we feel his/her job at Euless/B&B Wrecker Service needs to take priority over a second job. Should other employment cause a conflict to us or affect your work performance, we will have a discussion with you. In addition, any employee who accepts any gifts from any competitor, customer, supplier, affiliate or other entity, will report such to their immediate supervisor. Management reserves the right to restrict such gifts. No employee shall be allowed to purchase or negotiate a purchase of any vehicle or part that is on our property without the explicit consent of Andy Chesney. No employee shall be allowed to take possession of any damaged part that has been taken off any vehicle that is in our care, custody or control without the explicit consent of Andy Chesney. 7 Confidential Information It is our policy that all our relationships with vendors and/or customers and any other information secured during your employment with us are of a confidential nature. Such information should never be released to a non -employee without prior approval from Andy or Debi Chesney. Information on employees will also be treated in a confidential manner. Requests for information on employees are not to be granted until the legitimacy of the request can be determined unless authorized by the employee in writing. We make an exception when verifications of employment are needed. Open Door Polic Euless/B&B Wrecker Service has a strong and open relationship with their employees. In light of our Open Door Policy, we do not believe a third party representative is necessary. We want you to know our Open Door Policy so that you can participate in sharing your suggestions with us. We want you to know we will fully respect your rights as employees under all laws. Euless/B&B Wrecker Service encourages open and frank discussion between employees and management to share ideas, make suggestions and prevent or resolve problems. It is company policy to provide the open communication necessary for better understanding and or action when appropriate. Whenever an employee has questions or concerns related to an employment situation, he/she should proceed according to the following process: 1) First discuss concerns with Office Manager. 2) If a problem persists, he/she should request a meeting with the Driver or Dispatch Supervisor and Andy or Debi Chesney. 3) A conclusion and decision should be reached within a reasonable time period. The decision reached is final. Problem Solving Satisfactory working relationships depend a great deal on understanding among people. Good relationships are easier to achieve when people feel that their problems and opinions can be discussed freely and frankly. If you have a problem that you feel needs to be brought to the attention of management, please discuss it with your immediate supervisor. If it is not solved within five (5) working days, please discuss it with the Office Manager, a Supervisor, or Andy or Debi Chesney. Safety Policy Euless/B&B Wrecker Service is committed to providing a safe and healthy working environment for employees, customers, and authorized visitors. To accomplish this, it is our policy to comply with all current occupational health, safety, and environmental laws and develop the best, feasible operations and procedures. An organized and effective safety program will be carried out company -wide to make this policy work. The safety program will assist all employees in controlling the hazards, which will minimize employee accidents, customer injuries, damage to customer's property and damage and destruction of company property. Safety Rules • Report all injuries immediately following their occurrence. • Safety guards or devices are not to be altered in any way. • Defective tools or equipment should be taken to Shop Manager for repair. • Ensure all safe operating procedures and instructions from your Supervisor. • Report any safety hazards to the Shop Manager or the Driver Supervisor. First Report of Injury All employees are required to report an occupational injury or disease immediately, and in no case more than 24 hours, to their immediate supervisor. This will assist your supervisor in the completion of the required forms. We must fill out a First Report of Injury form. The employee may be required to seek medical assistance, or take a drug/alcohol test as stated by DOT. Emergency situations will be treated at the nearest hospital. OSHA The company is required by law to adhere to safety regulations and requirements as administered by the U.S. Department of Labor --- Occupational Safety and Health Administration (OSHA). OSHA was created to ensure safety violations do not take place. Please abide by all of our set safety standards. Accident Insurance We provide Accident Insurance in place of Workers' Compensation as provided by the state laws. You will be provided with the latest copy of the insurance information at the time of hire. 0 Firearms & Knives Policy Firearms and/or other types of dangerous weapons are not allowed on our property. Persons found to possess firearms or other weapons will face our immediate progressive discipline policy up to and including immediate termination. Any threats of or bodily harm to others with a firearm or other weapon will result