Price, P.E., Director of Public Works SUBJECT:ZA 09-039 – Specific Use Permit for a Mass Gathering Event for Home for the Holidays and Festival of Trees at Southlake Town Square - Comments relative to Valet Services Component With respect to the above referenced request which includes a valet services request for 4 locations in the Southlake Town Square development, the Public Works Department offers the following comments: 1.Currently, one Valet Services Permit has been issued in the Town Square Development. Permit No. 09-001 was issued to Truluck’s Seafood Steak and Crab House on May 16, 2009. Truluck’s offers valet services to their customers at no cost through Dallas Valet Services. 2.Ordinance 904 is the ordinance that regulates valet services in the public right-of-way. While the approval of this SUP would supercede the valet services ordinance, the upholding of the intent of the ordinance provisions is recommended. As such, the following provisions of Ordinance 904 are recommended to be included in any motion approving the valet services under this SUP. a. The director of Public Works may revoke the valet services authorization under this SUP if he/she determines that the operation of the valet parking service would: 1. Endanger the safety of persons or property or otherwise not be in the public interest; 2. Unreasonably interfere with pedestrian or vehicular traffic; 3. Unreasonably interfere with the use of a pole, traffic sign, traffic signal, hydrant, mailbox or other object permitted at or near the proposed location of the valet parking service; or 4. Unreasonably interfere with an existing use or other license permitted at or near the proposed location of the valet parking service. b. The police or fire chief, or their designated representatives, may temporarily suspend the operations of a valet parking service if the public street or right-of-way reserved by the valet parking service is needed for an emergency or temporary use. c. The valet services operator shall comply with Section 5-263, Standards for operation of a valet services service of Ordinance No. 904. Case No. Attachment D ZA09-039 Page 1 d. The valet services operator shall comply with Section 5-264, Valet parking services stands of Ordinance No. 904. e. The valet services operator shall comply with Section 6-266, Insurance of Ordinance No. 904 and submit a Certificate of Insurance to the City of Southlake prior to the initiation of . valet services f. The valet services operator shall comply with Section 6-267Indemnification and hold harmless of Ordinance No. 904. 3.The above information should be submitted to the Public works Department on an annual basis 45 days prior to the initiation of valet parking services if a multi-year approval of the SUP is given. WHEREAS , a Specific Use Permit for a mass gathering event for Home for the Holidays and Festival of Trees has been requested by a person or corporation having a proprietary interest in the property zoned as “DT” Downtown District; and, WHEREAS , in accordance with the requirements of Sections 45.1 (36) & 45.14 of the City’s Comprehensive Zoning Ordinance, the Planning and Zoning Commission and the City Council have given the requisite notices by publication and otherwise, and have afforded the persons interested and situated in the affected area and in the vicinity thereof; and, WHEREAS , the City Council does hereby find and determine that the granting of such Specific Use Permit is in the best interest of the public health, safety, morals and general welfare of the City. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SOUTHLAKE, TEXAS: SECTION 1. A Specific Use Permit is hereby granted for a mass gathering event for Home for the Holidays and Festival of Trees on the property located at Southlake Town Square, being legally described as Southlake Town Square, Phase One, an addition to the City of Southlake, Tarrant County, Texas, according to the plat recorded in Cabinet ‘A’, Slide 4892, Plat Records, Tarrant County, Texas, more fully and completely described in Exhibit “A”, and as depicted on the approved Site Plan attached hereto and incorporated herein as Exhibit “B” and providing an effective date, subject to the provisions contained in the comprehensive zoning ordinance and the restrictions set forth herein.
