CITY OF SOUTH LAKE MEMORANDUM October 13, 2009 To: Shana Yelverton, City Manager From: Chris Tribble, Director of Community Services Subject: Approve a Guaranteed Maximum Price Amendment with Dean Electric, Inc., dba Dean Construction, in the amount of $10,245,740 for Construction of Bicentennial Park Improvements Phase I Action Requested: Approve a guaranteed maximum price amendment with Dean Electric, Inc., dba Dean Construction, for construction of Bicentennial Park Improvements, Phase I in the amount of $10,245,740. Background Information: The City has been working with Schrickel, Rollins and Associates (SRA) to design Phase I improvements for Bicentennial Park. Working with SRA, the City advertised Requests for Proposals for Construction Manager at Risk on May 17, 2009 and May 24, 2009. Responses were received and opened on June 17, 2009. A review committee recommended Dean Construction to the Parks & Recreation Board, Southlake Parks Development Corporation (SPDC) and City Council. The Parks and Recreation Board and SPDC recommended Dean Construction to City Council. City Council approved a Construction Manager at Risk contract with Dean Construction on August 4, 2009. Dean Construction advertised for construction bids on August 23, 2009, August 30, 2009, and September 6, 2009. Bids were opened on September 23, 2009. Based on the bids received for the current scope of work, the total construction cost for Phase I is $10,245,740. The budget available is $10,297,000. The current scope, as presented, does not include the remodel of the Evans House and adjacent parking, sidewalks and landscaping. This element of the project has been removed due to extensive foundation damage present at the house and the 4C- 1 Shana Yelverton, City Manager Meeting Date — October 20, 2009 Page 2 of 2 corresponding costs to repair and remodel ($581,503). The estimated construction completion date is January 2011. Financial Consideration: The total construction cost for Phase I of Bicentennial Park Improvements is $10,245,740. Total budget amount for Phase I is $10,297,000. Strategic Link: This item is linked to the City's Strategy Map related to the focus area of Quality Development and meets the corporate objectives to Invest to Provide and Maintain High Quality Public Assets and to Provide Attractive and Unique Spaces for Enjoyment of Personal Interests. Citizen Input/ Board Review: Multiple public meetings have been held since 2006 including SPIN, Parks Board, SPDC and City Council meetings. Parks Board recommended approval 7 -0 at their October 12, 2009 regular meeting. SPDC will consider this item on October 20, 2009. Legal Review: The attached agreement has been reviewed by the City Attorney. Alternatives: Alternatives may include: • Approve Guaranteed Maximum Price amendment with Dean Construction as presented • Approve Guaranteed Maximum Price amendment with Dean Construction with input as desired • Not approve Guaranteed Maximum Price amendment. (the Construction Manager), for BICENTENNIAL PARK - PHASE I (the Project), the Owner and Construction Manager establish a Guaranteed Maximum Price and Contract Time for the Work as set; forth below.