in immediate termination and the employee's actions will be called to the attention of the proper authorities. Riuht to Search Policy Our right to search policy has been implemented to reduce theft, provide a safe work environment and maintain a drug and alcohol free workplace. Failure to submit, upon request, to a search of any company property or personal property located in our facility, may lead to progressive discipline up to and including immediate termination. Desks, file cabinets, files, work material, cars in our parking lot, lockers, tow trucks and all company vehicles, etc. are considered fair game in a company search. Any time there is reasonable suspicion that an employee is involved in the use or sale of illegal drugs and/or alcohol or is violating any other company policy/procedure, we may, at our sole discretion, choose to search any of the above items/locations. We also may elect to use camera surveillance in any open and appropriate areas. All phone lines are recorded at all times and we may use these recordings at any time to prove or disprove a problem. Workplace Violence/Incident, Investigation Policy It is our policy to make reasonable efforts to provide for the security of Company property, employees, customers and authorized visitors to its premises. Violations of company security rules or procedures will result in disciplinary action, up to and including termination. In addition, illegal acts committed by employees will be reported to law enforcement authorities. Employees are subject to search, surveillance, and interrogation whenever the company has reasonable suspicion to maintain security. Our procedures in addition to our problem solving policy, for investigation incidents regarding workplace violence and safety violations are as follows: • Reviewing all previous incidents; • Visiting the scene of an incident as soon as possible; • Interviewing threatened or injured employees and any witnesses; 10 • Examining the workplace for security risk factors associated with the incident, including any previous reports or inappropriate behavior by the perpetrator(s); • Attempting to determine the cause of the incident; • Taking immediate corrective action to prevent the incident or violation from recurring; • Recording the findings and taking all corrective actions as needed to eliminate risk. Failure or inability to meet and/or comply with any special security requirement, including extensive background checks, is grounds for progressive discipline up to and including immediate termination of employment or rejection of an applicant. Drug & Alcohol Policy Euless/B&B Wrecker Service is committed to providing a safe, healthy, and efficient work environment and likewise, expects its employees to report to their jobs physically and mentally fit for work. Furthermore, the company is committed to assuring its continued representation as a quality business enterprise. To achieve these goals, we must take a firm and positive stand against alcohol or other drug abuse. This policy is intended to ensure a drug free environment for the benefit of employees and customers of Euless/B&B Wrecker Service. Being under the influence of alcohol or other drugs on the job possesses serious risks to the user and others. It is our objective to eliminate abuse. Possession, use or sale of an illegal drug will not be tolerated. Alcohol consumption during working hours will not be tolerated. If you know or suspect anyone that might be using, selling or possessing drugs, or drinking or appears to have been drinking, please notify a Supervisor, Andy or Debi Chesney immediately. Policy Details: i) Violation of this policy will result in immediate disciplinary action up to and including termination. 2) Current employees may be required to submit to a screen test if any one or more of the following incidents occur: a) On the job accident; b) Abusive language or gross insubordination; c) Violent behavior; d) Involvement in a safety violation; and e) If management has reasonable suspicion that the employee uses, possesses, is under the influence of, or has distributed alcohol or other drugs. In addition, the company may at any time conduct routine tests if there is reasonable cause to believe that there has been use or possession of alcohol or other drugs. 11 An employee's refusal to consent to an alcohol/drug test will result in the employee's termination. While on company business in a social setting, (i.e. entertaining customers, Company events, or other social events you are attending based on your employment at the company, etc.), please use good judgment, maturity and restraint. DRUG TESTING POLICY 86.710. Responsibilities of Towing Company Licensee --Drug Testing Policy. (New section adopted effective April 15, 2008, 33 TexReg 2940) (a) A towing company adopting paragraphs (1) - (12) of this subsection will comply with Texas Occupations Code, §2308.158. (1) Purpose and Scope. This drug testing policy provides guidance to supervisors and towing operators about their responsibilities under this policy. Except as stated in paragraph (12), this policy applies to all towing operators and all towing operator job applicants. (2) Definitions. The words and terms used in this policy shall have their