Item 4J Department of Planning & Development Services S T A F F R E P O R T October 1, 2008 ZA07-033 CASE NO: Plat Extension for Autumn Creek PROJECT: REQUEST: Riordan Capital Properties, LP is requesting approval of a variance to the Subdivision Ordinance No. 483, Section 4.01(I) (Plat Expiration), as amended, and is requesting that the validity of Case No. ZA07-033, Plat Revision for Autumn Creek, be extended for an additional one year from the date of the City Council’s action on this item. Section 4.01(I) states that a Final Plat which has not been recorded in the County Plat Records within one year of the date of approval shall expire. The Plat Revision was approved by City Council on July 17, 2007. Final plats for subdivisions requiring the installation of streets and utilities are typically not recorded until these improvements have been installed and are ready to be accepted by the City. This insures that street right-of-ways and easements are correctly shown based on as-built conditions and also insures that all the new lots of record are properly served by streets and utilities. The plat revision for this development has not been recorded due to construction delays and has thus expired. If approved, the new expiration date for Autumn Creek would be July 17, 2009. Hood, No. 706 Addition LAND USE CATEGORY: Low Density Residential CURRENT ZONING: “SF-1A” Single Family Residential District HISTORY: A zoning change to “SF-1A” single family residential district and a single lot plat were approved in February of 1995. A plat revision was approved by City Council for 3 lots on August 2, 2005. A preliminary plat (ZA07-029) and plat revision (ZA07-033) were approved by City Council on July 17, 2007 for Autumn Creek, a 7-lot residential subdivision.
