Price, P.E., Director of Public Works Subject: Approve Change Order No. 1 for the construction contract with JLB Contracting in the amount of $88,961.56 for paving, drainage, and utility improvements to Shumaker Lane and Sunshine Lane. Action Requested: Approve Change Order No. 1 for the construction contract with JLB Contracting in the amount of $88,961.56 for paving, drainage, and . utility improvements to Shumaker Lane and Sunshine Lane Background Information: The FY 2006 Capital Improvements Program (CIP) Budget included funds for the paving, drainage, and utility improvements on Shumaker Lane and the FY 2007 CIP Budget included funds for Pavement Management Improvements that will be used for the paving and drainage improvements on Sunshine Lane. On March 4, 2008, the City Council originally awarded a construction contract to Jackson Construction as recommended by City Staff. Jackson Construction requested the contract be terminated after easement acquisition delayed the start of construction creating increased material costs and scheduling conflicts. The City Council terminated the contract on October 7, 2008. The City Council then awarded a new contract to the second low bidder, JLB Contracting, in the amount of $897,191.66 with a contingency amount of $129,808.34 to allow for a change order for increased material costs. The total project budget is $1,027,000.00. JLB Contracting began work onNovember 10, 2008. Change Order Number 1 includes the increased material costs component and two additional cost components. One, for a concrete flume to channel storm water runoff, before it reaches downstream property owners, to the proposed storm drain inlet that will be constructed at the north end of Shumaker Lane. The addition of the flume was instrumental in obtaining the necessary easements from downstream property owners. The second additional construction cost component is for a sanitary sewer bore to save an existing oak tree on Shumaker Lane portion of the project. Financial Considerations: The awarded contract amount, including construction phase contingencies is $1,027,000. Approval of this change order will increase the approved contract amount from $897,191.66 to $986,153.22. The FY 2006 Capital Improvements Program (CIP) included funds in the amount of $389,218.00 for the paving and drainage improvements on Shumaker Lane and $101,360.00 for the water and sewer improvements in Shumaker Lane. The total funding available for the Shumaker Lane improvements is $490,578.00 and the total funding required is $490,360.00 with the contingency amount. The FY 2007 Capital Improvements Program (CIP) included funds in the amount of $1,200,000.00 for the paving improvements to remedy deficiencies identified by the Pavement Management Assessment (PMA) program. Sunshine Lane is one of the streets identified in this program. The total funding currently available is $1,133,564.00 and the total funding required for Sunshine Lane is $536,640.00 with the contingency amount.