ordinary meaning unless the words or terms are used in Texas Occupations Code, Chapter 2308 or Title 49 Code of Federal Regulation Part 40, in which event the words or terms shall have the meaning designated in those regulations. (3) Consent Form. (A) Before a drug test is administered, towing operators and applicants are required to sign a consent form authorizing the test and permitting release of test results to the medical review officer (MRO), the company, and the department. The consent form shall provide space for employees and applicants to acknowledge that they have been notified of the drug testing policy. (B) The consent form shall set forth the following information: (i) the procedure for confirming and verifying an initial positive test result; (ii) the consequences of a verified positive test result; and (iii) the consequences of refusing to undergo a drug test. (C) The consent form also provides authorization for certified or licensed attending medical personnel to take and have analyzed appropriate specimens to determine if the tested drugs were present in the towing operator's or applicant's system. 12 (4) Compliance With Drug Testing Policy. The failure or refusal by a towing operator or applicant to cooperate fully by signing necessary consent forms or other required documents or the failure or refusal to submit to any test or any procedure under this policy in a timely manner will be grounds for refusal to hire or for termination. The submission by an applicant or employee of a urine sample that is not his/her own or is a diluted specimen shall be grounds for refusal to hire or for termination. (5) General Rules. This drug testing policy is governed by these general rules: (A) towing operators shall not take or be under the influence of any drugs unless prescribed by the employee's licensed physician. (B) towing operators are prohibited from engaging in the manufacture, sale, distribution, use, or unauthorized possession of illegal drugs at any time. (C) all towing company property is subject to inspection at any time without notice. There should be no expectation of privacy in or on such property. Towing company property includes, but is not limited to, vehicles, desks, containers, files, and lockers. (D) any towing operator convicted of violating a criminal drug statute shall inform his/her supervisor of such conviction (including pleas of guilty and nolo contendere) within five days of the conviction occurring. Failure to inform the supervisor subjects the employee to disciplinary action up to and including termination for the first offense. The towing company will notify the Texas Department of Licensing and Regulation of the conviction (including pleas of guilty and nolo contendere). (6) Types of Tests (A) Pre -employment. All applicants for positions requiring a towing operator's license, who have received a conditional offer of employment, must take a drug test before receiving a final offer of employment. (B) Annual. All towing operators employed by a towing company must complete at least one scheduled drug test each 12-month period from the date of the initial license or renewal. (C) Random Testing. In addition to annual testing, towing operators are subject to random urine drug testing. Under this policy, annual random test for drugs of at least 25 percent of the total number of towing operators is required. (i) A minimum of 15 minutes and a maximum of two hours will be allowed between notification of a towing operator for random urine drug testing and the actual presentation for specimen collection. (ii) Random donor selection dates will be unannounced with unpredictable frequency. 13 (D) Return -to -Duty and Follow -Up. (i) Any towing operator who has violated this drug testing policy and is allowed to return to work must submit to a return -to -duty test. Follow-up tests will be unannounced, and at least six tests will be conducted in the first 12 months after a towing operator returns to duty. Follow-up testing may be extended for up to 60 months following return to duty. The test results of all return to duty and follow-up must be negative. (ii) The towing operator will be required to pay for his or her return -to -duty and follow- up tests accordingly. (7) Drug Testing. The drugs for which tests are required under this policy are marijuana, cocaine, amphetamines, phencyclidine (PCP), and opiates. (8) Specimen Collection Procedures. (A) All urine specimens will be collected by a laboratory that is certified and monitored by the Federal Department of Health and Human Services. (B) Drug testing procedures include split specimen procedures. Each urine specimen is subdivided into two bottles labeled as a "primary" and a "split" specimen. Only the primary specimen is opened and used for the urinalysis. The split specimen bottle remains sealed and is stored at the laboratory. (C) If the analysis of the primary specimen confirms the presence of drugs, the towing operator has 72 hours to request sending the split specimen to another Federal Department of Health and Human Services (DHHS) certified laboratory for analysis. The towing operator will be required to pay for his or her split specimen test(s). (D) For the towing operator's protection, the results of the analysis will be confidential except for the testing laboratory. After the MRO has evaluated a positive test result, the towing operator will be notified, and the MRO will notify the company. (E) The towing company will notify the department of the positive test result. Notification to the department must occur within 3 days of receipt of the confirmed test results from the MRO. The notification must include the: (i) tow operator's name; (ii) tow operator's license number; (iii) date of the positive test; (iv) substance detected by the drug test; and (v) disciplinary action imposed violation of the drug testing policy. 