Todd Parrish called the January 28, 2010 17 meeting to order at 6:31 p.m. 18 19 Agenda Item No. 2 - Approval of the Minutes: Chairman Parrish opened discussion of the 20 minutes of the Zoning Board of Adjustment meeting held on January 14, 2010. 21 22 Motion was made to approve the minutes of the Zoning Board of Adjustment meeting held on 23 January 14, 2010 as presented. 24 25 Motion: Smith 26 Second: Waldman 27 Ayes: Amend, Forman, Waldman, Smith, Mills, Parrish 28 Nays: None 29 Abstain: Fairchild 30 Vote: 6-0-1 31 32 Motion carried. 33 34 Agenda Item No. 3 - Administrative Comments: Richard Schell, Planner II, announced that 35 no cases for the February 11, 2010 meeting were received and the next Zoning Board of 36 Adjustment meeting is scheduled for February 25, 2010. 37 38 Agenda Item No. 4 - ZBA-587 Special Exception Use Permit for a portable building. 39 Special Exception Use Permit per Ordinance No. 480, Section 44.12 (7) for a portable building 40 to be used for Sunday school classrooms on property located at 190 S. White Chapel Blvd. 41 Zoning ordinance No. 480, Section 44.12.7.c requires the approval of a portable building shall 42 be on a temporary basis only and shall be for a maximum period of three (3) years. In addition, 43 all portable buildings must be placed upon a permanent foundation and shall have a masonry 44 facade meeting the requirements of the City's Masonry Ordinance. The applicant is seeking re- 45 approval of the existing portable building for the maximum period of three (3) years. City Council 46 granted a variance to the masonry requirements for a period of one year on January 19, 2010. If 47 a Special Exception Use Permit is granted for a period of greater than one year, the applicant 48 will be required to go back to Council after the one year period expires to request another 49 variance to the Masonry Ordinance or to add a masonry fagade to the building meeting the Zoning Board of Adjustment Meeting - January 28, 2010 Page 1 of 2 50 requirements of the Masonry Ordinance. City staff has determined that the portable building as 51 placed and tied down meets the requirement of a permanent foundation. 52 53 The property is located at 190 S. White Chapel Blvd., being described as Lot 4, H. Granberry 54 No. 581 Addition, an addition to the City of Southlake, Tarrant County, Texas. The current 55 zoning is "CS" Community Service District. Applicant: Chuck Hallett of Bethel Methodist Church, 56 the owner is NMEM, Ltd. 57 58 Richard Schell, Planner II reported eight (8) notices went out within two hundred (200) feet with 59 no responses. 60 61 The applicant, Chuck Hallett, 190 S. White Chapel Blvd., Southlake, Texas, once sworn in 62 presented items and answered questions for the Board. 63 64 Chairman Parrish opened the public hearing for ZBA Case # 587 at 6:53 p. m. 65 66 Kevin Leaverton, 100 Londonberry Terrace, Southlake, Texas spoke against the time extension 67 feeling the unsightly structure is affecting property values and with the time frame given to the 68 City Council was adequate time for the church to relocate. 69 70 Chairman Parrish closed the public hearing for ZBA Case # 587 at 6:58 p.m. and opened 71 discussion for the Board. 72 73 Motion was made to approve the ZBA Case # 587 for a one year period subject to continuous 74 use by the current occupant. 75 76 Motion: Fairchild 77 Second: Smith 78 Ayes: Forman, Fairchild, Smith, Waldman, Parrish 79 Nays: None 80 Abstain: None 81 Vote: 5-0 82 83 Motion carried. 84 85 Agenda Item No. 5 - Meeting Adjournment: Chairman Parrish adjourned the meeting at 86 7:04:27 p.m. on January 28, 2010. 87 88 89 90 91 92 93 D.
