Price, P.E., Director of Public Works Subject: Resolution No. 09-070 Authorizing the Filing of a Project Application with the State Energy Conservation Office (SECO) for an Energy Efficiency Conservation Block Grant (EECBG) Action Requested: City Council approval of Resolution No. 09-070, authorizing the Filing of a Project Application with the State Energy Conservation Office (SECO) for an Energy Efficiency Conservation Block Grant (EECBG). Background th Information: On February 17, 2009, President Barack Obama signed into law the American Recovery and Reinvestment Act (ARRA) of 2009. The ARRA provides for Energy Efficiency and Conservation Block Grants (EECBG) to the states to fund energy efficient projects and stimulate the economy. The EECBG Program for the State of Texas is being administered through the State Energy Conservation Office (SECO). SECO is responsible for projects that improve energy efficiency and reduce fossil fuel emissions. The City of Southlake is eligible to apply for an energy conservation grant through SECO in an amount up to $75,000. City staff has submitted a signed Notice of Intent (NOI) to SECO. The second step in the grant application process is for the City Council to approve Resolution No. 09-070. The SECO requires that the governing body of the local government seeking grant funds approve a resolution authorizing the project application, designate an authorized representative, and receipt of funding if the project is approved. Once approved, City staff must send an original of the resolution to SECO postmarked by Sunday, November 22, 2009. Grant application timeline: Notice of Intent (NOI) Form due within 45 days; Resolution due within 60 days (by November 22, 2009); SECO will send out a final allocation letter and application to accepting cities within 75 days; Application due within 90 days; Within 180 days, the Comptroller and the City of Southlake will execute a grant agreement that contains al the requirements and obligations related to expending the EECBG funds; EECBG funds must be obligated within 6 months of the effective program award date; EECBG funds must be expended within 36 months of the effective program award date; and For the duration of the energy efficient project construction, the City of Southlake shall submit a monthly progress report, th due on the 25 of each month, per SECO guidelines to the Comptroller. Financial Considerations: Need for Grant Funding rd On the November 3, 2009 City Council session, Council approved lighting upgrades to the Southlake Town Square West parking garage in an amount of $107,178.85. Similar lighting upgrades are desirable at the East Parking Garage; however, funding is not available at this time for this retrofit. The total cost to upgrade the lighting in the East Parking Garage is estimated at $86,200. Applying for the SECO grant is an opportunity for the City to receive up to $75,000 that may be used to upgrade the lighting in the Southlake Town Square East Parking Garage. These lighting upgrades will reduce electricity costs to the City, reduce pollution, and will provide for additional safety and security to Town Square patrons. No City funding is presently identified to supplement the SECO grant in an amount of $11,200 to perform the lighting upgrades to the East Parking Garage. City staff proposes to fund the remaining dollars out of the Facilities electricity line item recognizing that the City will realize a cost savings in this line item from the project. Price, P.E., Director of Public Works, x8098 Cristina McMurray, C.P.M, Assistant to the Director, x8650 RESOLUTION NO. 09-070 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS AUTHORIZING THE FILING OF A PROJECT APPLICATION WITH THE STATE ENERGY CONSERVATION OFFICE (SECO) FOR AN ENERGY EFFICIENCY & CONSERVATION BLOCK GRANT (EECBG) FUNDED BY THE AMERICAN RECOVERY AND REINVESTMENT ACT (ARRA) FOR A LOCAL ENERGY EFFICIENT PROJECT; AUTHORIZING CRISTINA MCMURRAY, ASSISTANT TO THE DIRECTOR, TO ACT ON BEHALF OF THE CITY OF SOUTHLAKE IN ALL MATTERS RELATED TO THIS APPLICATION; AND PLEDGING THAT IF FUNDING FOR THIS PROJECT IS RECEIVED, THE CITY OF SOUTHLAKE WILL COMPLY WITH ALL CONTRACTUAL REQUIREMENTS OF THE ARRA, THE EECBG PROGRAM AND THE STATE OF TEXAS. WHEREAS, Congress passed the American Recovery and Reinvestment Act (ARRA) of th 2009 and the President signed into law on February 17, 2009, to stimulate the economy and create jobs; and, WHEREAS, ARRA included $3.2 billion in funding for the Energy Efficiency and Conservation Block Grants (EECBG) Program authorized in Title V, Subtitle E of the Energy Independence and Security Act (EISA) and signed into law on December 19, 2007; and, WHEREAS , the purpose of the EECBG Program is to 1) reduce fossil fuel emissions in a manner that is environmentally sustainable, and to the maximum extent practicable, maximizes benefits for local and regional communities; 2) to reduce the total energy use of eligible entities; and 3) to improve the energy efficiency in the building sector, the transportation sector, and other appropriate sectors; and, WHEREAS, the City of Southlake is a city with limited financial resources and desires to support the development of energy efficiency programs; and, WHEREAS, the City of Southlake City Council passed Resolution No. 02-047 on August 20, 2002 establishing a Comprehensive Energy Policy which supports energy efficiency measures in order to reduce electric consumption by the existing facilities of the City, and promote the social responsibility for environmental protection; and, WHEREAS, the City of Southlake accepts its allocation and may also accept additional funds that may become available at a later date; and, 1 of 2 WHEREAS, the City of Southlake has developed or is interested in developing a EECBG project, which is sustainable and has measurable energy savings, and economic stimulus effects into the city; and, WHEREAS, the City of Southlake is determined to support energy efficiency projects that leverage federal funds with other public and private resources, including coordinated efforts involving other Federal programs targeting community development; and, WHEREAS, the City of Southlake intends to comply with all agreed upon contractual requirements of ARRA, the EECBG program and other federal and state law: NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS, THAT: SECTION 1. Shana Yelverton, City Manager, or her designee is authorized to request grant project funding under the State Energy Conservation Office’s Request for Project Applications of the Energy Efficiency and Conservation Block Grant Program, and act on behalf of the City of Southlake in all matters related to the grant application and any subsequent project contract that may result. SECTION 2. The City pursue all EECBG funding made available through ARRA and being allocated by the State Energy Conservation Office to be used to assist in reaching the City’s goals of energy efficiency. SECTION 3. The City continue its commitment toward energy efficiency for the citizens of the City of Southlake and all of Texas. SECTION 4.