14 (9) Reporting and Reviewing of Drug Testing Results. (A) The company shall designate a medical review officer (MRO) to receive, report, and store testing information transmitted by the laboratory. This person shall be a licensed physician with knowledge of substance abuse disorders. (B) The laboratory shall report test results only to the designated MRO, who will review them in accordance with accepted guidelines and the procedures adopted by the Federal Department of Transportation. ""V_j-xepufe5 Toifr the laboratory to the`MR091fall 'be 1n'writing'or 6y tax. lhe'MRu may talk with the towing operator by telephone upon exchange of acceptable identification. (D) Neither the company, the laboratory, nor the MRO shall disclose any drug test results to any other person except under written authorization from the towing operator, unless such results are necessary in the process of resolution of accident (incident) investigations, requested by court order, or required to be released to parties having a legal right -to -know as determined by state and federal law. (10) Distribution of Information to Towing Operators. The minimal distribution of information for all towing operators will include the display and distribution of: (A) informational material on the physical and mental effects of drugs; (B) an existing community services hotline number, available drug counseling, rehabilitation, and assistance program; (C) the company's policy regarding the use of prohibited drugs and/or alcohol; and (D) the consequences or disciplinary action that may be imposed upon VSF employees for violating the drug policy. (11) Consequences of a Confirmed Positive Drug Test. (A) Job applicants will be denied employment if their initial positive pre -employment drug test results have been confirmed. (B) If a towing operator's positive drug test result has been confirmed, the towing operator will stand down from towing operation duties and may be subject to disciplinary action up to and including termination. (C) The company may consider the following factors in determining the appropriate disciplinary action: the towing operator's work history, length of employment, current work assignment, current job performance, and existence of past disciplinary actions. 15 (D) No disciplinary action may be taken pursuant to this drug policy against towing operators who voluntarily identify themselves as drug users, obtain counseling, rehabilitation and comply with return to duty and follow-up drug testing. (12) Exceptions. (A) Towing operators subject to random drug testing under Title 49, Code of Federal Regulation, Part 40 who have been randomly tested in the 12-month reporting period are exempt from the annual test requirement, provided that the towing operator's tested negative and the negative test results are submitted to and verified by the MRO. (B) Towing operators holding a valid Towing Operator License issued by the department who are tested for drugs in accordance with 16 Texas Administrative Code Chapter 85 are exempt from this section. (b) Independent drug testing policy. (1) A towing company may file an independent drug testing policy. (2) The filing must describe how the independent drug testing policy is as stringent as each provision of the model policy set forth in subsection (a). Employment Status Regular Full-time Employ — is one who has successfully completed his/her introductory period and who is normally scheduled to work forty (40) or more hours per week. Regular Part-time Employee — is one who has successfully completed his/her introductory period and who is normally scheduled to work less than 40 hours per week. Introductory Employee — is either full or part-time, but has worked less than ninety (90) days. Introductory Employment Period Employees are selected on the basis of ability, competence and experience. The first ninety (90) days of employment is considered a get acquainted period, therefore, all new employees are hired on a ninety (90) day introductory period. During this period, the employee has the opportunity to demonstrate the proper attitude and ability to perform the job. The company or the employee without any prior notice may terminate employment any time during the first ninety (90) days of employment. 