Item 9B Department of Planning & Development Services S T A F F R E P O R T September 30, 2009 CASE NO:SV09-018 PROJECT:Variance for Mendez Office Building REQUEST: Structures & Interiors, Inc., on behalf of East Southlake #2 Ltd., is requesting a variance to the Sign Ordinance No. 704-D regulations for maximum height of a monument sign for a business fronting a regional boulevard. The Mendez Office Building is located at 910 E. Southlake Boulevard. Specifically, the applicant is requesting a maximum monument sign height of 9 feet 10 inches to accommodate what has been recently constructed on a berm. Under the Sign Ordinance No. 704-D, the maximum allowed height for a monument sign for a business that fronts a regional boulevard is 8 feet; and is measured from the nearest pavement which in this case is the entrance driveway. The applicant constructed their monument sign late August, 2009. The sign exceeds regulations because a berm was created which is significantly higher than the closest pavement. In Addition, the sign face height exceeds the allowable height of 6 feet. The ordinance allows a sign base of 2 feet and a sign structure of 6 feet. The sign was constructed without showing the 2 feet of sign base. OWNER: East Southlake #2 LTD PROPERTY SITUATION: The property address is 910 E. Southlake Boulevard HISTORY: January 24, 2005 A sign permit was issued for a monument sign for the building located at 900 E. Southlake Boulevard. June 7, 2005 A conditional sign permit was approved by City Council allowing 3 signs on the south façade of the building located at 900 E. Southlake Boulevard. January 6, 2009 A conditional sign permit was approved by City Council allowing 3 signs on the south façade of the building located at 910 E. Southlake Boulevard. The stipulations were that the signs look identical in terms of color and font to the signs of the adjacent building at 900 E. Southlake Boulevard. May 11, 2009 A sign permit was issued for a monument sign at 910 E. Southlake Boulevard. The plan submitted did not include the berm. Upon inspection of the sign after installation, it was determined the sign exceeded the maximum permitted height due to the berm.