16 Near the end of the ninety (90) days, his/her Supervisor will determine whether or not to convert your employment status to "regular" or terminate your employment, and will review the employee. Successful completion of the introductory period does not guarantee continuing employment. All employees must meet company policy, rules, standards of performance, and could be subject to discharge for violation of policies, rules, standards for poor job performance, or reduction in force or other reasons. Other Policies Dress Code and Uniforms Policy All employees are expected to present a professional, business -like appearance to our customers at all times. Office personnel need to come to work dressed in business -casual clothing appropriate to a professional office environment. No short dresses/skirts spandex material shorts over -sized t-shirts or any type of clothing that has inappropriate writing or is low cut and/or baggy. Cleanliness, neatness and clothing appropriate for your position are expected. Inappropriate dress will be dealt with on an individual basis. The Supervisor or Office Manager will make the final determination as to whether the clothing is acceptable or not. If you are uncertain, please check with your Supervisor first. Exposed body piercings or exposed tattoos are not acceptable. Please make sure that you remove all exposed body piercings and cover exposed tattoos before coming to work. While we want to respect each employee's own style and personality we must, however, maintain a professional appearance. Drivers must be in uniform during scheduled hours and while on calls. Driver's uniform rental and cleaning will be deducted from each weekly paycheck, in an amount not to exceed $25.00 per week. Any outstanding amount of lost or damaged uniforms will be deducted from the final paycheck or escrow. The final paycheck will not be given to an employee until all uniforms are turned in or have been paid 17 for out of final paycheck. Any uniforms purchased through the uniform company (i.e. jeans, jackets, overalls, coveralls, etc) are the personal property of the driver and no amount will be refunded to the driver by Euless/B&B Wrecker Service, Inc. at any time. Customer Service Our customers are our number one priority. Therefore, it is crucial that we quickly greet each customer when they walk through our doors. Customers should be treated professionally and courteously at all times. Even during hectic periods, customers should still be greeted and told they will be helped as soon as possible. This lets the customer know that they are important to us. Escrow Euless/B&B Wrecker Service, Inc will withhold an amount not less than $25.00 per week from my weekly wages to be held in an escrow account. The escrow account must meet and maintain a minimum balance of $500.00 to cover the cost of damages or lost items caused by me while employed by Euless/B&B Wrecker Service, Inc. If an employee quits without notice, or is terminated for gross misconduct, any monies remaining in their escrow will be forfeited. If an employee quits or is terminated and owes Euless/B&B Wrecker Service for anything, that amount will be withheld from either Escrow or Paycheck. Gross Misconduct Our Definition of Gross Misconduct may include, but not limited to Drug/Alcohol Abuse, Theft, Lying, Intentional falsification or Destruction of any company records and/or property, harassment or any other unlawful action. Visitors Visitors are only allowed in our reception area and are not allowed into other areas without management approval. In addition: 1. Visits by personal friends of employees are discouraged; 2. Visitors should not wander around our facility unescorted. The employee should escort their visitor; and 3. Safety is always our primary concern for you and your visitor. Company Property An employee is expected to exercise due care in the use of company property and to utilize such property only for authorized purposes. Negligence in the care and use of 18 company property may be considered cause for suspension and/or your immediate termination. Unauthorized removal of company property from the premises or its conversion to personal use will be considered cause for suspension and or immediate termination. Company property issued to an employee must be returned to the company at the time of termination of employment or when it is requested by a Manager. All trucks will be inspected. The equipment belongs to Euless/B&B Wrecker Service. It is furnished to you for business use. You are not to make any modifications to the truck unless authorized by Andy Chesney. The cost to repair any such damages will be withheld from your wages or escrow. Money drawer is the responsibility of the counter help or dispatcher on each shift. Your drawer must balance to $200.00 at the beginning and end of each shift. If there is an overage when you balance you will turn that money in to the safe. If there is a shortage, you are responsible for that money as well. Drivers are responsible for all of assigned invoices. We charge $65.00 for each lost invoice. Personal Property The company assumes no responsibility for the loss or damage to the personal property of an employee. Company Vehicles Personal or business use of company vehicles is prohibited without prior approval. Unauthorized personal use of a company vehicle will subject the employee to the progressive discipline policy up to and including immediate termination. Employment of Relatives The company reserves the right to hire the most qualified candidate for our job openings. Should a relative of an employee be hired, we will review the supervisory/subordinate relationship. Telephone Policy It is the policy of Euless/B&B Wrecker Service to limit the personal use of company telephones to calls received or made only during lunch or breaks. Personal long distance calls should only be made with prior approval and the employee will be responsible for the charges. Any calls pertaining to a business nature do not need prior approval. 19 Dispatchers should have their cell phones turned off while at work unless it is an emergency. Misuse of any telephone line could result in immediate termination. Be accurate, prompt and courteous when on the phone with a customer. If you are unable to answer the caller's questions, or are unsure of the correct information, immediately direct the caller to a qualified individual. Business Expenses Employees incurring authorized business expenses associated with the performance of job duties will receive reimbursement, with prior approval. Customer Vehicles When a customer leaves their vehicle with us, we are responsible for its care and treatment. This includes the personal belongings in the vehicle. All parts removed from a customer vehicle shall remain the property of either the customer or the company. As such, no customer parts or personal belongings shall be removed from the premises without prior authorization from Andy Chesney. All vehicles should be secured and protected from the weather at all times. Smoking Smoking is strictly prohibited in all office areas. Compensation and Benefits Pay Periods Payroll checks are cut on Thursday and distributed on a weekly basis on every Monday after 11:OOam following the prior work week, defined as Thursday morning through Wednesday night. Paychecks will be released to the employee, in person, unless the Office Manager has received prior authorization from the employee. Errors in Paychecks Please read your paycheck carefully when you receive it. If you notice errors, please bring them to the attention of the Office Manager, regardless of who it benefits. We will do our best to correct the error immediately, and in all cases no later than your next paycheck. Unclaimed Paychecks P Paychecks not claimed by employees at the time of paycheck distribution will be returned to the Office Manager. Lost Paychecks Employees are responsible for their paychecks after they have been issued. Checks lost or otherwise missing should be reported immediately to the Office Manager so that a stop payment order may be initiated. The Office Manager shall determine when and if a new check should be issued to replace a lost or missing check. Employee shall be responsible for any stop payment fee issued by our bank. Garnishments By law, the company is required to honor legal garnishments of employee's wages or salaries. If required by court order to garnish an employee's wages, we may elect to withhold an administrative fee as allowed by law. Work Hours Our scheduled work hours will vary based on your position with the company. All hours will be discussed with an employee when hired. If an overtime or change of schedule need arises, we will try to provide as much notice as possible. Time Cards All employees (as designated by position) are required to use the time clock to record their hours worked. Under no condition shall an employee record time for another employee. You must clock in and out for lunch. Once an employee has punched in, he/she must begin work immediately. No Exceptions. Any employee who must leave our facility for personal business during the work day must punch out and then back in when they return. Clock in Time: The time to clock in is when you are ready to start on your particular work related project. The time to clock in is after you deal with personal needs (i.e. greeting friends, refreshments, uniforms, restroom, etc.). Clock out Time: The time to clock out is when you are ready to stop on your particular work related project. The time to clock out is before you deal with personal needs (i.e. cleaning up, greeting friends, refreshments, uniforms, restroom, etc.). 21 Again, the Wage and Hour Laws allow us no margin for error. Please make every effort to be as accurate as possible when using the time clock. Lunch Lunchtime is generally thirty (30) minutes but may vary based on business necessity. Employees are required to take their lunch period and to clock in and out unless pre - approval is arranged to work through your lunch, or unless the business necessity does not allow for the entire thirty (30) minutes. Our customers and other company business have priority over lunchtime and break time. Ignoring the telephone or a customer will be dealt with through our progressive discipline policy. Overtime All overtime must be approved in advance, or be a business necessity at then beginning or end of your shift. Working overtime without advance approval will result in progressive discipline. Overtime is the time in excess of forty (40) hours, which is actually worked in a one -week pay period. Salaried and commissioned employees are not eligible for overtime. Your supervisor must approve the overtime for payment. Please clock as close to your scheduled in/out times as possible. You may make an exception if you arrive early and are needed to cover an excessive workload. Vacation Pay All full-time employees are eligible for one (1) week of paid vacation after 1 year of employment and two (2) weeks of paid vacation after 3 years of employment. They may be taken in 1 day increments with prior approval from the Supervisor. Vacation pay will not be used for sick days or family illness unless approved by Andy or Debi Chesney. Five (5) days may be carried over to the next anniversary year. We do not pay for vacation days not taken unless authorized by Andy or Debi Chesney. Any unused portion of earned vacation days will be forfeited upon separation of employment. Holidays Euless/B&B Wrecker Service is open 24 hours a day 365 days a year. Therefore, we do not pay overtime or holiday pay for any nationally observed holiday. 22 Simple IRA Retirement Plan Any employee will be eligible to participate in the plan after grossing $4500.00 in wages for two (2) consecutive years. The amount you choose to contribute will be deducted from your weekly wages. You are allowed to contribute the maximum that the law provides. Euless/B&B Wrecker Service will match up to 3% of your gross salary, provided we had an increase in revenue from the prior year. Medical/Dental Insurance The insurance premium will be deducted from your weekly wages. Information provided after 90 days of full-time employment. You are responsible for the remaining insurance premium due through the end of the month of separation from employment or leave of absence. This amount will be held from your paycheck or escrow. It will be the employee's responsibility to maintain their current insurance plan during a leave of absence. Monthly premiums MUST be PREPAID, by the employee, directly to Euless/B&B Wrecker Service or coverage will be canceled. Cobra Insurance will NOT be offered to anyone that has been terminated for Gross Misconduct. Time Off From Work Absentee and Tardiness Control Program This program is designed to: • Eliminate failure to report absenteeism/tardiness in advance; • Reduce absenteeism/tardiness, and; • Ensure that all cases of absenteeism/tardiness and failure to report are treated consistently and uniformly. You were hired because we needed you at work, every day, on time. Your most basic obligation to your company is to be at work, every day, on time, unless there is a compelling reason for absence or tardiness, you have a duty to notify the company in advance so that necessary adjustments can be made. A record of absenteeism and lateness will result in the following discipline: No Call/No Show An employee who fails to call in for a scheduled shift in order to report an absence shall be deemed as having voluntarily resigned. 23 Attendance Any unexcused absences, (unpaid, non approved in advance), in any twelve (12) month period, will be dealt with through the following progressive discipline; • 1st unexcused absence verbal warning • 2nd unexcused absence written warning • P unexcused absence termination Consecutive day absences constitute one occurrence. Tardiness/Lateness If you are late, you should not make up the time at the end of the day, you may stay over your scheduled time only if there is a business necessity. Your pay is docked if you are more than eight (8) minutes late. Excessive tardiness is defined as more than two (2) lates in any one calendar month period and will be grounds for the following progressive discipline within a twelve (12) month period: • Three (3) lates in a one -month period verbal warning • Three (3) lates in a second -month period written warning • Three (3) lates in a third -month period possible termination Bad Weather We never close our doors for business. If you are unable to drive to work or obtain a ride on your own in the case of extreme weather conditions, contact the office and we will try to make other arrangements. Call In Policy If an employee is unable to report to work, they are required to call their Immediate Supervisor at least one (1) hour prior to the start of the scheduled work shift, and no later than one-half (1/2) hour after the start of the scheduled work shift, on each day not worked. If the Immediate Supervisor does not receive a call, then the employee will be subject to progressive discipline. Family & Medical Leave Euless/B&B Wrecker Service is not required, by law, to follow Federal FMLA guidelines. Leave of Absence 24 If you are ill or injured, you may apply for a leave of absence for a period specified by your physician up to a maximum of 2 months. During a leave of absence, you may not accept other employment or be self-employed. You will be expected to report to your designated Supervisor on a weekly basis or you will be considered to have quit. Please understand that when you take a leave of absence your position may not remain available as we must maintain a productive business. You are required to submit a written release from your physician when you are able to return to work. You must also be able to perform all aspects of your assigned position before being allowed to return to work. Euless/B&B Wrecker Service cannot guarantee job vacancy once an employee begins a leave of absence. Bereavement Leave Full-time employees will be eligible for a funeral leave up to three (3) paid days for immediate family which includes: spouse, children, step -children, parent, grandparent, sister, or brother, mother-in-law, and father-in-law. Please contact you Supervisor if you need more than three (3) days off. Paid time off must be used for the additional time off. Military Leave We will abide by federal and state laws in regards to military leaves of absence. Please provide the Office Manager with your orders as soon as you receive them. Jury Duty Any employee who has been called for jury duty will receive up to a maximum of three days off without pay to serve for a particular case. Extended duty for said case, over and above the three (3) days, will be granted only after written notification from a court officer. A certificate of attendance is required on the first day the employee returns to work. Personal Conduct & Performance People working together are expected to follow a reasonable code of conduct for the mutual welfare and safety of all. The following rules of conduct are designed to serve as a common sense guide to improper employee activities. This list is intended as an example only and is not intended to indicate all those acts that could lead to employee discipline. Corrective Approach to Rule Violations: In all but the most serious cases, corrective action may include a verbal or written warning, suspension and/or immediate termination. When corrective action is necessary, normally it will progress as follows: 25 1" violation verbal or written warning 2"d violation written or company option or three (3) day suspension 3rd violation company option of three (3) day suspension or termination. The action appropriate in any case depends upon: 1. The seriousness of the offense; 2. The nature of previous violations; and 3. When previous violations occurred. A rules violation which occurred outside the most recent twelve (12) month period will not be considered in determining corrective action appropriate under current circumstances. The following are examples of major offenses that may result in immediate termination: I . Unauthorized release of confidential information. 2. Reporting to work under the influence of illegal drugs or alcohol and/or possessing or using illegal drugs or alcohol while at work. 3. Intentional destruction or misuse of property of the company, an employee, a supplier or a customer. 4. Theft of company property or property of others. 5. Possession of weapons on company property at any time. 6. Insubordination, which includes: a. Failure or refusal to obey reasonable orders or instructions of any supervisor; b. Use of abusive or threatening language toward any supervisor; c. Any conduct which may seriously undermine necessary supervisory authority. 7. Violation of the company's ethical standards or conflict of interest policy. 8. Clear and willful negligence on company premises, which creates a substantial, risk of, or actually causes serious personal injury or property damage. 9. Violation or company's Equal Employment Opportunity or Harassment Policies. 10. Intentional falsification or destruction of any company records including time cards. 11. Fighting on company premises or during working hours. 12. Threatening, intimidating or coercing employees, supervisors, customers, visitors or vendors at any time. 13. Discourtesy or disrespect to a customer. 14. Leaving or walking off the job, or failure to return to work during your scheduled work hours. 15. Sleeping on the job or similar obvious failure to perform assigned work during working time. 16. Discussing pay or raises with any other employee or any potential employee. 17. Misuse of DMV Access and Records. 18. Removing anything from the office of a supervisor. 26 19. Removing any company or employee property from the premises. 20. Failure to meet reasonable standard of efficiency, productivity or performance. Violation of any of the following rules will ordinarily result in progressive corrective action previously described: 1. Violation of the absentee and tardiness control program. 2. Intentionally interfering with the work or job of a customer, vendor or another employee. 3. Conducting personal business during working hours. 4. Refusal to work scheduled hours, including reasonable overtime when required, without satisfactory excuse verified upon request. 5. Inappropriate dress or poor personal hygiene. 6. Failure to report a known mistake by yourself or another person which could substantially affect the company's operations. 7. Immoral or indecent behavior. 8. Eating a meal at the counter, unless there is no one to relieve you. 9. Making or receiving an excessive number of personal phone calls. 10. Having cell phones on during work hours (for dispatch). 11. Leaving the office for the day without all of your paperwork finished or without balancing your drawer. 12. Allowing your part-time job to interfere with this full-time position. Resignations & Terminations Procedures for Written Notice We request that each hourly employee submit his/her resignation in writing at least two (2) weeks in advance for the final workday. We request that each salaried employee submit his/her resignation in writing at least three (3) weeks in advance of the final workday. 27 Metal fence surrounding entire property.
